Army fudged papers, says Kargil officer, moves court

A serving brigadier in the Army—who played a key role in evicting Pakistani intruders from the Batalik sector during the Kargil conflict—has moved the Delhi High Court against the "fudging" of the after action report by the Srinagar-based 15 Corps Headquarters and the Directorate General of Military Operations in the Army Headquarters.

According to Brig Davinder Singh, the report named four infantry battalions—allegedly under his command during the Kargil conflict—to have been under the command of another brigadier who was nowhere near the scene of action.
The petition states that this officer, who was serving as Deputy GOC of 3 Infantry Division in Leh, has falsely been shown to have had an ad-hoc command in the Batalik sectors. Singh attached documentary evidence to prove that all these units were under his command.

Brig Singh, who is at present with the Army Training Command in Shimla, has named the then GOC 15 Corps, Lt Gen Krishan Pal and then GOC-in-Chief Northern Command, Lt Gen HM Khanna, as among those responsible for fudging the report.

He is the third senior officer involved in the Kargil conflict to have moved the Delhi High Court after Brig Surinder Singh and Major General Lakhwinder Singh.

Brig Singh was commanding the 70 Mountain Brigade when his brigade had to fight the Pakistani intruders in the Batalik sectors.

Despite sterling performance by his formation—seven out of the 11 battalions under his command earned decorations—Brig Singh was overlooked for promotion.
He alleged that the false action report was made to hide the laxity of senior officers and to make him a scapegoat for their faults. He prayed to the court to restore his military honour by issuing a order about the facts of the case.

Brig Singh said the fake report of the then Corps Commander was then further propagated by the Director General of Military Operations. The report also found its way into the Kargil Review Committee, where it has been presented as a fact.

Incidentally, the current Army Chief, Gen JJ Singh, was the additional director general of Military Operations during the Kargil conflict while Lt Gen (later Gen) NC Vij, Gen JJ Singh's predecessor was the director general.

The Delhi High Court has issued a notice of motion in the case, which will now be heard in the second week of December.
