I have mixed feelings about the current scenario in Pakistan. I support that Courts and Adliya should be completely independent and the curse that we have had thru Justice Munir's decision in Maulvi Tamizuddin case against the wrongful dissolution Assembly by the civilian Gov General Ghulam Mohammad is finally lifted. Independent Judiciary is the only guarantee of justice to man on the street even though it may be long time coming. This can only be a good thing for Pakistan in every way.
However at the same time, I dread the chaos that would follow. Lets speculate as to what happens if CJ is reinstated.
Musharraf loses all his credibility and is forced to step down in disgrace. Who takes over??. Elections havenot yet taken place; no single political party can therefore claim people's mandate. ML ( Q) have finished their tenure and need a new mandate to remain in power. If another Army Strongman takes over, what guarantee is there that he will step down and we wont have go thru the same process all over again??
If on the other hand, CJ loses his case.
The situation will get worse and surely a chaos will follow as all political parties will claim that justice has been denied. People will take to the streets and if elections are then postponed, we would see the same result as in case one above. What this movement has done is that whether CJ is guilty of misuse of power or not is immaterial. Political parties want Mushy out and to hell with the consequences.
Regrettably, Mushy has over played his hand and there appears to be no peaceful solution in sight. Among the political parties, PPP is the most likely party to gain majority in the forthcoming election. ( It is the largest single party even now) and would be the greatest loser if for whatever reason elections are delayed. BB probably senses this and therefore is reluctant to give full support to the APC. Besides, MMA and PPP are diagonally opposite in their political thinking.
NS is hoping that if he is back as a result of this mayhem, ML(Q) leaders will desert the Chaudhries and rejoin ML ( N). Together ML is a force strong enough to take on PPP in Punjab and Sindh and result of these two provinces will decide as to who forms the govt. Beside NS would have support of the MMA as well. NS also being creation of Zia, must have had some support in the Army. What I am surprised that why PPP think tank is not foreseeing the events in this light and allowing this movement focussing on CJ to cool down.
Adliya ki Aaazadi is definitely a good thing but will this movement deliver it to us?? To me it looks that even if CJ really is guilty, lawyer community is not going to accept a decision against CJ. Where is the Adliya ki AAzadi then?? Isn't the preconceived notion that CJ is innocent excludes freedom of action by the Supreme Court in case the full bench concludes that CJ was wrong. Catch 22 ???
However, I sincerely hope that there is a third scenario which my lowly mind is unable to foresee and Pakistan economy comes out of this mess with minor bruises only.Elections are held and transfer of power to the civilians takes place smoothly.
Finally, I appologize that I am repeating the arguments in different posts in various threads. IMO situation in Pakistan is quite grim and I have no other arguments to reinforce my point of view.
