Kulbhushan Jadhav's death sentence: Case’s international shift may help Sharif one-up Pakistan army

NEW DELHI: The ICJ's decision to ask Pakistan to stay the execution of Indian national Kulbhushan Jadhav could allow Pakistani PM Nawaz Sharif to try and wrest some leverage from the army and prise open the door to diplomacy.

The ICJ decision puts a lot of pressure on Pakistan, and more particularly its army, to not carry out the death sentence handed out to Jadhav on alleged charges of spying ,and weakens the military's grip on events.

Though no political party in Pakistan has spoken against the death sentence, it has been clear that Sharif and the government have largely been bystanders as the army held and tried the Indian. In fact, the Pakistan army's aggression along the Line of Control and the death sentence handed to Jadhav by a secret military court with no access to the normal judicial procedure left Sharif with few options. But now, the ICJ order provides a reason to argue that the matter has assumed larger proportions, with Pakistan risking serious international opprobrium if it carries out the death sentence.

Though the argument will not be made so plainly, sections in Pakistan could point out that the army's heavy-handed ways have once again resulted in embarrassment and dented the country's image.

India's decision to move the ICJ clearly indicates the priority PM Narendra Modi

Sharif has reportedly been keen to restart the political process with India and the ICJ decision gives him the room to take the initiative and reduce the military's say on the Jadhav case.

So far, the Pakistan army under Gen Qamar Bajwa has seemed determined to carry out the death sentence, given a string of statements about Jadhav's alleged complicity in terrorist acts.

Executing Jadhav — like the beheadings of Indian soldiers on May 1 — would serve to further shut the door on talks and up the hostility with India in keeping with the Pakistan army's intent to stoke violence in J&K. Sharif can begin to explore the possibilities of a negotiated settlement to the Jadhav case, starting with ensuring the death sentence is not carried out and moving to providing consular access to India. This would undercut the Pakistan army's agenda, which entails reckless confrontation with India over the ongoing violence in the Kashmir Valley.

This article holds the real context of Sajjan jandal and Nawaz Sharif meeting. India moved to ICJ to provide Nawaz with an excuse to get Jadhav free.

Nawaz asked Sajjan to tell India to provide him with some excuse. Just an assessment.
 
I dont think there is any link between ICJ & internal pakistan issues. PA vs civilian govt rivalry has been there for long time and would continue irrespective of KJ's case.

A propaganda piece with no holding in reality. Firstly, no ICJ order has been issued it is just a document which states that India is asking for court proceedings to begin. Not the first time this has happened between the two countries ex. shooting of Pakistani naval plane at the border. ICJ stated it has no jurisdiction over such matters. Same has happened with one of India's cases against Pakistan if I recall correctly.

Secondly, a clear attempt of maligning Pakistani army by stating it always interferes with the peace process when in truth the Hindutva government does not want peace as is evident by their actions.

Peace can never be achieved by agreeing to getting slapped in the face by the other party. That is what the hindutva government wants and Nawaz may very well agree to this for his business interests if not for Pakistani populace, media and state institutions (foreign office, Army etc.). Takla is a national security threat.

This article is just a dirty game being played by India to get their spy out. Any government in Pakistan will find it very hard to let this slide, even the takla Nawaz whose business interests are more important to him than national interests. Pakistani's will find this unacceptable, it is a national issue not an issue just for the army as dirty Indians are trying to portray it. People who fall for this cheap piece of propaganda should be ashamed of themselves.


No country in the world will let a spy involved in terrorist activities get away and Indians should get that in their heads. It has nothing to do with the army, It is a national issue

WTF is going on? How many threads are needed?

It's a spy captured even if they did try him in "Civilian" court the amount of redacted reports given to the judge might as not even present.

Spies aren't given the same treatment as a nation's citizen who is suspected of a crime.

Neither does any nation release evidence they've gathered on how their captured a spy. Never has the US, Soviets, Brits even Chinese. Releasing such information you might as well pack up your counter-intel offices and fire your agents.

Where are all the former soldiers who can calm this sh!t down?
 
India is doing what any respectable country would do, (this only applies to respectable countries, so countries in the habit of disowning their own need not read further), i.e. demanding a fair transparent trial and due process for one of our own. Pakistanis can repeat till they go insane how his secret arrest from unknown location, secret trial within two days of col habib running away with his nepali girlfriend and propaganda videos made in captivity are "fair trial" but it is not. Anyone with half a brain can see that but such gifted people dont visit this forum atleast, if they exist.

Anyway unless we know he has had a fair trial we will support him. If we keep quiet the pakistani charade gets dignity. We are declaring to the world that we reject the pakistani charade trial and videos.

Just "enhance interrogate" the repugnant Indian terrorist till he devolves into a veggie state and spends the rest of his miserable life in an Indian hospital in diapers.

Just like dawn leaks, innocent ehsanullah and innocent Noreens prime time hero videos, shakil afridis jail for helping to find osama, dr syed baqar shahs and sardar arif shaheeds murders, naseeruddin haqqanis hushed up dead body etc. All of this concerns terrorism and terrorists who deserve punishment, with the same common party coming up in all cases. And its not Jadhav.
