What's new

IHC to initiate contempt proceedings against Imran Khan for demanding legal action against Police & Magistrate

Problem is judiciary is not accountable in Pakistan just like the military isn't

Pakistan is the only country where judges appoint themselves at upper courts.

What's needed is a radical change..judges need to be increased in numbers proceeding made public and even a jury trial needs to be brought back rather then judges alone deciding after taking cash under the table

Judges, lawyers will be on the road like during Musharaff time if any changes are even suggested, the others are already showing their true colours, to be frank they were always like this but you only feel the pain when the target is you.

From the comments of the judges it is clear, they have already decided, so why do the hearing, just issue orders, and arrest IK for contempt of court. While a convicted criminal out on bail, for a reason which doesn't exists anymore can demand a full bench and threatens SCP. But no action. That criminal get full state security and given billions of rupees of Pakistani people's money to buy the journalists. I am sure these crooked judges lives on some different planet.

IK statement was perfect example of hitting axe on your own feet. Anyways he should clarify and apologize to close the case.

Did you hear what he said!!
He said PTI would take appropriate legal actions against the Heads of the Police and the judge who handed the custody to those who carried out torture on Shahbaz Gill.
In which country, it is a contempt of court!!
Oh don't answer the Q. We all know there is only one such country in the world, where any bizzare thing can happened.
It is now officially known as "Banana Republic of Pakistan".
Long live the era fo tyrany and oppression. Hitler is turning in his grave, saying "WTH, how come I didn't use all these tactics"". While the imported Government's members saying, "If only could have the liberty of Gas Chambers". Things are this bad my friend. Pakistanis have to rise up.

This is what happens when you make a deal with the devil. IK jumped in bed with goras and their agent Kiyani when movement was launched against Musharraf. Same forces have been activated again. Politics, like cricket, is survival of the fittest. Sadly for Pakistan, IK's political acumen is much, much lower than his cricketing abilities.

By providing legitimacy to the western sponsored lawyers movement, IK helped likes of Zardari and NS to come to power. These western sponsored puppets repaid the favor by appointing US agents in critical positions in foreign service, in judiciary and in law enforcement. Today IK is getting the just reward for betrayal of Pakistani nation. Legal remedy will be used initially and if that fails, serious games will begin. As we have seen with the recent deaths of witness against the Sharif family, murder is no big deal for gora agents or their masters or for Pakistani judges. Elimination of few more will barely raise an eyelid.

I do feel sorry for the likes of Shabaz Gill who had to pay a physical price for IK's folly. But politics in Pakistan is not child's play. As we have seen even recently, plenty of innocent patriotic Pakistanis have been eliminated. So Gill is getting of relatively easy.

For people of Pakistan, I have no sympathy. This is not the nineties and the likes of Azhar Lodhi and Shaista Zaidi have been long gone. Thanks to policy of a dictator, we get to see murder and torture in real time. And yet large sections of awam stand behind traitors. Is there any country on Earth whose political leadership is based in the capital of former colonial master? Would Koreans ever support parties whose leadership is based in Tokyo? I think not.

Ghulami is not a fate alien to people in our part of the world. Our ancestors could not even dream of overthrowing the Raj. But then, Hitler attacked Poland and Jinnah saw the opening. No Jinnah around anymore and I am not sure we will get lucky twice. Arabs have learnt to live with ghulami. Why should we be any different?

Convicted criminal can't be out on bail. This is against common law(common sense law)

But anything is possible in banana Republic
Just like chief executive was made possible by judiciary

Bail is only for on trial people not for convicts

We have two convicts out.
And third one being their grantour as PM.

WHAT A MOCKERY

Ranking at #130 in performing their duties to provide justice to the public

Ranking at top #10 in perks and privileges in the whole world - a true shame for a country where people are burning their electricity bills, because they wont have anything left to buy food if they pay those.

To top that, they also want that they be treated as "heroes" and respected as if they are ranked #1 for providing justice to the public.

I am speechless!

Unless there is a pill where you can change people's heart and program them to respect you, it is never gonna happen.

Earn it or forget it!

Now start contempt proceedings for 200 million people because judiciary (courts + bar councils) is the MOST HATED institution in Pakistan (closely followed by police).

Oh poor innocent police officials and judges are terrorized by imran khan. What a stupid banana republic Pakistan has become.

The Islamabad High Court, which on Tuesday summoned PTI Chief Imran Khan in a contempt of court case on August 31, has outlined the implications of Imran Khan’s “contemptuous and intimidating statements” statement against Additional Sessions Judge Zeba Chaudhry in a written order.
A three-member IHC bench headed by Justice Mohsin Akhtar Kayani heard the contempt of court case hearing against Imran Khan. The other two judges on the bench are Justice Miangul Hassan Aurangzeb and Justice Babar Sattar.
During the hearing, the bench ordered the PTI chief to appear before the Islamabad High Court on August 31. Later, it issued the written order and said that Imran Khan had prima facie undermined the integrity and credibility of the judicial system and that after his statement citizen’s right to access justice was at stake.

The court said that in a speech by Imran Khan at a public rally in Islamabad’s F-9 park “prima facie contemptuous and intimidating statements were made against Ms. Zeba Chaudhary, Additional Sessions Judge, who is working under the administrative control of Islamabad High Court, Islamabad.”
Referring to the case registered against Shahbaz Gill, the order said that Imran Khan’s statement was in a subjudice matter and the court was of the view that prima facie he made the statement “to obstruct the course of justice and due process and erode public confidence in the Courts of law and therefore, come within the ambit of contempt of Court.”
“These remarks have also been made with the motive of undermining the integrity and credibility of the judicial system in the eyes of public at large.”
The court issued a show-cause notice to Imran Khan under Section 17 of the Contempt of Court Ordinance, 2003, telling him to explain his remarks against the judge and ordering that the notice must be served through a police SHO.
The court said that after Khan’s statement “at stake here is public faith in the administration of justice, the rights of citizens to access justice and to be afforded due process of law by a justice system not susceptible to intimidation, and a system of rule of law that the unruffled by considerations of fear or favour and capable of affording equal protection of law to all citizens, in accordance with the mandate of Article 4 of the Constitution, irrespective of their social and economic class or political affiliation.”
It said the issue was linked to the state’s ability to “uphold rule of law through a Court system that dispenses justice independently and transparently.”
The court has forwarded the case to the chief justice IHC with the request to form an even larger bench to hear the case.
Earlier, during the proceedings, Justice Kayani said that Imran Khan’s allegation applies to the entire judicial system and not just a fellow judge.
The court said that the entire judicial system has been put at stake.
How the state institutions would serve the public if they are not allowed to work, the court asked.
These remarks are to defame the entire judiciary, the justice said.
If such an environment is being created then no one will be able to work, he said.
The court said that remarks were made about a female judge who is currently hearing multiple cases.
Are they going to make speeches against everyone who gives a verdict against them? the court asked.
The court asked the advocate general if it should issue a notice to Imran and hear his point of view, or should it directly issue a show-cause notice.
Prima facie, this calls for show-cause notice, Advocate General Jahangir Jadoon replied.

Case background

Pakistan Tehreek-e-Insaf Chairman Imran Khan, while addressing a rally in Islamabad, had announced to take action against the Islamabad Inspector General of Police, DIG, and female magistrate in court.
Yesterday, the Islamabad High Court took notice of the issue and decided to convene contempt of court proceedings against Imran Khan.

I agree with everyone criticizing IK over this statement....those who have seen the working of Pakistan judicial system will agree that this statement is no less but even more cruel that death threats, its even worst than murdering the entire city....he should be booked under terrorism laws.

p.s. don't forward this post to Mariam Jahil or any of her family members, she would tweet this and get embarassed when some parha likha nooni (if there is one) translates it to her.

IK should openly make it a case of contempt of court done by the thugs impersonating as judges, who are clearly doing selective justice (injustice), ignoring threats of physical assault on judiciary by PDM goons, while taking notice of IK warning individuals of legal consequences for their illegal actions.
Infact, if IK announces a government in Pakistan, on his own, that would be taken more legit by people than one being run by US stooges.

I think this is the most serious case for IK. The rest of trumped up charges and ECPs actions are very weak and eventually will be cleared. But if three judges agree to issue a notice on their own, then they have already made up their mind. I don’t know if a clarification or apology will work in this case or not?

I read IK is not planning to render an apology. Unless he changes his mind on legal advice.
Individual judges, no matter how many of them are there, cannot take suo moto action. Thus, the start of the case is questionable under constitution. But it is Pakistan, they all make a mockery of law, justice and constitution, even judges.
IK on the face of it has committed no contempt. He never threatened anyone, he says they would start legal proceedings. Since when invoking law is a threat!!
Pakistani judges are in complete control of Bajwa and Nadeem, they take orders, and this is done on orders. So they are doing the case first, they will find some absurd reasons under the law later.
That's how it goes in "Banana Republic of Pakistan".
Bajwa is breaking so many laws, interference with the running of justice in itself is perverting the course of justice crime, when these judges will invoke that against Bajwa!!
Pakistani society is a hypocrite society, it is full of "Munafiqoon". There is nothing worse in Islam than a Munafiq. The Holy Quran decrees against "Munafiqoon" repeatedly. The Word of Allah SWT is final on every matter, it is final on "Munafiqoon" too.
Bajwa is a curse on Pakistan. Pakistanis should stand up against him and there should be blockage movement all over Pakistan to bring this illegal government and Bajwa down. They both are the same, in fact Bajwa is defacto Martial Law Administrator in Pakistan at the moment.

He will apologize or should clarify his statement completely. Taking on judiciary is zero sum game. Even half hearted apology will clear him from this unwanted case.
