India, US ask Pakistan to act against 26/11 Mumbai attack perpetrators | Zee News

Washington: Recognising the threat posed by outfits like the al-Qaeda, LeT and the D-Company, India and the US on Tuesday agreed to deepen cooperation in fighting terrorism and asked Pakistan to bring to justice the 2008 Mumbai attack perpetrators.


US Secretary of State John Kerry and External Affairs Minister Sushma Swaraj co-chaired the first India-US Strategic and Commercial Dialogue that ended with the important takeaway of a joint statement on combating terrorism, recognising the threat posed by terror groups operating from terror safe havens within the South Asia region.

India and the US decided to take their counter-terrorism co-operation to the next level in view of the continued danger faced from terror groups and the emergence of the new global threat from the Islamic State.

At the conclusion of the dialogue, India and US issued a separate joint statement on counter-terrorism co-operation, pledging to fight terrorism together.

Swaraj said the joint statement reiterates commitment of the two countries on common approach against terror groups like Lashkar-e-Taiba, Haqqani network and the D-Company.

"We (India and the US) reiterate that the threat posed by al-Qaeda, Lashkar-e-Taiba, Jaish-e-Mohammad, D-Company (Dawood Ibrahim), Haqqani network and other regional groups undermines stability in South Asia. And we call to Pakistan to bring to justice the perpetrators of the 2008 Mumbai terrorist attack," Swaraj told reporters while reading from the joint statement.

"We (India and the US) strongly condemn the July 27, 2015 terrorist attack in Gurdaspur, Punjab, and August 5, 2015 attack in Udhampur," she said of the terror assaults in India which were carried out by terrorists based in Pakistan.

Swaraj said the joint statement states that the two countries are determined to fight terrorism to the end.

In response to a question, Kerry said the two countries are committed to bringing all their efforts together in this fight against terrorism.

Another significant outcome of the parleys coming just ahead of Prime Minister Narendra Modi's meeting with US President Barack Obama in New York next week was that both sides set up a new mechanism of dialogue between India's Foreign Secretary and US Deputy Secretary of State on regional and global issues.

After the talks, Swaraj listed six key points as takeaways from the dialogue with the most important one being stepping up cooperation in fighting terrorism.

The two countries also decided to elevate the Secretary- level trilateral with Japan to a Ministerial-level. Kerry and Swaraj would meet their Japanese counterpart in New York next week on the sidelines of the UN General Assembly session.

Responding to questions, both Kerry and Swaraj refuted reports that the India and US meeting was aimed at China.

"It has nothing to do with China," Kerry asserted. There is no message intended to be sent to China through this strategic and commercial dialogue, he said.

Swaraj said China did not figure in the talks at all.

"This is bilateral dialogue," she said adding that any apprehension about India and US coming together against China is mistaken.

There is no effort about India and US coming together to increase their influence in any part of the world, she said.

Kerry also announced that India and the United States have also signed a memorandum of understanding on cooperation in the field of climate change and renewable energy. It also decided to launch a Fulbright Climate Fellowship programme.

In another important outcome, India and the US decided to train troops in six African countries before they are deployed on a UN Peacekeeping mission. Kerry described this as a milestone.

The two countries reaffirmed their commitment to a secure and stable Afghanistan and agreed to launch an Ocean Dialogue, an issue close to Kerry's heart.

Both Swaraj and Kerry described the meeting as "meaningful and productive".

"Our discussions have been most productive and fruitful and allowed us an opportunity to assess and review all the good work being done on both sides in different fields. We have also charted new ideas and initiatives to further strengthen our bilateral cooperation in different domains," Swaraj said in her statement at the press conference of First India-US Strategic and Commercial Dialogue.

Swaraj said that in her meeting with Secretary Kerry, they shared India-US' strategic priorities, interests and concerns on issues of mutual interest including security and counter-terrorism, convergences in India's Act East policy and the US re-balance in Asia.

"We have agreed to step up our cooperation in fighting the menace of terrorism. We have recognised the threat posed by Lashkar-e-Taiba and other groups operating from safe havens in our region and the need for Pakistan to bring to justice the perpetrators of the 2008 Mumbai attacks," Swaraj said.

"A main take-away from our discussions includes our shared view that we need to keep the big picture, the strategic framework of relationship in mind, especially when it comes to our strategic security and political interests, regionally as also internationally, as also when we deal with transactional issues," she said.

"We also talked about creating new substantive underpinnings to deepen bilateral engagement including in the fields of defence, security, cyber, energy, climate change, science and technology, space, health, and other areas of economic development," she added.

The Indian side also welcomed US' reiteration of support for India's membership of the four major multilateral export control regimes including the NSG.

The crime scene has witnessed a sea change. What are changes you have seen?

When I joined the force the stress was more on ‘traditional crimes’ like robbery, dacoity, housebreaking. In my initial postings in Akola, Buldhana , Osmanabad we used to concentrate on these traditional crimes. The 80s-90s were dominated by the underworld. During the Khalistan movement terrorism started to become a subject matter of the local police. However 1993- serial blasts was a watershed for us. When the blast took place our initial assessment that it was a handiwork of the underworld. However, I vivid recall while interrogating Dawood Phanse (a landing agent who was in charge of the landing of the RDX at Shrivardhan in Raigad) he was the first to reveal that young boys from Mumbai were imparted weapons training in Dubai by underworld criminal Dawood Ibrahim. Pakistan’s ISI had used Dawood to carry out the blasts in India. Our investigations revealed how the 1993 blast was the handiwork of the ISI with Dawood being used to execute their plans.

The blast had also left the underworld divided on communal lines. You had a Chhota Rajan, a self proclaimed Hindu don who was killing ‘Dawood’s men’ who participated in the blasts and Dawood’s men were trying to eliminate Rajan’s men. Urban terrorism was now a reality and the local police had to evolve and equip itself with the rising challenge. The cracking of the Indian Mujahidden, a home grown terror module in 2008 introduced a new facet of terrorism. The November 2008 attack stunned all of us. It is another watershed in the history of policing. Today there is a constant threat of attacks by lone-wolf who are indoctrinated online.

Staying on the topic on the 1993 blast, what are your views on Yakub Memon and was be arrested from Nepal and not Delhi as claimed by late R&AW chief B Raman?

There is not an iota of doubt that Yakub Memon played an active role in the conspiracy. He had arranged for the tickets for the boys who too training in Dubai. One of the witness had testified before the courts that Memon had carried a bag of explosives containing arms and hand grenade and kept it at a friend’s place for safekeeping. He also motivated and radicalized the youth. While the arrest of Memon was made by CBI and I am not privy to where it was made. I could only say that he was responsible for the killing of 257 people and the courts of found him guilty and awarded him the punishment. When he was executed I was the Commissioner of Mumbai Police. Mumbai was tense and even NSA Ajit Doval had flown to the city to take stock of the law and order. Despite knowing that I might face the wrath from the crowd I decided to lead my men from front and had stationed myself in Mahim to ensure the funeral proceedings go off peacefully.

During those days was there nexus between Bollywood and the underworld and does it still exists?

In the past there was nexus. The dons used to even come to give a clap for the mahurat shots. Being seen with the dons was considered as a status symbol and in those days, anyone who had money irrespective of the source became a producer / director. Today that is not the case. The shady characters aren’t there and with the big corporates and even big international production houses approaching Bollywood, those shady elements of underworld are as good as over.

You are hailed as Sherlock Homes of the Mumbai Police. Where does this expertise of cracking a criminal come from?

I would credit my success to my team. Knowledge is information and for a police officer its his informant network. I was lucky to have some of the best men in my team. I always respected information and never differentiated if it came from a constable or an IPS officer. Detection is my weakness and interrogating an accused is like playing a game of chess. Like when I first saw Maria Susairaj(convicted in the murder of a television executive, Neeraj Gover) I just looked at her and told her- Madam, you are my first suspect. My words left her unsettled. The next day she came to visit me along with her brother. While talking to her, I noticed a bruise mark on her left arm, I called my officer to take her for a medical test and we interrogated her. In few hours she cracked and the case was solved.

While instinct play a big role, I would say its the eyes that give away. An accused always comes prepared. He has an alibi in place but he would never be able to make an eye contact and that’s where you get your first clue.

But any case that you regret not detecting?

I would say the Dr.Narendra Dabholkar murder case. While ATS was never formally given the investigation in the case. We were parallely probing it. My officer, Ravindra Dohiphude even visited the Sanatan Sanstha’s ashram in Panvel and we were on the right track but the Kalina Forensic Science Laboratory report changed the course of the investigation. It opined that the weapon seized from two arms dealers were used in Dabholkar’s murder and that made us change the line of the investigation.

What are your takeaways from the 26/11 attack?

November 2008 is another watershed. In the said case the conspiracy, planning, training everything took place of a foreign soil. We were able to nail that it was a handiwork of the Lashkar-e-Taiba. Our investigation has not only been hailed by the Indian press but also by the international media. When Police inspector Ramesh Mahale prepared a 55-pages synopsis in Marathi, I sat down late night translating in English to ensure that there is no error as I knew the world was watching us and there was no room for mistakes. The case ended in conviction and it was a sense of victory for me and my team.

But along with the accolades came the allegations levelled by Vinita Kamate, widow of slain IPS officer Ashok Kamte, who said that you failed to send the reinforcement on time? Your comment?

Unfortunately the yardstick for measuring one’s contribution in the 26/11 attack was if an officer was injured or he died. It was my bad luck that I asked my men to assemble at the crime branch to collect their weapons, the then CP, Hasan Gafoor saw me and ordered me to take charge of the control room. I did whatever was best possible. My only regret is that I wasn’t there. If I could rewind my life, I would go back and try to rescue the three. I understand the emotions of the family members and respect them but I did whatever I could.

There is a conversation which has been recorded on the wireless where late ATS chief Hemant Karkare is heard telling a senior IPS officer that teams from the crime branch and the Quick Response Team (QRT) had arrived at Cama hospital and they were planning to cordon it. On wireless we even received inputs that terrorists were approaching the Crime branch but I diverted the force to the spot and told my men at the control room to be prepared. I think if I would have been killed, I would have been hailed for my efforts.

The Chief Minister, Devendra Fadnavis recently said that the Commissioner of Police shouldn’t take keen interest in one case. Were you hurt by the comment and do you regret cracking the Sheena Bora case?

Commissioner of Police is not a showpiece. The job mandates to maintain the law and order of the city, prevent , detect and investigate crime. If I wanted to shield Peter I wouldn’t have cracked the case in the first place. I don’t regret detecting the case. I have met Peter only four times during the course of the probe and if I have to rewind my life I would still go the Khar police station and interrogate Peter.

On September 7, a day before I was promoted to DG, State Homeguards, I had interrogated Peter and found discrepancies in his statement. I had discussed those with my team and had given Peter 24-hours to come clean but before I could interrogate him again on September 8 my orders had come. While transfer and promotions are the prerogative of the Government , I felt bad that they imputed motives on me. Contrary to what is said a month before my promotion i had sought a posting as the DG with either Homeguards or the State Security Corporationl as I wanted to take a break from active policing.

In a twist to the 2008 Malegaon bomb blast case, the NIA on Tuesday told the Bombay High Court it did not know if recordings or transcripts existed of a conspiracy meeting in Bhopal, as claimed by Maharashtra ATS, to plot the crime which prime accused Sadhvi Pragya Singh Thakur allegedly attended. Maharashtra ATS, which earlier probed the case, had alleged in its charge sheets that Thakur attended several conspiracy meetings held by the right wing group Abhinav Bharat in Bhopal, Indore, Faridabad, Dharamkot and Ujjain.

It claimed key witnesses had heard Thakur discussing the conspiracy at a closed-door meeting in Bhopal on April 11, 2008, it said. This was the first meeting attended by Thakur, ATS claimed, and said its proceedings as also of such previous and subsequent gatherings, had been recorded and saved by the co-accused Sudhakar Dwivedi on his laptop.

ATS recovered the laptop, seized its hard disk for examination at FSL labs, and cited a host of audio and video clips retrieved from it to back its claims.

The division bench headed by Justice R V More, which was hearing Thakur’s bail plea today, was informed about the meeting by advocate B A Desai, who appeared for blast victims.

When the HC asked NIA to produce the transcript of the recording of the Bhopal meeting, the agency said it was not aware if it existed.

Additional Solicitor General Anil Singh, representing NIA, the country’s anti-terror probe agency, said it only had the transcripts of an alleged meeting in Faridabad and if any more video recordings or transcripts existed, ATS had failed to hand them over to it.

“The Faridabad meeting was held before the Bhopal meeting and the reference to the accused was first made in the Bhopal meeting. So, if you have transcripts of the first meeting, the transcripts of the subsequent meetings must be there. What did you do with them? These were crucial meetings and the transcripts are important evidence. So, how are they missing?” the bench asked.

The High Court then directed additional public prosecutor Jayesh Yagnik to take instructions from the ATS. Yagnik, on instructions from an ATS officer present in the court, said it had submitted to the lower court a video clip of the Bhopal meeting.

The bench ordered the lower court to release, for the High Court’s inspection, copies of 11 CDs, some video clips, and call details that ATS had annexed with charge sheets.

HC is likely to resume hearing the matter on February 7.

Earlier, the NIA, after taking over the case, had told the lower court during a hearing on Thakur’s bail plea that it had no evidence against her. However, the court said there was prima facie evidence and rejected her application following which she moved the High Court.

Seven people were killed in two blasts in Malegaon town in Maharashtra’s Nashik district on September 29, 2008.

Sadhvi Pragya Singh Thakur and seven others were acquitted in the 2007 RSS pracharak Sunil Joshi murder case today by a Madhya Pradesh court, which held the state police and NIA conducted the probe with "prejudice" and produced "weak and self-contradictory evidences".

"The contradictory evidences by police and NIA in the case raised serious doubts in the whole case," the First Additional District and Sessions Judge of Dewas Rajiv Madhusudan Apte said while acquitting Thakur, Harshad Solanki, Vasudev Parmar, Ramcharan Patel, Anandraj Kataria, Lokesh Sharma, Rajendra Choudhary and Jitendra Sharma.

Joshi, once a close aide of the Sadhvi before they fell out over some dispute, was shot dead here on December 29, 2007 in Audyogik Police station area here. Thakur, also an accused in the 2008 Malegaon bomb blast case, is in judicial custody. She was not present in the court when the verdict was pronounced as she is undergoing treatment in Bhopal.

"My clients were absolved due to the contradictory evidences of Industrial Area Police, Dewas, and the NIA, which were not found trustworthy by the court. This has been observed by the court in para 124 of the operating order," defence lawyer Raghuveer Yardi told PTI.
"The court has observed that the analysis of evidence gathered by the police and NIA reveals that in the sensitive and serious cases like murder, both the prosecution agencies carried out investigation with prejudice," he said.

"They (police and NIA) didn't conduct investigation seriously and the self-contradictory and weak evidences of the agencies were insufficient to convict the accused and the contradictory pari-materia (a rule of statutory interpretation) makes the prosecution highly suspicious," advocate Yardi said quoting the order. Initially, the probe had hit a dead-end, but later the arrest of a person in Rajasthan led the district police to Thakur and other accused.
The trial was shifted from the district court to the Special NIA Court in Bhopal a few years ago. However, the matter was shifted back to the district court in September 2014 on the ground it was a murder case and does not come under the ambit of NIA, which is an anti-terror probe agency. Public Prosecutor Girish Munji said the state will take a call on challenging the order in the competent court after studying the judgement.

Like Thakur, Solanki, Lokesh Sharma and Choudhary too were not present in court. While Solanki is lodged in Ajmer jail, Lokesh Sharma and Choudhary are in Panchkula prison in Harayana. Lokesh Sharma and Choudhary are also accused in the 2007 Samjhauta Express blast case. Accused Jitendra Sharma, Ramcharan Patel, Kataria and Parmar were present in the court. Hearing the verdict, Parmar and Kataria broke down. The supporters of acquitted persons shouted slogans in the court premises after the verdict.

New Delhi: Following the Pakistan Interior Ministry's statement that India should provide concrete evidence against Jamaat-ud-Dawa chief Hafiz Saeed, the man behind the 2008 Mumbai terror attacks and whom Islamabad put under house arrest earlier this week, India on Thursday said all evidence against the terror mastermind was available in Pakistan itself.


"The entire conspiracy in the Mumbai terror attack case was hatched in Pakistan," External Affairs Ministry spokesperson Vikas Swarup said in a weekly media briefing here.

"All the terrorists came from Pakistan. All the planning was done in Pakistan. All the support was rendered from Pakistan. So, all the evidence to implicate the mastermind of the Mumbai terror attack is already available in Pakistan," he said.

Pakistan on Wednesday snubbed India's demand for a "credible crackdown" on militant groups following the detention of Jamaat-ud-Dawa chief Hafiz Saeed, saying it does not need New Delhi's endorsement for its actions.

"Pakistan does not need any certification or endorsement from India over the recent actions it has taken in relation to Hafiz Saeed," a spokesperson for the federal Interior Ministry said in a statement in response to Tuesday's statement by the Indian Ministry of External Affairs.

The spokesperson said the actions taken by the government were carried out as per "obligations vis-à-vis listing of JuD under UN Security Council Resolution 1267 in December, 2008". He, however, said various actions that needed to be taken under the relevant resolution i.e. arms embargo, travel ban and asset freeze were not taken for some reason by the previous regime.

"India has constantly been using Hafiz Saeed's political activities as a tool to malign Pakistan," the spokesperson said, adding that the international community should take note and understand that Pakistan is a democratic country. "In Pakistan judiciary takes free, independent and transparent decisions."

The Interior Ministry urged New Delhi to come up with undeniable evidence against the JuD chief if it were serious about the allegations.

"India should come up with concrete evidence against Hafiz Saeed which is sustainable in court of law in Pakistan or for that matter anywhere in the world," the statement said.

The ministry warned New Delhi against "casting aspersions and levelling allegations without any corroborating evidence", saying it would not help the cause of peace in the region.

The firebrand leader, who has a $10-million bounty on his head, was taken away by police on Monday and escorted to a house where he is now under house arrest. Four other JuD followers were detained in the same operation.


India said JuD was a front for the militant Lashkar-e-Taiba group, which it accuses of carrying out the attacks on India's financial capital Mumbai in November 2008 which killed 166 people. Islamabad briefly detained Saeed in the aftermath of the attacks but he was later released on court orders.


Swarup on Thursday said Hafiz Saeed has himself confessed to masterminding multiple acts of terror directed at India.

"So the so called concrete evidence that Pakistani establishment is looking for is already available in Pakistan. All they need is to find the requisite political will," he added.

India has asked Pakistan to re-investigate the 2008 Mumbai terror attack case and put on trial Jammat-ud-Dawah chief Hafiz Saeed who is currently under house arrest in Lahore under the anti-terrorism law.

India has made a freshdemand in areply to Pakistan's request to send 24 Indian witnesses to record their statements in the case, an interior ministry official told PTI today.

"We have received a reply from Indian government in response to our letter regarding sending 24 Indian witnesses to Pakistan to record their statements in the Mumbai terror attack case.

"But instead ofentertaining our request India has sought re-investigation of the case and alsodemandedtrialof Jammat-ud-Dawah chief Hafiz Saeed and Lashkar-e-Taiba operation commanderZakiur Rehman Lakhvi in the light of evidence it had provided to Pakistan," the official said.

The Pakistan government on January 30 had put Saeed and the four leaders of JuD and Falah-e-Insaniat under house arrest in Lahore under the country's anti-terrorism act.

Saeed, who carries a reward of USD 10 million, was also put under house arrest after Mumbai terror attacks in November 2008 but he was freed by court in 2009.

The official said Indian witnesses statement are needed toconclude the case which has been pending for the lastseven years.

He said Pakistan has no issue to try any suspect of Mumbai case provided it has evidence against him.

"If India provides some strong evidence against Hafiz Saeed in Mumbai case we will try him," he said, adding that Lakhvi was tooreleased on bail because of lack of solid evidence against him.

India has been urging Pakistan to complete the trial at the earliest. It has said that enough evidence has been shared with Pakistan to prosecute the accused.
Meanwhile, no hearing in the Mumbai case was held today.

This was 17th consecutive hearing of the case in which no progress has been made primarily because the anti-terrorism court was awaiting reply from India regarding sending of 24 Indian witnesses to record their statements.

The trial court has already completed recording of the statements of all witnesses here and their cross examination and other relevant record has also been presented before it.

The trial court is likely to be informed about theIndian reply on next hearing scheduled for March 8.

Mumbai attack mastermind Lakhvi, Abdul Wajid, Mazhar Iqbal, Hamad Amin Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younis Anjum have been facing charges of abetment to murder, attempted murder, planning and executing the attack.

Lakhvi got his freedom some 22 months ago after he secured bail in the case. He has been living in undisclosed location since then.The other six suspects are in Adiala Jail, Rawalpindi.

Ten LeT militants killed 166 people and wounded dozens in Mumbai in November, 2008. Nine of the attackers were killed by police while lone survivor Ajmal Kasab was caught.
Kasab was executed after a court found him guilty and handed down deathsentence.

Pakistani authorities on Sunday withdrew terrorism charges against Hafiz Saeed and his group Jamaat-ud-Dawa (JuD), paving way for the possible release of the UN, US and Indian designated terrorist for his involvement in 2008 Mumbai attacks.

A Punjab government official told a review board of Supreme Court on Saturday that the provincial government did not include charges of terrorism in the new order for Hafiz Saeed and his aides.

Authorities had earlier detained Saeed under Anti-Terrorism Act (ATA).

Saeed's lawyer A.K. Dogar had urged the court to order the release of Saeed and his four aides since they are no longer under ATA. The Lahore High Court is expected to decide his application in the coming week after Jusice Muzahir Naqvi asked the government to file charges against Saeed. He had warned the government earlier this week that Saeed would be freed unless evidence was presented against the JuD leader.

Offer to provide evidence

Earlier on Friday, the government offered to provide all evidence against Saeed and the JuD privately to a High Court judge in his chambers, and urged the court to not grant any relief to Saeed, saying it was a highly sensitive matter.

Saeed and JuD were already banned by the UN while U.S. has put $10 million bounty on his arrest.

Saeed was arrested in a crackdown in January this year and put under house arrest. His lawyer A.K. Dogar told the court on Friday that the Punjab government had once again extended Hafiz Saeed's detention for three months.

Saeed challenged his detention in the Lahore High Court alleging that his arrest was due to U.S. pressure and that he had never been charged for any crime.

No formal charges have been filed against Saeed so far by Pakistani authorities.

Cites ‘lack of consensus’ for not designating JeM chief as a global terrorist

Citing a lack of “consensus,” China has said on Monday that it is once again not designating Masood Azhar, head of Pakistan-based militant group Jaish-e-Mohammad, as an international terrorist.

The Chinese position, expressed by its Foreign Ministry spokesperson, Hua Chunying, came ahead of Thursday’s meeting of the 1267 committee of the United Nations Security Council, where Azhar’s status would be discussed.

Xi-Modi’s “excellent” meeting

Chinese President Xi Jinping and Prime Minister Narendra Modi had apparently held an “excellent” meeting at the sidelines of the Brazil-Russia-India-China-South Africa (BRICS) summit in Xiamen in September, raising a slim possibility that Beijing may change tack on Azhar during this month’s UN conclave.

“We have made our position clear many times from this podium. The relevant resolutions of the security council have clear stipulations as to the mandate to the 1267 committee and also clear stipulations when it comes to listing of relevant organisations and individuals,” said Ms. Hua.

She added: “As for listing the application by the relevant country, there are disagreements. China raised the technical hold so as to allow for more time for all parties to deliberate on this matter. To our regret the committee so far has yet to reach a consensus.”

"Pakistan is a victim of terrorism"

Asked whether China was resisting the ban on account of its special ties with Islamabad, Ms. Hua said: “I can understand why you raised this question but cannot side with what you said. China always upholds the principle of objectivity and fairness and we judge this matter on its own merits.”

The spokeswoman stressed that Pakistan itself was a “victim of terrorism.”

“You mentioned Pakistan. Pakistan is also a victim of terrorism and we support Pakistan in countering terrorism in accordance with its own national conditions.”

China had repeatedly imposed a “technical hold” on India’s application for banning Azhar, who has been accused of masterminding last year’s attack on an Indian Air Force base. In January, the United States filed a fresh application, backed by Britain and France after India’s filing on Azhar’s listing had lapsed last year.
