Jammu, Oct 12: Jammu and Kashmir High Court has quashed an FIR registered against two youth for allegedly wearing a green colour T-Shirt with Pakistan written on it on August 15. The two youth, Sheikh Imran and Nawaz Sharif, were booked under section 153-A RPC by Udhampur Police in 2012.
Justice Tashi Rabstan of J&K High Court Jammu allowed the petition filed by the accused youth with the observation that no independent compliant was lodged by the District Magistrate/Government before any authority.
The investigation commenced with the registration of FIR for commission of offence under Section 153-A RPC, the court observed.
The grounds taken in the petition is that the respondents have not complied with the provisions of Section 196 Crpc and, therefore, the FIR as well as the charge framed against the petitioners by learned Additional Sessions Judge, Udhampur is in violation of the Rules.
The police had claimed that the youth were found wearing a green T-Shirt with the name and symbol of Pakistan inscribed on it on August 15, 2012.
On being asked by the police party as to why they are deliberately wearing the dress of Pakistan on the independence Day, the petitioners replied that their independence day was on 14th August, the police had claimed in the FIR.
