ICJ rejects India’s plea for acquittal, repatriation of Kulbhushan - Updates, News & Discussion

Does it relate to Powerful as compare to jurisdiction? However, not a good comeback to reply like this. And by the way, is India that powerful?

That is why I said in previous post that, one must read & update before jumping to conclusive question or judgment in this case.

Just to add ICJ has no legal power to over rule local court decision. ICJ is not a court of appeal.

Beside its decision is non-binding.
 
India might win this case but pakistan shouldn't leave jadhav.icj can't overrule local Pakistani court.india will build pressure after winning the case but let them do whatever they want.don't release jadhav.tensions will mount again and may be we close airspace again.
 
The judgement of ICJ is final and binding. There is no room for review. Although many countries, including the US and China, have been known to violate the rulings of the world court. The only other body to seek redressal from such violations is the United Nations Security Council (UNSC). Given that they are P5 nations, approaching the UNSC would have been a futile effort.

But, that is not the case with countries that are not permanent members of the Security Council. Therefore, any judgement at the ICJ on Kulbhushan Jadhav would have to be abided by both parties, India and Pakistan.

Interestingly, the Jadhav verdict comes on International Justice Day.

Lets see where that justice is today.
 
Don't know about which way verdict will go but doesn't ICJ also gives their judgments on water disputes between India and Pakistan.
A precedent will be made by pakistan after this verdict which India will follow in its own way.

India will only twist the facts through uncontrolled Indian Media with lot of propaganda & making falsified claims. Indian Media is well known for such reputation and Pakistan is not worried of any outcome from ICJ but participated into proceedings on courtesy unlike Indian plain rejection while running away from such platforms.

After reading multiple posts claiming that ICJ judgement is not binding on Pakistan, then I wonder why fight it out in that court in first place if you felt it's not binding on you. After all court fighting are a costly affairs and who better to know than Pakistan
 
Pakistan is not bound to follow ICJ verdict.. this court rejected Pakistan case back in 99 of Atlanta shot down...

India has always respected International courts ,you could argue it is so because we win but that's the reality and that's the precedent India has set,it's upto pakistan now after this verdict.
Either pakistan can respect or open a new option for India.
 
The verdict will be against Pakistan, as usual. This decision is not based on what evidence is presented in the court or how this case was argued by both parties. The decision is purely based on which country have more international influence. Will Pakistan accept ICJ verdict in case India win the case? Its an internal matter of Pakistan like Kashmir is internal to India. ICJ’s verdict should be respected in the same way India has responded to UN resolutions on Kashmir. India is fighting for this terrorist in ICJ we knew its a norm in India to let loose a mass murderer and Rapist! and will become PM in future.

What happened in this case...

ICJ only accept those cases in which both parties agrees to move this into the international court.

1. Before going to INJ, Sanjan Jindal met NS.

2. Suddenly, India went to Court on Kulbushan Yadav case.

3. Nawaz Sharif was puppet of International Establishment, so wiithout consulting the Army, NS Foreign office received, accepted and return the ICJ case.

4. Once you accepted officially, you can’t move out. You are bound to follow all the proceedings.

5. If Pakistan initially rejected that proceedings by labeling this case “Its our internal matter”, that case was over on the first day... but...

Now at this stage, ICJ ruling can’t force Pakistan. Pakistan execute Kulbushan...

What India can do if Pakistan execute, protest, takeup this case in Security Council and on the other side, creating water disputes because Pak/Indi has long history of water disputes so when Pakistan move that case to ICJ, India will not become a part of the case and then the case automatically becomes bi-literal...

But again... technically, Pakistan case is very strong but because of of American and British support, you can easily predict the result.

I have lost faith on IK regarding India. His BS way fo sealing Modi regime sometime ******** me.... Army should and will execute him despite of whatsoever decision coming out from this “Army knew since day one”.
 
ICJ to announce verdict in Kulbhushan Jadhav case today

THE HAGUE: The International Court of Justice (ICJ) will deliver its reserved verdict in Kulbhushan Jadhav case on Wednesday (today).

Pakistani team headed by the attorney general has reached The Hague to hear the verdict. The team also includes foreign office Spokesperson Dr Muhammad Faisal, Radio Pakistan reported.

According to official sources, the verdict will be announced at 3:00 pm, as per Netherlands time.

Kulbhushan Jadhav, who is currently in the custody of Pakistan’s Law Enforcing Agencies (LEAs), has been accused of charges pertaining to espionage which are punishable by death under the law of the land.

Pakistan on Feb 15 released a fact sheet just before the hearing of Kulbhushan Jadhav’s case at ICJ in The Hague.

Pakistan has presented evidence obtained from Commander Jadhav after his arrest and during the criminal process leading to his conviction as amply demonstrating his activities in fomenting terrorism and engaging in espionage in Pakistan.

Who is Kulbhushan Jadhav?
Pakistani security agencies on March 24, 2016, apprehended an ‘on-duty RAW agent’ from Balochistan. The suspect was said to be an officer of the Indian navy working for the covert agency to destabilize Pakistan.

The operative had contacts with banned organizations and was working on plans to break Karachi and Balochistan away from Pakistan and to sabotage the billion dollar China-Pakistan Economic Corridor (CPEC) project.

On March 25, a day after the arrest, the Indian Ministry of External Affairs said the Indian man arrested from Balochistan has no connection with the government, however, admitted that Kulbhushan Yadav is a former officer of the Indian navy.

Either pakistan can respect or open a new option for India.

Its useless to expect an academic argument where history based facts/reality is just ignored so conveniently. Let's the verdict be announced and will see.

The 2013 Kishanganga Dam case which was in favour of India was decided by the International Court of Arbitration(ICA) not the ICJ.

In case of water, Pakistan and India have a treaty signed under the supervision of the WB.

India, if it in future violates elements of the treaty and at first doesn't accept arbitration from a neutral expert appointed by WB and then goes ahead further to disregard any judgements by the ICA, will have no leg to stand on. In fact, it will jeopardize the previous judgement of the ICA in its favour.

The issue of water between upper riparian and lower riparian states is global and any untoward steps to block Pakistan's water needs will have global repercussions apart from a justified military response from Pakistan.
 
Expect the ICJ to rule against the death penalty and urge Pakistan to allow consular access.
And after that expect a deluge of Indian trolls on Pakistani forums all over the internet.
Those who disappeared after 27/02/2019 are coming back today.
