KARACHI: Lawyers on Monday disrupted the proceedings of the model criminal trial courts established in the metropolis in line with a decision of the National Judicial Policy Making Committee to conduct ‘swift trials’ in old criminal cases, judicial staff said.

A group of lawyers, including representatives of the Karachi Bar Association, led by its president Naeem Qureshi reportedly went to the model criminal trial courts of districts South, East and Central at the City Courts at around 9am and asked the judges to stop hearing the cases, they said.

The staffers said the lawyers also presented copies of a resolution passed by the Pakistan Bar Council and told the judges that the PBC had denounced the establishment of the model courts and had also called for boycotting their proceedings being hurriedly conducted on a day-to-day basis.

They also asked the lawyers, who were appearing on behalf of the state, the accused or other parties, to stop appearing before the model courts else their licence of practice would be cancelled for violating the top regulatory body’s decisions.

The staffers said the judges went to their chambers over the disruption of the proceedings in protest against the behaviour of the lawyers.

When contacted, KBA president Naeem Qureshi told Dawn that their top regulatory body had denounced the decisions of the NJPMC, including the establishment of the model courts as the proceedings were being conducted “hurriedly” by these courts without fulfilling the legal formalities of the process of the trials and justice. He said they requested the judges to stop conducting proceedings as the PBC had passed a resolution in that regard and also asked the lawyers not to plead the cases in those courts.

Mr Qureshi added that they had filed an application with the Sindh Bar Council to cancel the licence of a lawyer for violating the PBC’s decision.

I find it utterly disgraceful that a 27yr old CSS pass sits above someone with years of experience in a field. One flipping exam is the credential.

True. I also wonder that how can a ( BA/14 jumatain pass) inexperienced person can become a bureaucrat by just passing CSS and play with the future of millions of people. Bureaucracy needs some serious reforms as well.

The entire system is mafia controlled in every sector. These are no lawyers... just gangster in blackcoats. LaWhore high court is the prime example of this #CriminalEnterprise.

Same goes for bureaucracy... who have zero specialisation... how can doctors be sitting in FBR? No Phd in FinMin or even some financial analysts...

We need a totally new system... same as we started when Pak came into Being.... We have great and competent people to fill the gaps directly.

A clean break from #CriminalEnterprise. We are a competent, intelligent Nation... I have no doubt we can transform Pak State and Pak Peoples within a decade...

In every department there is a ban on making unions but "Liars" have the freedom to make their unions in the name of bar associations in every city of pakistan, there should be a ban imposed on these "Liars" unions/associations. The only reason these "Liars" are capable to hold successful strikes across the country is because of these coordinated "Liars" bar unions/associations.

I don't know when the pakistani state will learn that nothing beats "practical experience of the field", if I have to make a selection for a new head of police in a district between a 27 year old CSS pass vs a 50 year old sp police with 20 years experience in the field, I will 10 out of 10 times go with the 50 year old SP police guy who actually have years of experience of managing police than a no body like 27 year old guy who happened to pass a colonial legacy css examination. Actually CSS examination should be even abolished, there is no need for this crappy colonial legacy system to exist in pakistan anymore. Every department should have its own selection criterion according to their field specific requirements.

Sir we like to talk all big without taking into account the ground realities. In an ideal world all these cry babies would still be complaining about the snail pace execution of justice.

A judge can only order the concerned department to comply with his orders . But in case those sarkari babus refuse - - - - - - - all he can do is to write to their seniors for punitive measure besides initiating contempt proceedings or direct the district accounts officer to freeze thier pay.

That's all. The court must have an independent execution arm of its own like the us marshals. So the judge don't have to look towards some sp for carrying out his judgment .

You seem like a senior member but your assumptions and language are reminiscent of a hormonally-imbalanced teenager. I'm not sure if your charged post deserves to be dignified by an intellectual response. Two of my best friends are lawyers; one was on the Attorney General's team to get military courts approved by the SC and the other is a Yale JD/Princeton PhD who decided to return (despite being on a partner track in a fancy NY law firm) to Pakistan and shares many of the same lamentations against the much of the local lawyer fraternity.

I did not abuse the "whole lot" in one go --- I was just giving my opinion on how best to deal with the troublemakers who desecrate the law, ripping their sacred duty to shreds. And I'll say it again: in my opinion, lawyers who do this should be dealt with extremely harshly. And if the "State within the State" can take a lead in this, that would be amazing!

I also think all others who do this should be dealt with strongly (public office holders, civil servants, military offices and of course ordinary citizens.)

May be the time for this has come, so far state within state has only focused on some trouble making journalists but trouble making lawyers have remained out of their focus. SBC suspends licences of four lawyers for appearing before model courts

KARACHI: The Sindh Bar Council has suspended the licence of practice of four lawyers for appearing before the model criminal trial courts in violation of the decision of the Pakistan Bar Council, it emerged on Wednesday.

The four lawyers also include a former judge of the Sindh High Court.

The SBC took the decision on the complaints of the Karachi Bar Association.

A notification issued in this regard stated that the disciplinary committee of the lawyers’ top provincial regulatory body had suspended the licences of advocates Abdul Sami Memon, Mohammad Shair Khan, Syed Zakir Hussain and Mohammad Arif Sitai.

Mr Hussain is a retired judge of the SHC while Mr Sitai is currently posted as the deputy district public prosecutor in the court of additional district and sessions judge/model criminal trial court in district South.

Two other lawyers were representing the parties before the model courts in Karachi.

The notification further stated that in case these advocates were still appearing before any court of law they would be liable to be punished as warranted in Section 58(2) of the Legal Practitioners and Bar Councils Act, 1973.

Model courts’ proceedings disrupted again

Earlier in the day, lawyers once again disrupted the proceedings of the four model criminal trial courts for a third consecutive day in protest over swift trials being conducted on a day-to-day basis.

Judicial staff said a group of the lawyers, including KBA representatives led by its president Naeem Qureshi went to the model criminal trial courts of districts East, West, Central and South and asked the judges to stop hearing the cases in the light of a PBC resolution against conduct of the trials in a “hurried” manner.

They also asked their colleagues appearing before these courts as prosecutors or on behalf of the contesting parties not to plead their cases in violation of the PBC’s resolution.

The judicial staff said the protesting lawyers had arguments with Mr Sitai as well as Advocate Zakir Hussain, who were found sitting in the chamber of the judge concerned.

The lawyers had been disrupting the proceedings in the model courts since Monday arguing that the PBC had denounced the decisions of the National Judicial Policy Making Committee, including establishment of the model criminal trial courts and appointment of the police superintendents to decide applications filed under Section 22-A of the Criminal Procedure Code (CrPC) instead of the judicial magistrates.

Islamabad lawyers hold strike today against model courts


ISLAMABAD: District Bar Association has announced to go on strike today (Thursday) against formation of model courts and threatened to cancel licences of those lawyers who appear in these courts.

District Bar Association’s General Secretary Raja Yasir Shakeel said that under the Notification of Pakistan Bar Council strike would be observed against establishment of model courts today (Thursday) and lawyers were directed not to appear in model courts.

It was stated in the notification that the licences would be cancelled of those lawyers who appeared in these courts during the strike.
