Judge Orders ARY to Broadcast Its Humiliation

Recently two Pakistani networks were embroiled in a court case in UK over one network (Geo Group) accusing the other network (ARY Group) of indulging in defamation and libel.



The high profile case concerning two Pakistani media conglomerates was heard in the UK and was recently concluded – with the judge awarding damages of £185,000 (some PKR 25 million) that ARY needs to pay to Geo over defaming its owner Mir Shakil ur Rahman.

After the conclusion of this case, and the passage of almost a month, the UK-based Judge Sir David Eady has ruled that ARY needs to broadcast the news of its loss to Geo in its TV channels. And that too in Urdu. Failure to do so could mean more punitive measures against the already penalized network.

ARY needs to state that:

“On Dec 2, 2016, the High Court of Justice ordered the UK broadcaster of ARY News… to pay £185,000 in libel damages to Mir Shakilur Rehman, the Editor-in-Chief of Jang/Geo Group, in relation to seriously defamatory allegations broadcast in 24 programmes which the judge said simply had no foundation.

The court held that the broadcasts were unrelenting and calculated to arouse hatred towards Mir Shakilur Rehman (and indeed quite possibly violence) among members of the Pakistani community in this jurisdiction.”

The judge told ARY to broadcast the above message in Urdu on Dec 23rd at the following timeslots at the beginning of each hour:

• 6 PM
• 10 PM
• 3 AM

In case that idea of public humiliation wasn’t enough, the judge also ordered ARY to state that it had no evidence to back up its claims against the owner of Geo Group.

It should be mentioned that ARY has appealed against this decision and that nothing is known about the status of that appeal to date. The appeal is expected to delay the time when it is supposed to carry an on-air correction on its TV channels.

And this shows how things shud work... its a shame a court in uk is doing what our courts should have done...

Seriously for all practical purposes.... we need to sort out our courts before .... as a rule of nature some one else does

It would be too humiliating and costly commercially for ARY to see its operations stopped in UK. So they will have to pay. These rulings are not the same we see around in Pakistan. That is UK my friend. The same country that not only convicted but also JAILED Asif and Amir

It is Islamic guidance that a society built on injustice cannot survive while the one built on kuffar can! So, hats off to the justice system (wherever it is upheld)

justice was not done due to following of my assessment:
1)Geo said it had stakes in UK that's why it is fighting case in uk court. Now why would UK court consider it a foreign link as geo proved itself as british product.
2) No blasphemy law in uk. which means he can get away from this charge in UK. But it is a serious offence. Geo owner said at court that it is common in world to do it.(to dance over religious songs)
3) Geo owner said in court that the propaganda against ISI chief was done by his order and permission. Now it is not a crime in uk to malign pakistani institution.
4) ARY would have won the case in pakistani courts under Pakistani laws. Geo owner would never have accepted anything like blasphemy,anti ISI propaganda.

Sorry we are no Pakistan where you can do that or get an Army Chief to put pressure on a court to give Gen M bail to run away.

Before such a procedure starts both sets of lawyers get ironclad agreements to ensure the clients will pay and accept the jurisdiction of the UK courts. if you had read the article then it states the damages are only GBP 185K, whereas the costs of the winning lawyers is GBP 3 million and hence it can safely be assumed Ary's own lawyers must have been paid GBP 3 million too. The Judge can ensure ARY never does business in Europe, USA and most countries where they have assets including Pakistan. If you read something called Comity of Courts you will understand how these awards are implemented.

LONDON: In a legal first for the UK, ARY News has had to broadcast a summary of a highly critical legal judgement against it. ARY was forced to announce that the judgement found that 24 ARY programmes about Mir Shakil-ur-Rehman, Editor-in-Chief of GEO/Jang Group, were not only “seriously defamatory” but also “simply had no foundation”.

The allegations against Mir Shakil-ur-Rehman included linkage with RAW, the Indian intelligence agency, the CIA (the US foreign intelligence agency) and/or Mossad (the Israeli foreign intelligence agency) and taking covert funding from foreign governments in order to promote their agenda and committing blasphemy.

Judge Sir David Eady’s ruling that ARY broadcast summary of the judgement was the first time the UK’s Defamation Law 2013 has been used in this way. ARY was also restrained through injunction from broadcasting its false allegations in future.

“This is the first time that a TV network has been ordered to publish a summary of a judgement in this way,” said lawyer Alasdair Pepper.
