Japan and Vietnam vow to uphold rule of law in South China Sea

Japan actually is worst. But nobody have heard of Okinotori. It's only a rock and they claim 200km EEZ around a rock.

Japan Slams China for Unauthorized Research Around Okinotori Island
Japan’s exclusive economic zone around the remote island is being challenged by China again.

Quote.....
China views Okinotori as a reef or rock at most, emphasizing that during high tide Okinotori has only 10 square meters of land area, roughly the size of a bedroom. The Chinese vessel angered Japanese authorities by wording the research mission as one on the “high seas” and “in accordance to the law.” China has repeatedly referenced article 121 of UNCLOS, which holds that “3. Rocks which cannot sustain human habitation or economic life of their own shall have no exclusive economic zone…”

Vietnam even occupies 2 Malaysian reef that lies within Malaysian 200km EEZ.

Hypocrites.

China vessels sailed near Senkakus at record pace
15 hours ago

The Japan Coast Guard says Chinese government vessels sailed just outside Japan's territorial waters near the Senkaku Islands in the East China Sea at a record pace last year.

The coast guard says such vessels did so on 282 days in 2019. The figure is the highest since record keeping began in 2008.

All isls in SCS that we claim belong to VN. We have enough evidents to prove that, even CN Qing officers also said "those islands belong to VN" when some bussinessmen comlpain to CN that their ships were attacked by pirates in SCS( east VN sea).At Qing time, there was No country named Malaysia yet

Malay-CN have No evident to prove that those islands belong to u guys, so ur occupation on VN islands (that even Qing officers said " they belong to VN" ) are illegal and will be taken back (by forces) when US-CN cant help u guys to contain VN

Being a hypocrite would be Japan building a massive island and airbase at Okinotorishima. But the only thing there is an encasement over some rocks to keep erosion from wearing it down below sea level. Now if the PRC abondoned Fiery Cross Reef, Subi Reef, Mischief Reef, and the other 4 man made islands with bases on them, all 7 of them in ghe Spratly islands.. if PRC abondons tjem all, then the point on Okinotorishima starts to make sense. But until then... actually no, not at hypocrite levels.

Errr no. Those features falls under China's EEZ. Reclaimination under EEZ is legal.

Actually no, according to International law, Owning an exclusive economic zone only give you the right of exploring and benefiting from economic activities. EEZ does not grant territorial right for the country that owns it, and cannot be obstructed with international shipping. And Reclamation is a form of obstruction to international shipping. Because you basically limited the sealane from transit.

You can reclaim territorial water (and that would not extent the EEZ)but you cannot reclaim EEZ

That is under UNCLOS, not under some Chinese law.

Exactly. China's reclaimination occurs only around it's EEZ.

Japan claim 200nm EEZ around a rock. Please enlighten us what law is that.

Both are illegal. You cannot reclaim EEZ as per international law.

You can reclaim up to12 nautical mile from your land, which is the limit of your territorial water

You can claim 200ktmiles if your feature is an island. So China claim is legal. Japan claim is illegal since the feature is a rock.

You cannot claim if that island is man made or not connected to continental shelf of your land limit (ie connected under water). Which is the argue point of the law, and which is why UNCLOS rule against China in 2013

Perhaps I was not clear. I was referring to Taiping dao which can sustain life on it's own thus, classified as an island and can claim 200ktmiles EEZ. China's reclaimination lies within this 200ktmiles EEZ.

First of all, do you understand why Chinese claim was rejected by UNCLOS in 2013?

Taiping Island or Itu Aba was ruled as a rock formation by PCS in 2016 after China and Taiwan protest. A rock formation is an isolation of rock cluster that did not connect to any continental shelf, which do not extent the of the edge of China territorial land border, in this case, it is 630 miles (or 547 nm) away in Hainan. Therefore Taiping Island was not even lies within the Chinese EEZ.

Also, Taiwan is the current administrative authority of the island, not China, hence China reclamation within 200 nm of Taiping is illegal as per both UNCLOS and PCS ruling.

It's not about ability to sustain life, that would be the terra nullis clause, which is another issue regrading land border.

The sea belongs to fish. No sea belongs to any country. Be it Japan sea or China sea. Humans can only claim land.
