Indonesia’s Constitutional Court to begin hearing appeal into election rigging

Indonesia’s Constitutional Court will hold its first hearing today over allegations of rigging during the April 17 general elections by incumbent President Joko Widodo.

The appeal against Widodo, who received 55.5% of the vote, has been brought forward by the right-wing leader of the Great Indonesia Movement Party, Prabowo Subianto, who took 44.5%.

Today’s hearing follows the large-scale protests on May 21 and 22, when eight people died and hundreds were arrested or injured as Subianto’s supporters took to the streets against Widodo’s re-election amid allegations of systemic cheating.

A lack of evidence plagues Subianto’s vote rigging appeal- the result of which will be heard on June 28. Regardless, his supporters are likely to take to the streets. On May 28, the police also revealed an alleged plot by avid Subianto supporters to assassinate four top government officials and a polling agency head in a bid to foment more political instability and undermine Indonesian democracy.

Indonesia’s security forces are preparing to combat any further unrest . 48,000 security officials have been deployed to ensure peace around the precinct surrounding the Constitutional Court along with another 10,000 placed across Jakarta, though unrest is still expected.

Indonesian constitutional court concludes hearing, ready to issue final poll judgment

JAKARTA, June 24 (Xinhua) -- Indonesia's highest justice institution of Constitutional Court (MK) will issue its final judgment on presidential election results later this week after concluding a week-long hearing on frauds in the poll process claimed by the loser camp.

The MK was scheduled to issue its final judgment on the poll results Friday after discussing the hearing results and materials presented by the winner and loser camps in the poll.

"We will hold a justice assembly meeting. Intense debate will happen to discuss what have been presented by the two camps in this court. It is going to be tough (process)," MK Chairman Anwar Usman said at the conclusion of the hearing process over the weekend.

The hearing was part of legal process to accommodate the challenge against poll vote count results announced by the General Election Commission (KPU) last month, which qualified the incumbent candidate President Joko Widodo as the 2019 presidential election winner.

In his lawsuit filed to the MK, Prabowo Subianto, President Widodo's arch rival in the last two elections, claimed that the poll was marred with massive frauds that put the incumbent candidate at advantage.

Therefore, he demanded the MK disqualify the incumbent candidate's victory and order a re-election process in provinces identified to have the frauds.

Prabowo's witnesses presented several accounts which they identified as frauds in election process, which experts said were assumptions.

Among those accounts were the president's moves to raise the salary of civil servants, inaugurate infrastructure projects prior to the election, among others.

President Joko Widodo obtained 55.5 percent of votes, or equal to 85,607,362 votes in the presidential election held in April. Prabowo Subianto earned the remaining amount of 44.5 percent, or 68,650,239 of votes.

Based on the MK judgment, the KPU would officially name the president and vice president to govern the country from 2019 to 2024.

I don't know, I feel like that it's a prolonged drama.

In my opinion It is a good process that can make our democracy get more solid inshaAllah. We will wait what will be the outcome but I feel Jokowi team will win and Prabowo camp will accept the result. People in the end will be more wise and not follow emotional tendency anymore like believing the election are not fair without any strong evidence.

Constitutional Court reaches decision on presidential election lawsuit, will deliver verdict tomorrow

Tomorrow is set to be a crucial day that could shape the landscape of Indonesian politics for the next five years as the Constitutional Court (MK) is set to deliver their decision on the presidential election lawsuit by losing candidate Prabowo Subianto.

The court today confirmed that it has already reached a decision on the lawsuit.

“The deliberation meeting between judges has ended, meaning that a decision has been made. It is ready to be read out, and the council of judges has confirmed that it will be delivered tomorrow,” MK spokesperson Fajar Laksono told reporters today, as quoted by Liputan 6.

MK had until June 28 to render their decision on the lawsuit, meaning that they will deliver it one day ahead of the initial schedule.

The lawsuit was filed by Prabowo and his campaign team earlier in the month following the candidate’s defeat in April’s election, which was officially announced by the General Election Commission (KPU) on May 21.

Most legal experts believe that Prabowo has little to no chance of winning his lawsuit, which seeks to overturn President Joko Widodo’s re-election victory with claims of massive and systemic voting fraud. In a devastating dissection of Prabowo’s case, Professor Simon Butt of the Centre for Indonesian Law, Islam and Society, said the failed candidate’s legal team would need “an evidentiary miracle” to avoid losing in court, just as Prabowo lost a similar MK case in 2014 after he lost to Jokowi the first time.

The hearing has so far been quite an embarrassment for Prabowo’s campaign, with much of the nation’s focus being on the plaintiff’s comically questionable witnesses, particularly one man who violated a detention order in order to testify for Prabowo in court.

Just like on and after May 21 when Prabowo’s defeat was made official, there are once again concerns that the Gerindra chairman’s supporters will stage mass protests in Central Jakarta, this time outside the MK building on Jalan Medan Merdeka Barat. One Islamic hardline group has predicted that around 100,000 will descend to the streets in support of Prabowo, though the group has been known to overestimate protester numbers before.

National Police Chief Tito Karnavian yesterday publicly forbade any forms of protest outside MK during the final court hearing and the police have said that no permit for large public gatherings in Central Jakarta has been issued. Nevertheless, close to 50,000 police and military personnel are reportedly being deployed in the city ahead of MK’s verdict tomorrow to prevent large scale protests and riots.
