AHMEDABAD: A woman who wanted to terminate her 28-week pregnancy after being allegedly gang-raped, has been told by a Gujarat court to "bravely go ahead and deliver the child." The woman had told the court that she feared her husband and his family would never accept the child.

The Gujarat high court, while rejecting the rape survivor's petition on Thursday, asked the state administration to look after her and make sure her baby is not abandoned.

The woman, who is from Saurashtra, had filed an FIR or police complaint on March 16, alleging that she was kidnapped in July last year from outside her home and gang-raped by seven men who moved her from place to place for about 10 months.

When she went to the police, she was 24 weeks pregnant. A district court rejected her plea for abortion saying it was "too late" and could endanger her life. The high court endorsed the ruling.

"I am conscious of the fact that to carry a child in the womb after an act of rape is not only extremely traumatic for her but also humiliating, frightening and psychologically devastating. In Indian society, she becomes an object of scorn and ostracisation," said Gujarat high court judge JB Pardiwala.

"The applicant will have to bravely go ahead with the pregnancy and when time comes, she should deliver the child. I am conscious of the fact that it is easy for a judge to say so in his judgment because it is ultimately the applicant who will have to face hard days ahead. Yet, howsoever harsh one may find the law, it remains the law and one has to respect it. She must understand that termination at this stage will put her own life in peril."

The court directed the state government to help the woman with medical facilities and ordered police protection for her and her family. Top district officials have been asked to keep a close watch on the woman's family, including her husband.

The petitioner's lawyer says they will decide now whether to appeal the high court's decision.

If abortion was legal in India their would only be like 10 girls left in India.

Legal up to 20 weeks. The woman has waited far too long.

She may have been going through intense psychological issues and torn apart on the issue of aborting her child or letting it live in those weeks.

Might well be true. However there is now a case of viability of the fetus. Other than any risk to the mother, the fetus is now deemed to have some rights.

No its not, it can be done. She should go to back alley and have this done. It will save her a life time of mental torture. She will go crazy after 5 years of having this baby and will end up in mental hospital or dead by suicide.

Read the article again. The court gives this ruling primarily because the baby is already 28 weeks old and abortion at this stage may endanger the life of the woman.

As per Medical Termination of Pregnancy Act of India :
1.Abortion before 12 weeks of pregnancy is allowed, opinion of one doctor is required.
2. Abortion between 12-20 weeks is allowed , opinion of two doctors is required.

However, determination of sex of the foetus is not allowed, at any stage.

Yes and rightly so because millions are aborted when family gets to know its a girl sad but true

India loses 3 million girls in infanticide

In an alarming trend, girl child numbers in India have shown a sharper decline than the male children in the decade beginning 2001, leading to a skewed child sex ratio.

On the eve of the International Day of the Girl Child, government on Tuesday said that while the decade saw an overall drop in share of children to total population, nearly three million girls, one million more than boys, are “missing” in 2011 compared to 2001 and there are now 48 fewer girls per 1,000 boys than there were in 1981.

“During 2001- 2011, the share of children to total population has declined and the decline was sharper for female children than male children in the age group 0—6 years,” said the study “Children in India 2012- A Statistical Appraisal” conducted by the Central Statistical Organisation.

“Though, the overall sex ratio of the country is showing a trend of improvement, the child sex ratio is showing a declining trend, which is a matter of concern,” the study said

According to the report, female child population in the age group of 0-6 years was 78.83 million in 2001 which declined to 75.84 million in 2011.

The population of girl child was 15.88 per cent of the total female population of 496.5 million in 2001, which declined to 12.9 per cent of total number of 586.47 million women in 2011.

Similarly the male children population has also declined from 85.01 million in 2001 to 82.95 per cent in 2011. During the period, 1991-2011, the child sex ratio declined from 945 to 914, whereas the overall sex ratio showed an improvement from 927 to 940.

“Though the child sex ratio in rural India is 919 which is 17 points higher than that of urban India, the decline in Child Sex Ratio (0—6 years) during 2001—2011 in rural areas is more than three times as compared to the drop in urban India which is a matter of grave concern,” it added.
