Among the ASEAN countries they all have their territorial disputes with one another, now why is it that you and other Indians like to criticize China for not participating the arbitration process? You don't see the Viets dragging the Pinoys to the International Court and vice versa now do you? And we can all see that you guys don't criticize these countries either only China.... if you don't consider that double standard then i don't know what is. Besides China has the right to refuse taking part of it, it's as simple as that. The International Court is even a joke considering when it wanted to charge US troops for war crimes, Bush even threatened to invade the Court with US military if that were to happen. Arbitration is for the weak.

One does not arbitrate when one controls the entire situation and enjoys ultimate advantage.

And there is no "other nations." Everybody is on their own.

Exactly. When it comes to an evaluation of the ultimate reality based on facts on the ground, the arbitration is no more effective than Obama's riding a mini bicycle. Hence all we have is talking heads with lots of talking points, ignoring the fact that both the international court as well UNCLOS provide a number of exit clauses and it makes sense because unless these institutions offer some relief, they will be utterly useless and dead soon.

I am not even talking about China simply shrugging off whatever verdict comes from the Court. Lots of historical precedence proves that one major country ignores the ruling, the entire story is forgotten in a week or so. Point is, no body cares, really, probably other than the most related party, the Philippines in this case.

It is not about why we should or should not go the arbitration but why are we being target and force to go when there are disputes between Vietnam & Philippines. You see, UNCLOS law allow country to reject going to arbitration if they fell it is unfair. This fact of unilateral by a midget is what we object.
