Israel 'admits' using white phosphorus munitions

The Israeli military came close to acknowledging for the first time yesterday its use of white phosphorus munitions during the war in Gaza, but continued to insist that it did not breach international law.

As fresh evidence emerged of Gazan civilians being burned by phosphorus, Avital Leibovich, the army spokeswoman, said its use was “legal according to international law...All the munitions we were using were legal, like the French, American and British armies. We used munitions according to international law.

“They [Hamas] were committing war crimes by putting the civilians in the front line,” she said. “If Hamas chooses to locate training camps, command centres...in the middle of the [civilian population]...look how populated it is...naturally they are endangering the lives of civilians. Hamas is accountable for the loss of the civilians.”

Major-General Amir Eshel, the army's head of strategic planning, said that firing shells to provide a smoke screen was legal. “It is the most nonlethal kind of weapon we used. I don't see any issue with that,” he said.

The Israeli newspaper Ma'ariv reported that the Israel Defence Forces (IDF) had privately admitted using phosphorus bombs, and that the Judge Advocate General's Office and Southern Command were investigating.

The Times first accused Israeli forces of using white phosphorus on January 5, but the IDF has denied the charge repeatedly. Phosphorus bombs can be used to create smoke screens, but their use as weapons of war in civilian areas is banned by the Geneva Conventions.

Yesterday reports emerged from Gaza about the killing of five members of the Halima family, when a single white phosphorus shell dropped on their house in the town of Atatra on January 3. Two others were in a coma and three were seriously wounded, according to doctors and survivors.

Salima Halima, 44, who is in Gaza City's Shifa hospital, said that the chemical burst in all directions after hitting her living room.

Nafiz Abu Shahbah, a doctor who trained in Britain and America, said he was sure white phosphorus was responsible. Her wounds at first appeared superficial “but it eats at the flesh, it digs deeper and gets to the bone...The whole body becomes toxic,” he said.

In the Jabaliya refugee camp, the Associated Press found a crater that was still producing acrid smoke days after the war ended, and in the town of Beit Lahiya a lump of white phosphorus burst into flames after some boys dug it up from beneath some sand.

Ban Ki Moon, the UN Secretary-General, expressed outrage at Israel's destruction of Gaza yesterday, when he became the first world leader to visit the Palestinian territory since the end of the war. “This is shocking and alarming,” he declared while visiting a UN warehouse that was still smouldering after being hit on Thursday, allegedly by white phosphorus shells. “I'm just appalled.”

Visibly angry, he condemned Israel's “excessive” use of force, and demanded that those responsible for shelling schools and other facilities run by the UN Relief and Works Agency during the 22-day offensive should be held to account. “It is an outrageous and totally unacceptable attack on the United Nations,” he said.

Israel has apologised for attacks on UN facilities but insisted in almost every case that Hamas fighters were using the buildings for cover.

VIENNA, Jan 21: The UN nuclear watchdog said on Wednesday it would investigate allegations by Arab countries that Israel used ammunition containing depleted uranium during its 22-day military offensive in the Gaza Strip.

Arab countries made the allegations in a letter addressed to Director-General of the International Atomic Energy Agency Mohammed ElBaradei and delivered by the Saudi Arabian ambassador.

They asked the IAEA to investigate the matter.

IAEA spokeswoman Melissa Fleming confirmed the receipt of the letter. “We are circulating the letter to member states and will investigate the matter to the extent of our ability,” she said.

The exact course of action would be decided after consultation with member states.

The Israeli ambassador to the IAEA, Israel Michaeli, declined to comment.

Depleted uranium is a waste product of uranium enrichment and has a number of civilian and military applications, including its use in weapons to penetrate tanks and armour plating.

Investigations have been carried out into its use in ammunition in conflicts such as the 1991 Gulf War and 1994-95 Nato air strikes in the Balkans.

The IAEA published a report on the issue in 2002. At the time, IAEA Deputy Director-General Werner Burkart said: “To be honest, there are very few health concerns for depleted uranium from a radiological point of view, because it is only very slightly radioactive.

“Even the handling of enriched uranium in industry does not need special protection such as shielding. There are more dangerous radiotoxic elements associated with uranium in nature.”

Depleted uranium could pose a health risk, however, in the form of dust found at impact sites.

Nevertheless, in the case of the Balkans conflict, “it is difficult to imagine that peacekeepers had exposure to depleted uranium high enough to significantly change their normal level of radiation exposure from natural and civilian sources,” Burkart had said at the time.—AFP

Israel's name smeared in public, and its officials threatened with jail if they leave the country. Israel's use was quite legal, save possibly for the acts of two soldiers who were prosecuted for their errors.

Yet what have been the consequences for Gazans about this?

Nothing so far. Nothing is likely to happen, is it? And unlike the Israeli employment of white phosphorus to camouflage troops, there is no doubt that the deliberate employment of white phosphorus to terrify and kill civilians is illegal.

Are you kidding??

When a sovereign state uses phosphorous weapons in complete disregard of International law, do you expect the so called "terrorists" fighting against you to follow all the international rules. I can believe that you are seriously complaining that terrorists, of all people, did not follow the rules of combat. That statement itself means that you acknowledge that they are not terrorists but proper soldiers and that is why you expect them to follow rules which you callously break.

This is similar to Israel amassing 100s of nuclear weapons against international law and then arguing against the peaceful nuclear program that Iran claims it is pursuing. Israel breaks every rule in the book. Maybe it has no other option but to do this in order to ensure it's survival. Just don't go around justifying that by claiming that it's all legal. That insults our intelligence .

Why not? Why shouldn't terrorists be prosecuted world-wide as war criminals? Why should they be given the protection of nation-states? Israel assassinated one such terrorist in Dubai a few months back. Israel killed no innocents then, but was vilified for its deed. No one asked why the UAE authorities didn't arrest him.

Your grasp of international law is faulty, and I dispute your characterization of Israel's actions; you have to be specific.

Israel used M825A1 WP smoke round. This is standard NATO smoke round. Although this round contains WP, there is absolutely nothing illegal about it, because it is just a smoke round.

I'm not Indian, and I came here with an open mind. I don't side with Israelies nor Palestinians. It's a rudimentary fact that you would side with Palestinians, being Muslims after all. But there is a clear reason why Israels do what they do, because if they didn't, then there wouldn't be no israel. If that means keeping Muslims out of Palestine, so be it. Now, the Palestinians aren't exactly darling angels, must I remind you how Muslims share the hate towards Jews? Not all, just some. I need not say more.
