GUJRAT: A local court here on Saturday handed one-year imprisonment and Rs100,000 fine each to three grooms for contracting second marriage without obtaining permission from their first wives, ARY News reported.

The men who were awarded prison terms were identified as Idrees, Altaf, and Tariq.

Meanwhile, the court sentenced another suspect, Muhammad Malik, to three years of imprisonment in a case pertaining to attempted murder.


Earlier, on July 15, a local court had handed jail term and fine to a man over contracting second marriage without permission from his first wife.

The court of Judicial Magistrate Amanullah Bhatti heard a petition filed by Ms. Shamim, against second marriage of her husband Rashid.

Petitioner pleaded to the court that her spouse Rashid contracted second marriage without her knowledge and permission, while according to the law a husband must get permission from first wife before the second marriage.

“He not only betrayed me, but also violated the law of the land,” the petitioner said seeking legal action against her husband.

It is pertinent to mention here that recently the Islamabad High Court (IHC) in a landmark verdict ruled that a person intending to contract second marriage will have to seek mandatory approval of the Arbitration Council for the purpose.

An IHC bench gave this ruling on a petition filed by a woman who challenged a sessions court’s verdict that had exonerated her husband from the charge of solemnizing second marriage without her permission.

The bench held that the Arbitration Council’s permission is mandatory even if existing wife or wives permit a man to contract another marriage.

“Contracting second marriage without the council’s consent will be a punishable act,” it ruled.

A sessions court had acquitted the petitioner’s husband, named Liaqat Ali in a case pertaining to contracting second marriage without permission of first wife, which is mandatory under section 6 of the Muslim Family Law Ordinance 1961.

despite the criminal charge and the criminal case & punishment, the 2nd marriage cannot be nullified or invalidated. So what happens after the prison sentence is over? He is going to divorce his 1st wife for putting him in jail? any thoughts?

The man will have a very clear mind, when he will be out after serving his term.
First wife anyway deserves a divorce, in this case.

If the first wife has a problem then she should get a divorce, not throw the husband in Jail, but our logic, 2nd marriage is cruel and leads you to jail but having extramarital relation with other women whilst married is fine.

This is similar to moving the marriage age to 16 or 18 years, because if a girl has turned in to a woman she is allowed to get married, but the law we are creating favours extramarital relations but making marriage look like evil.

Force marriages should be banned and life sentences should be given to those who do it.

What the...

I believe in taking 1st wife into confidence about the possibility of 2nd marriage before proceeding towards the latter, but I find these punishments excessive. Pakistani courts barely punish criminals but they have a problem with 2nd marriages. :rolleyes:

And what the hell is this Arbitration Council?

And which law is that? And is it applied to all citizens (Muslims, Christians etc) including all schools of muslims of Pakistan?

From what I know - the only way this is possible is if they (3 grooms) had some agreement written and agreed - with their first wives on their marriage contract (nikah namah) regarding 2nd marriage.

And what the hell is this Arbitration Council?

Probably another "biddah" in Islam? :D
