The UN's top court on Thursday announced its ruling on an urgent bid by India to stop Pakistan from carrying out a death sentence on one of its nationals convicted of spying.

"Pakistan should take all measures to ensure that Mr Jadhav is not executed till the final decision of this court," the court said.

"India has the right to seek consular access for Jadhav," it also added.

The ICJ also said the case is now being heard in the international court, and both sides can present their arguments to the court.

The president of the court, Ronny Abraham, read out the decision.

In an emergency hearing swiftly organised on Monday, lawyers for New Delhi had urged the International Court of Justice (ICJ) to halt the execution of Kulbhushan Sudhir Jadhav.

Jadhav was arrested in Balochistan province last year and he had confessed to spying for Indian intelligence services. He was convicted by a court martial and sentenced to death.

The UN tribunal, based in The Hague, had earlier said in a statement that it “will deliver its order on the request for the indication of provisional measures made by India in the Jadhav Case (India vs Pakistan) [...] on Thursday May 18, 2017”.

India denies Jadhav was a spy, and on Monday accused Pakistan of “egregious violations of the Vienna convention” by denying him access to legal counsel and consular visits, and refusing to reveal the charge sheet against him.

Jadhav was “an innocent Indian national, who, incarcerated in Pakistan for more than a year on concocted charges ... has been held incommunicado... and faces imminent execution,” Indian lawyer Deepak Mittal told the tribunal on Monday.

But Pakistani representatives accused New Delhi of “political grandstanding” and told the court Jadhav “has confessed to having been sent by India to wage terror on the innocent civilians and infrastructure of Pakistan”.

This is a developing story which will be updated as the court's judgement is made clearer.

And if Pakistan hangs him, ICJ can do what exactly?
Nothing, but don't go back to ICJ on any international disputes because it's not binding for Pakistan and hence other countries will reciprocate the same with Pakistan too.

Well on the serious note, it is all about a life too. However, if someone is on troll mod, can't say anything but as per current situation, execution has been stayed till final judgment of ICJ. Also, it has been expressed that Pakistan did not mention any date on record for execution because KY has the right/remedy to appeal before proper forum.
I don't know who is on the troll mode. I'm damn serious about that. He is terrorist mastermind and deserves to be beheaded or hanged publicly.

Every attempt is being made by the PM to release him!! He has friends in PM office.

His punishment is determined by Pakistani courts

His guilt or non guilt is not up for question

They have only said he should have been given consular access

US has declined to accept ICJ orders multiple times. So Pakistan can do that as well.

P.S This was on the cards, Pakistan will use him to malign India at the international court since getting an stay order was easy for India but to prove him as not a spy is the most difficult part.

Not terrorist, he was doing business after retirement and was kidnapped from Iran.
