can ICJ rule freeing him? or just can stay his hanging ?
Depends whether the Pakistani state submits to the ICJ. It can technically refuse, if I am not mistaken. But, if it refuses, then India may refuse to do so in any other case too. I am not sure if the ICJ has jurisdiction. But, the very fact that it has admitted the application by India, means it sees merit in hearing the case. Which is not a great thing for Pakistan.
The ruling is not for freeing. It is a request. If Pakistan submits to the ICJ in this case, it will then have to follow ICJ ruling in the matter, if it goes to court.
