Baluchistan High Court declares DHA Quetta illegal, the court in short verdict state that some articals of the DHA Act are contrary with constitution.

Baluchistan Assembly is not the only Assembly or the first one to adopted resolution of DHA Act, which is present in entire country. However, subsequent Notification passed in 30.05.2018 wherein entire Local tribes joint land was notified as DHA Land illegally without acquiring land.

Balochistan High Court’s verdict regarding DHA Quetta: Court notes the DHA Quetta Act 2015 makes DHA independent from govt’s involvement It is “established for the benefit of a limited class of people, with an aim of income generation. It is a non-governmental authority."

The 2015 Act restrains any local body from preparing master plan, planning without consulting DHA Executive Board. “It is only the State which has the power to implement restrictions....in public interest. Such power of State cannot be assigned to a non-governmental entity"

The Balochistan High Court adds that "imposing restriction upon the right of a citizen, guaranteed by the Constitution, for the purpose of acquiring land, for a single private entity, is illegal."

The Court adds that DHA Quetta cannot acquire land under the Land Acquisition Act 1894. The law can only be used by State to acquire land for public interest. "Such power of the concerned Government cannot be entrusted to a non-governmental authority or entity."

DHA is illegal anyway..but what is legal?

That is the question, this verdict essentially leaves all housing societies illegal, even small ones by local developers. A very weak judgement, just a media highlight.

In fact the judgement has no legs to stand upon.

You fail to understand the verdict, it essentially means no society is legal except a government housing society. No one can develop a housing society we have hundreds in every city.
If anyone has ever bought a plot ever it's illegal be it any developer, as only state can sell plots. Our entire housing industry is based on private developers. Government does not sell plots, 99% are private firms developing lands and selling plots and houses.

What a stupidity.
They would live in slums but not let development go one.
If the verdict says that the land is taken by force or there is some corruption then i would admire the verdict.
But the supreme Court is saying that, it is not made by government. Wtf.
The newyork wouldnt be newyork and London wouldn't be London and apris. Wouldn't be Paris if courts like this exist there.
