Cabinet approves recovery of ‘health expenses’ by Nawaz, Zardari govt

Can you please quote this provision of the law and its retrospectively date of effect?

Is there any law that allows Govt officials to spend unlimited amount of money on their personal trips.

Under the law where state resources have been used for up keeping of personal assets and where state resources have been used one was not power and had no right to use of those resources.

These are misuse and abuse of public resources thus are recoverable by the state and failing which they can be charged under NAB law.

Remember IK was referred to NAB for helicopter case.

How is calling NAB incompetent interference with its function? Interference would be where the Government directs NAB to take certain action. This is not same as calling it incompetent.

Now Government can render bill to these people to pay up or failing which Government can refer the matter to NAB and NAB can than investigate the matter, like they did with IK for helicopter, and if NAB finds something it can than commence proceedings.

NAB Chairman has repeatedly insisted that GoP is pressurizing NAB to pick and choose. It does not help also when NAB works and the PM goes on the tele and says foreign powers are demanding that charges be dropped for political mafia.

The good cop bad cop policy will not work anymore in Pakistan.

1. I am not aware of when the chairman has said that. That is news to me. Can you provide link to it being reported or video of any press conference. From what I recall he has repeatedly said that there is no pressure on NAB.

2. What PM has said about the foreign power has nothing to do with NAB's work nor it is hampering NAB's work. PM has has stated that those who want deal can do that through NAB plea bargaining and that there will be no NRO from the government.

So can government provide NRO, possible through legislation enacted through parliament. But there will be many legal questions about that. But that by no means its pressure on NAB.

PM has ultimately put external pressure by involving foreign parties in an internal affair. It was already a multi national affair with Qatari letters and Calibris. Before NAB could begin, PM has fatwafied the verdict already thusby providing unnecessary complications in matters of law and order.


So can government provide NRO

GoP cannot provide NRO or ERO. Forget about that

Section 9(a) (iv) and Section 9(a)(vi)

So how will this be proven in court for health expenses that have no limit specified?

9 (a) A holder of a public office, or any other person, is said to commit or to have committed the offence of corruption and corrupt practices- (i) if he accepts or obtains from any person or offers any gratification directly or indirectly, other than legal remuneration, as a motive or reward such as is specified in section 161 of the Pakistan Penal Code (Act XLV of 1860) for doing or for-bearing to do any official act, or for showing or for-bearing to show, in the exercise of his official functions, favour or disfavour to any person, or for rendering or attempting to render any service or disservice to any person; or (ii) if he accepts or obtains or offers any valuable thing without consideration, or for a consideration which he knows to be inadequate, from any person whom he knows to have been, or likely to be, concerned in any proceeding or business transacted or about to be transacted by him, or having any connection with his official functions or 2 [from] any person whom he knows to be interested in or related to the person so concerned; or (iii) if he dishonestly or fraudulently misappropriates or otherwise converts for his own use, or for the use of any other person, any property entrusted to him, or under his control, or willfully allows any other person so to do; or (iv) if he by corrupt, dishonest, or illegal means, obtains or seeks to obtain for himself, or for his spouse 3* or dependents or any other person, any property, valuable thing, or pecuniary advantage; or (v) if he or any of his dependents or benamidar owns, possesses, or has 4 [acquired] right or title in any 5 [“assets or holds irrevocable power of attorney in respect of any assets] or PAGE 13 pecuniary resources disproportionate to his known sources of income, which he cannot 1 [reasonably] account for 2 [or maintains a standard of living beyond that which is commensurate with his sources of income]; or (vi) 2 [if he misuses his authority so as to gain any benefit or favour for himself or any other person, or 3 [renders or attempts to render] 4 [or willfully fails to exercise his authority to prevent the grant, or rendition of any undue benefit or favour which he could have prevented by exercising his authority]; (vii) if he has issued any directive, policy, or any SRO (Statutory Regulatory Order) or any other order which grants or 5 [attempts to grant] any 6 [undue] concession or benefit in any taxation matter or law or otherwise so as to benefit himself or any relative or associate or a benamidar 1 [or any other person] 7 8 [(viii) if he commits an offence of willful default, 9 {; or }] 10[(ix) if he commits the offence of cheating as defined in section 415 of the Pakistan Penal Code, 1860 (Act XLV of 1860), and thereby dishonestly induces members of the public at large to deliver any property including money or valuable security to any person; or (x) if he commits the offence of criminal breach of trust as defined in section 405 of the Pakistan Penal Code, 1860 (Act XLV of 1860) with regard to any property including money or valuable security entrusted to him by members of the public at large; PAGE 14 Punishment for corruption and corrupt practices: (xi) if he, in his capacity as a banker, merchant, factor, broker, attorney or agent, commits criminal breach of trust as provided in section 409 of the Pakistan Penal Code, 1860 (Act XLV of 1860) in respect of property entrusted to him or over which he has dominion; and (xii) if he aids, assists, abets, attempts or acts in conspiracy with a person or a holder of public office accused of an offence as provided in clauses (i) to (xi).];
