The JIT formed included officers from the IB, NCMC and the Special Branch. Their report has essentially reached the same conclusion as the earlier police report.
This is not meant to be a defence of what the crowd did in anyway - not from me and not from the investigation authorities. So any reactionary swearing must be controlled.
ISLAMABAD: The Mushtaq Sukhaira-led Joint Investigation Team (JIT) probing the barbaric killing of two brothers in Sialkot has submitted before the Supreme Court that the brothers had killed two innocent people of village Buttar of Sialkot.
Following the brutal public assassination of the two brothers, Hafiz Mueez Butt of Class 9 and Muneeb Butt of 1st Year Intermediate, the Supreme Court took suo motu notice of the incident and appointed Justice (retd) Kazim Ali Malik to find the facts. Justice Kazim submitted its report before the SC, which did not answer crucial questions relating to the incident and also left a few for the trial court.
After Justice Kazims report, the SC directed the police to investigate the murders and a JIT was constituted, which submitted its report in the apex court, declaring the two young boys as killers of two residents of Buttar village, upon which the suo motu notice was disposed of.
Following are the findings of the JIT submitted in the Supreme Court:
The investigation of this case was entrusted to JIT on 2nd September 2010. In compliance with that, the JIT took up the investigation and first of all pursued the case file, obtained the version of complainant, visited the crime scene, recorded the statements of eyewitnesses, heard both the parties and also collected evidence from other sources.
The JIT found out that the deceased persons namely Mughees and Muneeb riding their motorcycle went to Buttar Road where they stopped one Bilal on gunpoint. Bilal was also riding a motorcycle. When Bilal was intercepted, he resisted.
In the meantime, the brother of Bilal namely Javed and their servant Imran reached there. A scuffle took place between them.
Meanwhile, a mini-truck carrying about 25-30 persons from Buttar village reached at the scene of the incident. During that, Mughees fired indiscriminately. As a result, Bilal, Zeshan, Javed and Imran received bullet injuries.
After hearing the gunfire, a few employees of the Rescue 1122 rushed to the spot and transported the injured persons to hospital. Both the brothers Mughees and Muneeb were overpowered by the people and handed over to the staff of Rescue 1122 along with the weapon of offense, a black bag and a motorcycle to be further handed over to the police.
It is sufficient to prove in the light of the evidence collected that both the brothers were the accused persons while Mughees fired at the above-mentioned four persons. Bilal succumbed to the injuries and died before reaching hospital, Zeeshan died after one month while two others, Javed and Imran, received injuries at their hands.
Post mortem report of deceased Zeeshan and report of ASI regarding weapons is still awaited. On receipt of the same, final report will be submitted.
A senior police officer privy to the lynching incident told The News that it had been proved that four people were murdered in the incident of whom two were innocent i.e. Bilal and Zeeshan, while two were murderers, Mughees and Muneeb but unfortunately all the politicians and media men went to the family of those who had now been declared murderers.
He said that now the media should ask those politicians to visit the other families as well where a pregnant girl had been made widow, a mother had lost her young son and many members of their family were in jail.
It is worth mentioning here that many stories were tossed during August, and even the uncle of the lynched boys told this correspondent that his nephews were killed on cricket match scuffle. However, he could not prove it before Justice Kazim and the JIT.
