Dalit killing case: CBI fails to file chargesheet; 4 Rajputs get bail

As Central Bureau of Investigation (CBI) failed to file chargesheet against 12 accused in killing of Dalit children in Sunpedh, Faridabad, within the mandatory 90-day period, the CBI Special Magistrate, Haryana, here on Tuesday granted bail to four accused.

On October 20, 2015, two children, which included nine-month-old girl and two-and-half-year-old boy, were burnt to death in Sunpedh. As per the complaint of Jatinder Kumar, the victims’ father, the police arrested Sanjay, Dharam Singh, Kartar Singh and Balwant Singh of Rajput community on the same day. Later, 8 more people were arrested who are also expected to get bail in absence of charge sheet.

Jatinder Kumar had alleged that the Rajputs poured inflammable liquid through a window inside the room where he and his wife were sleeping with the two children, and set it ablaze.

The four accused who got bail on Tuesday had submitted in an application before the CBI court, through their counsel Abhishek Singh Rana, “That in this case, the challan under section 173 of CrPC (Code of Criminal Procedure) has not been submitted by the CBI in the court till January 18 and now, 90 days has expired,” and added that in view of section 167 (2) of CrPC they were entitled to bail.

According to section 167 (2) of CrPC, the detention of accused couldn’t exceed 90 days in cases of murder.

The accused have been maintaining that they were framed as they were pursuing and witnesses in the murder of three Rajput men where 11 Dalits are accused.

“On October 5, 2014, three members of the Rajput community, Indraj, Mohan Lal and Bharat Pal, were killed in a fight which took place between them and the Dalits over a mobile phone. Jatindar Kumar’s two brothers are accused in the case,” said Abhishek Singh Rana, counsel for the accused.

While giving consent for polygraph test, the accused had demanded that lie detection test of Jatinder Kumar and his wife Rekha should also be conducted to find out the truth. However, the CBI opposed it but the court issued notice to Jatinder Kumar and his wife for February 1.

Haryana Forensic Team Counters Dalit Children Killing Claim: Report

Forensic experts in Haryana have concluded that the fire which killed two Dalit children and injured their parents started inside their house and not outside as claimed by the victims, reports said.

The Haryana forensic team, that visited the village yesterday, has submitted its report to the Central Bureau of Investigation which took over the case from the state police this week.

Two children had died and their parents were badly burnt in the incident in Sunped in Faridabad on October 20 allegedly carried out by villagers from another community.

The team of Haryana experts reportedly found a half-burnt kerosene oil plastic bottle under the partially burnt bed and a burnt match stick lying on a slab next to the window of the room.

Regardless of my religion, my caste is Rajput and I have every bit of right to our history. Infact Pakistani Rajputs take alot of pride in displaying their caste name that is because it cultural. Rajputs are one of few clans that don't do marriage outside of their clan (preferably) but I don't believe in that though. So Yeah if our Biraaadars on the other side of the border wants to do anything they have a right to do w.e because we are "Rajputs".

I never knew that there is social hierarchy in muslims like hindu society....
And I know that in whole Indian subcontinent endogamy is prevalent, still its your choice to marry inside or outside clan...
lastly, Anyone can take pride in his caste and clan. however whether Rajput or Pundit or Baniya or Shuddarr, or Shia or Sunni, every one is equal in the eyes of law;
