ISLAMABAD: After incorporating amendments for allowing inland movement of foreign currency worth up to $10,000 and granting permission to arrest on charges of money laundering with court approval, the National Assembly Standing Committee on Finance has cleared two key bills that could help Islamabad to move out from grey list under FATF review. According to the bill movement any foreign currency worth more than $10,000 (currently Rs1.6 million) will not be allowed.


The National Assembly Standing Committee on Finance which met under the Chairmanship of PTI MNA Asad Umar here at the Parliament House cleared Anti-Money Laundering (AML) (Amendment) Bill and Foreign Exchange Regulations (Amendment) Bill to curb currency smuggling and money laundering. Asad Umar asked the members to pass laws as a critical meeting of Financial Action Task Force (FATF) was approaching to decide the fate of the country on account of worsening outcome. Pakistan has been currently under the grey list of FATF and Islamabad is implementing 27 action plan to come out from it. In case of any worsening outcome the country could slip into blacklist.

The members of the committee opposed any move to declare money laundering as predicate offense and proposed to arrest anyone on the charges on money laundering only after seeking approval of the court of law. They recommended making arrest of a person, reason to believe of guilty of an offence punishable under money laundering should subject to issuance of arrest warrant by the court.

On the proposed bill of Foreign Exchange Regulations (Amendment) Bill, the SBP officials informed the committee that they were proposing harsh measures in order to comply with FATF requirements. The PML-N MNA Ayesha Ghous Pasha said that there was no need of unnecessary regulations on movement of currency for businesses.

The SBP official told the committee that an amendment into the bill proposed on the suggestions of the committee for allowing movement of currency up to $10,000 (or equivalent in other currencies). The committee cleared the bill after incorporating of this amendment into bill tabled by the government.

The committee asked the State Bank of Pakistan to provide details of ten years history of total applications received with regard to permission to remit money along with details of those accepted and rejected in the next meeting. The committee also decided that tribunal be given powers to decide with regard to confiscation of property, currency, gold, silver or goods.

The NA panel also approved the ‘Anti-Money Laundering (Amendment) Bill, 2019’ and proposed amendments in various sections of the law; (i) to increase punishment for money laundering up to ten years and fine of five million rupees; (ii) do away with the condition of administrative process to cooperate with the Financial Intelligence Unit (FIU) of other countries for information sharing related to money laundering; (iii) prompt filing of suspicious transaction report and others.

According to the approved bill, violators of the law against money laundering will be subject to a prison sentence of up to 10 years instead of the previous two years, along with a fine of Rs5 million, up from the previous figure of Rs1m. Furthermore, the investigating officer shall be authorised to seek remand of the person for a period of 180 days, up from the previous 90 days, and shall not need to obtain arrest warrants from the court. The offender’s assets will also be seized by authorities.

We need a semi fascist/communist/dystopian kind of setup to put the jaahil awam amongst us in order. The corruption and jahalat is widespread and it can't be controlled by just making a few good policies.
People need to feel pressure and need to level up a bit and stop being jungli and corrupt already.

That's for the policy makers to decide. If they made something they will figure how to check it.
The questions is do we need strict policies that make people cry? Yes we do...

I just dont seem to understand the problem.

Why there has to be a cry when ever something is being done to make us comply with international standards and get ourself of the greylist.

We do not live in cave nor we are NK that we cannot care about international rules.

in Australia as of 1 July 2019 cash transactions over $10,000 (AUD) is to be banned.

  1. We dont want to pay taxes.
  2. we dont want to registered our businesses
  3. we dont want to provide ID

Its all IMF conspiracy.

Not so difficult to figure.. either it will be a bank transfer so the govt will know otherwise just check the withdrawal and deposit of such large sum... even if someone does it over the span of a month...sum all the transactions. Rest ask all forex to provide the record of each transaction / money conversion.

I think the implication is that when you declare your income/ or are investigated by FBR you will not be allowed to say you received payments above this threshold.

If someone deposits a large sum in the bank, they will have to disclose source of that money. So they just can't say that Mr. ABC gave them cash as it will not be legal to do so anymore.
If Ayyan Ali is caught with half a mil again, either at airport or anywhere else in the country, she can't just say that it was given to her by her brother or chacha or mama. Because they wont be allowed to give "cash" to anyone. So there either will be an audit trail to get to the source of that money or you face criminal charges.

It's impossible for cash but should be very straightforward for bank transactions.

1. You train staff to limit transactions to a value of no more than 10,000USD if the currency is not PKR.

2. You mandate that all banks update the software their tellers use so that it prevents them from trying to process such a transaction. This software can have daily access to exchange rates and calculate for each currency what the maximum transferable amount is.

3. The same software can be put on online banking accounts.

4. The relevant authorities could ask all banks to provide them with a daily log of all transactions (again really easy with IT) and have software that processes these logs and checks for large transactions and other algorithims that check for patterns, ie accounts or banks that regularly make large transactions.

I don't get why they're doing it though. Why limit how much currency someone can transfer internally? Why not just log each transaction and then using algorithims to detect potentially fraudulent patterns?

In UK one can only carry maximum £999.99 cash! £1,000 and above it gets confiscated by police under money laundering law until one provides proof of source such as bank withdrawal receipt!

Is UK a communist state?

There are other laws as well where transactions above certain limits get in the automatic investigations.

This new law in Pakistan is to curb the exchange mafia and dollar fluctuation. Excellent move.

People should be glad that this restriction is not on PKR!

Do u even know what ur talking about???? Inland movement of currency has been banned in many countries that face money laundering. Why not use banking channels? What has communism to do with this?? If u ever study western regulations and how strict they r, ud call them communists too lolz...

These ppl been living in a corrupt jungle society of nawaz and zardari. Implementing any rule on these ppl is new to them and hence they shout communism lolz.
