KARACHI, July 26: The trial of the Arshad Pappu murder case has been transferred to another anti-terrorism court on a directive of the Sindh High Court, it emerged on Friday.

The transfer order became public a day after SHC Chief Justice Mushir Alam called a report from the provincial police chief for not arresting Uzair Jan Baloch, the chief of the banned People’s Amn Committee, who is an absconder in the Arshad Pappu murder case.

Alleged Lyari gangster Arshad Pappu, his brother Yasir Arafat and their confidant Juma Shera were killed on the night of March 16 and their bodies were found in the Kalakot area.

Court sources said that the case was transferred from the ATC-III to the ATC-II for trial on a directive of the SHC.

Earlier, the presiding officer of the ATC-III, Judge Ghulam Mustafa Memon, had sent a reference to the SHC registrar requesting him to transfer the case in question to any other court for trial citing some ‘personal reasons’, they added.

The ATC-III had recently directed the police to initiate proceedings against absconding accused under Sections 87 (proclamation for persons absconding) and 88 (attachment of property of person absconding) of the criminal procedure code since the warrants were not executed and the police informed the court that they failed to arrest the absconders as they went into hiding.

On July 25, CJ Alam asked the provincial police officer to submit a report as to why Uzair Jan Baloch, the banned PAC chief and an absconder in the Arshad Pappu murder case, was not arrested by the police when he was accessible to the media.

Shahjehan Baloch, a Pakistan Peoples Party MNA from Lyari, Zubair Baloch, Zakir Dada, Abdul Rehman and Yousuf Baloch, said to be a policeman and under treatment at a hospital, were charge-sheeted in the case.

Uzair Jan, Habib Jan, Noor Mohammad alias Baba Ladla, his brother Zahid Ladla, Asif Kana, Faisal Pathan, Yasir Pathan, the then SHOs of the Chakiwara and Kalakot police stations, Chand Khan Niazi and Javed Baloch, were the absconding accused in the case.

The police had also arrested Sub-Inspector Mohammad Baqar for his alleged involvement in the case, but the investigation officer released him under Section 497(2) of the CrPC for want of sufficient evidence.

According to the prosecution, the alleged gangster along with his brother, confidant and 10-year-old son had gone to attend the party of a friend in Defence Housing Authority on the night of March 16. However, Pappu’s son returned his home around midnight and informed his mother about the abduction of his father and others.

Their bodies were thrown near Brohi Chowk in the Kalakot area and some residents spotted the bodies, identified them and informed the police, but the bodies of Pappu and his brother were taken away by killers, it added.

They were killed after being subjected to torture and the bodies of Pappu and his brother were thrown in manholes in the Kalakot area after being defaced and mutilated, it added.

On a directive of the Supreme Court, a case was registered under Sections 302 (premeditated murder), 365 (kidnapping), 297 (trespassing on burial place, etc), 392 (punishment for robbery), 109 (abetment) and 34 (common intention) of the Pakistan Penal Code read with Section 7 of the Anti-Terrorism Act, 1997 at the Kalakot police station.

Now judge of ATC-II has been terrorized by gang war of Lyari … He is no more interested to hear this case … And case has been transferred to ATC-III … Judges are avoiding to proceed cases against gang war due to their fear … A important accused of this gang war police constable Bakar Baloch has released on personal bond … It means Justice Mushir Alam is now trying to do something to release Uzair Baloch respectfully ……………
