A former Microsoft senior programming manager has been charged with raping a woman who worked as a custodian in his Redmond office.

Prosecutors say Vineet Kumar Srivastava, 36, was on the third floor of Building 27 when he motioned for the custodian to follow him to his office. She did thinking he needed something cleaned or the trash taken out.

As soon as she entered his office, Srivastava pulled her blouse down and made a sexual comment, then picked up his cellphone and started showing pornographic images, according to court documents.

"He asked her if she liked it and (the victim) cried, 'No' covering her face," King County Sheriff's Detective Laura Murphy wrote in a probable cause document. "(She) tried to leave, but Srivastava slammed the door shut and prevented her from leaving. He proceeded to (grab) her around both arms and fondled her buttocks."

Srivastava then demanded oral sex, saying his wife was in India, prosecutors said.

The woman "continued to struggle to get out of Srivastava's hold and continuously told him, "No, let me go,'" Murphy wrote. "Srivastava overpowered (her) and prevented her from escaping his hold."

Investigators said the woman, 32, was slammed to the floor and raped for several minutes.

Graphic investigation documents show the woman told her supervisor, but he discounted her story and "he failed to report it to the authorities."

The alleged rape was eventually reported to another supervisor who called police. The woman was examined the following day at Overlake Hospital in Bellevue, and results from the examination were recorded as evidence. That day, the woman also picked Srivastava from a lineup, investigators said.

Murphy reported seeing visible bruises on both of the woman's shoulders consistent with pressure. She said they were from her struggle with Srivastava.

The following day, July 26, Srivastava was arrested at the Microsoft campus.

"Srivastava claimed (the woman) forced him to have sexual intercourse with her and he was afraid of (her)," Murphy wrote. "He said she forced him into his office and lifted her blouse and bra, exposing her breasts and telling him she wanted to have 'sex' with him. … He said he was afraid of her."

Srivastava said he had no bruising or injuries from the incident, court documents show.

He was booked into King County Jail that day, but posted $75,000 bond on July 27. Despite his lack of criminal history, prosecutors argued that Srivastava was a flight risk and “a danger to the community.”

Srivastava is expected to have an arraignment later this month.

Ex-Microsoft manager charged with raping office janitor

A former Microsoft senior program manager was charged last week with second-degree rape for allegedly forcing himself on a janitor inside his office on the company’s Redmond campus.

Vineet Kumar Srivastava, 36, was arrested July 26, four days after he allegedly raped a 32-year-old woman, charging papers say. He spent 24 hours in the King County Jail before posting a $150,000 bond, jail records show.

King County prosecutors — noting that Srivastava had worked for Microsoft only for one month and that he has the means to travel — had asked a judge to order Srivastava to relinquish his passport as a condition of his release. According to a spokesman for the King County Prosecuting Attorney’s Office, Srivastava’s defense team said his passport had been turned over to the court.

Microsoft spokesman Lou Gellos said Tuesday that Srivastava’s employment was terminated after the alleged attack. Gellos said Microsoft contracts with an outside company to provide cleaning services.

According to charging documents, the alleged victim was cleaning the third-floor kitchen in Building No. 27 around 11 p.m. on July 22 when Srivastava approached her and motioned for her to follow him down the hall to his office. She grabbed her cleaning supplies and followed him, “assuming he needed something clean(ed) in his office,” the papers say.

Once inside the office, Srivastava allegedly grabbed the woman’s breasts and buttocks, showed her pornographic videos on his cellphone, then slammed her to the floor and raped her, charging papers say. The woman screamed and struggled to get away, then lay on the floor crying while Srivastava left the office to dispose of the condom he wore during the attack, according to the papers.

The woman called her supervisor but couldn’t reach him until nearly 1 a.m. on July 23. When she did, the supervisor “discounted what she reported and he failed to report it to the authorities,” charging papers say. The woman reported the incident to a female supervisor the evening of July 24, and that supervisor called police, according to the papers, which do not indicate the name of the cleaning company. While he declined to name the cleaning company, Gellos said he would pass along a reporter’s contact information to the company.

Redmond police say Srivastava claimed the woman forced him to have sex, saying he was “afraid of her,” but had retrieved a condom from his car, then reluctantly returned to his office because he “felt like he had no choice,” charging papers say. “He said he should have been stronger but was missing his wife who has been in India” since July 8, according to the charges.

The charging papers note that Srivastava said he had no injuries or bruising after the incident, while the woman had bruises on both shoulders “that appeared consistent with finger pressure.” The woman identified Srivastava from a photo montage and also turned over unwashed clothing that she was wearing at the time of the alleged attack, the papers say.

According to court records, Srivastava has retained David Allen and Todd Maybrown of Allen, Hansen & Maybrown, a Seattle criminal defense firm, to represent him.
