Nothing stops Pak from doing so. But the case will be not be heard because it is outside the scope of the jurisdiction of the ICJ. India will cite the Simla Agreement which will prevent ICJ intervention

ICJ takes the case by the consent of both parties. India will never be party to dispute taken to ICJ. It was Pakistan under Sharif which wanted to give India the advantage and Pakistan the bad name.
