The PPP-led Azad Kashmir governments decision to announce three days of mourning over the hanging of Afzal Guru has upset many in the diplomatic circles of Islamabad who are asking why the AJK government had to officially condemn the execution of an Indian national who was convicted by the Indian Supreme Court on terrorism charges.
A Jaish-e-Mohammad activist, Guru belonged to Doabgah village of Jammu and Kashmir, 52 km from Srinagar. He was sent to the gallows on February 9, 2013 for his role in the December 12, 2001 Fidayeen attack on the Indian parliament in New Delhi which killed 12 people. However, to the surprise of many Western diplomats in Islamabad, AJK Prime Minister Chaudhry Abdul Majeed has condemned Gurus hanging, saying, The Indian government action proves that India was not sincere in maintaining peace in the region. I express my sympathies and solidarity with the people of Jammu and Kashmir in general and Gurus family members in particular. We stand by them.
The PMs condemnation was followed by an official announcement by the AJK government spokesman, Shaukat Javed Mir: The AJK government declares three-day mourning over the unjust hanging of Afzal Guru. The AJK flag would fly half mast for three days and all official functions have been suspended.
A Western envoy in Islamabad said while requesting anonymity that many diplomats of the Western nations believe that the AJK government has overreacted needlessly on the hanging of an Indian national by condemning an execution which was carried out on the orders of Indian Supreme Court. He reminded that in a sharp contrast to Gurus hanging, the Pakistani foreign office had reacted differently after the hanging of Ajmal Kasab, who was a Pakistani national, by stating that Islamabads position on terrorism was very clear and consistent and it always condemned terrorism in all its forms and expressions. He reminded that Pakistani foreign office had even expressed willingness following Kasabs hanging to cooperate and work closely with all countries of region to eliminate the scourge of terrorism.
In fact, Pakistan had refused to accept Kasabs body from India following his execution, saying he was a non-state actor involved in terrorism. No mourning was observed by the AJK government after Kasab was sent to the gallows, although he was a Pakistani national unlike Guru. Justifying Gurus hanging, another Western diplomat in the federal capital reminded that phone calls made by the Fidayeen attackers belonging to the Jaish on Gurus mobile phone minutes before attacking the parliament building, coupled with the laptop recovered from his custody which was used by the attackers, had proved beyond any iota of doubt that he had played an active part in the ambush.
The Indian Supreme Courts August 2005 judgment in the parliament attack had clearly stated: The transcripts of the phone calls made to Afzal Guru by one of the terrorists [Mohammad] at 10:43 AM, 11:00 AM and 11:25 AM established that he had told Afzal Guru that he and his accomplices were going to execute the attack plan. The Supreme Court bench took into consideration that Guru was instrumental in providing hideout and accommodation to the terrorists at Gandhi Vihar and Indira Vihar in north Delhi, and played a key role in arranging the logistics such as the purchase of chemicals used for preparing the explosives.
Following his arrest, Guru had confessed his involvement in the parliament attack and also identified the bodies of five terrorists, Mohammad, Haider, Hamza, Rana and Raja, who were killed during the gun battle with the security inside the Parliament complex. The court had noted in its verdict that the evidence had established that Guru was in contact with the terrorists and three other accused - SAR Geelani, the Delhi University College lecturer, his cousin Shaukat Hussain Guru, and his wife, Afshan Tabassum aka Navjot Sandhu.
Afzal Guru may have escaped conviction had he not been found with the laptop, which the terrorists used till December 12, 2001 to store minutest details of their activities till a day prior to the attack on Parliament. The apex court had recorded in its judgment. We hold that the laptop found in custody of Afzal Guru and the results of analysis thereof would amply demonstrate that the laptop was the one used by the deceased terrorists contemporaneous to the date of incident and it should have passed hands on the day of the incident or the previous day.
After weighing the evidence produced by Delhi Police, the Supreme Court had ruled: It has been clearly established that Guru was associated with the deceased terrorists in almost every act done by them to achieve the objective of attacking Parliament House. The court had found Guru to be a close associate of Mohammad, the leader of the JeMs fidayeen squad which had stormed the Parliament building to take hostage the Indian political leadership.
The circumstances cumulatively considered and weighed, would unerringly point to the collaboration of the accused Afzal Guru with the slain terrorists. The circumstances, if considered together, as it ought to be, establish beyond reasonable doubt that Guru was a party to the conspiracy and had played an active part in various acts done in furtherance of the conspiracy. The collective conscience of the society would be satisfied if Guru was given death penalty for participating in the conspiracy of a terrorist act of gravest severity to attack the Parliament, an apex court bench comprising Justice P.V Reddi and Justice P.P Naolekar said in its verdict 13 years ago while awarding capital punishment to Guru on two counts.
