Agreed 100% with the last sentence. They are obligated by company policy to throw it away out of fear of being sued for causing a food borne illness. That's the other dimension to capitalism, even a homeless person has the right to sue if he/she falls sick from eating food offered to them by an employee. If the food is set aside in the trash then the liability no longer exists. Infact quite a lot of service employees take care to carefully "discard" leftovers so that homeless people don't have to dig through garbage to find food.
