Hinduism does not condone homosexuality.

Homosexuality was recognized and neither persecuted nor encouraged.

Manusmriti equates homosexual sex to a man having sex with a menstruating woman, or having sex during the day, and the punishment involves purification rites: bathing with clothes on, and fasting for a night, and eating specific cow related products. Failure to purify can result in loss of caste.

Chanakya's Arthashastra , says -

"A man having sexual intercourse with another man shall also pay the first amercement. (Lowest fine)"


In any case, the law and the practices of dharma are two different things.

The Law gives you freedom to do most things as long as it does not harm others.

In the practice of dharma, kama, or lust, is one of the arishadvargas, or six passions. To attain moksha, or salvation, one must lack all desires, including sexual ones.
