Thiruvananthapuram: The armed guards on the Italian merchant navy ship are facing murder charges and will be arrested after they allegedly killed two Indian fishermen on Wednesday. The ship docked at Kochi port will be allowed to leave soon, while the crew members will be granted Consular visits.

The Kochi police has registered a case against the crew members of the Italian ship who killed two Indian fishermen on Wednesday. Murder charges have been slapped against the crew members after taking bullet injuries as evidence.

Reports say that the Italian naval personnel who shot at the fishermen tried to carry on with the journey, without informing maritime authorities about the shooting.

The Italian government insists that the fishermen were shot at after being warned and were mistaken for pirates.

Earlier, the captain of the ship had refused to come in to the port off Kochi coast for questioning into the shooting incident that left two Indian fishermen dead.

Two fishermen were shot dead by Italian navy personnel who were part of the merchant vessel crew.

According to MEA sources, a total of 11 fishermen were on the boat, of them nine were sleeping. The two, who were awake at the time, were fired upon without warning.

However, the Italian government has claimed that the ship had come under attack from pirates and the navy personnel fired only warning shots.

The preliminary assessment of the marine authorities is that armed guards aboard the ship might have fired at the fishing boat on Wednesday mistaking it for a vessel of pirates.

The coastal police has registered a murder case against the crew of the vessel based on the evidence of bullet injuries found on the bodies of the dead fishermen -- Valentine alias Jelestine (45) and Ajesh Binki (25)-- during post-mortem.

Fellow fishermen who were in the same boat as Binki and Jalastine, said the boat had 11 fishermen. They had put out to sea from Neendakara in Kollam district.

Italian Consul General in India, GiamPaolo Cutillo, had reached here yesterday in the connection with the incident and met City Police Commissioner MR Ajay Kumar.

The burial of Jelestine would be conducted on Friday at Moorthakara Parish Church in Kollam district while Binki's body has been taken to Poothural in Kanyakumary district in Tamil Nadu.

The Kerala government had announced a solatium of Rs five lakh each to the families of the deceased fishermen. It was also decided to bear all legal expenses for getting due compensation from the owners of the ship.

The Kollam administration also announced an emergency relief payment of Rs 10,000 each to the kin of those killed.

Meanwhile, fishermen's organisations have threatened to lay siege the ship at Kochi harbour demanding penal action against the ship crew.

The FIR of Murder has been registered, since case is already filed and they are detained by police..probably they will be in police custody y tonight..
I guess after these steps...those guards cant leave freely from india..else supreme court will give a long bamboo in *** of govt...and the govt has been already fucked by numerous times by supreme court..and the main diffrence is This is India...dont mess with us

White skin should not be a license to kill. Arrest them, throw them in jail, then continue the investigations.

Pls don't bring racism into this. Its clearly a case of mistaken identity. Thanks to Somalis almost every merchant vessel is on look out for sea pirates. The security officers of the ship shot the fisherman mistaking them to be sea pirates.They did it inorder to safeguard the ship and crew which incidentally also includes 19 Indians.

Also it may be wrong to criticize the dead, but it should be investigated whether the fisherman followed protocols..as the Italians are saying that clear warning was given before they fired their weapons.

The only problem is that it technically happened outside of Indian jurisdiction. This will be an interesting case.

There is even a debate on which law should be used..Italian or Indian

territorial waters exist only till the 12 mile boundary . about 17 km from land.

last i heard that the captain was refusing to put into port . the cops were waiting to arrest then once they land.

Not in Indian territorial waters, that distance would be clearly be within international waters.

Seems to be some doubt. From the same article:

"Italian news agency Agenzia Giornalistica Italia had earlier reported that naval riflemen from the San Marco Battalion had “thwarted an attempt made by pirates to board the ship 30 miles west of the southern Indian coast.”
