New Indonesian law: No sex outside marriage, no abortion, no Marxism

Indonesia’s Parliament unanimously passed a long-expected revision of the country’s penal code on Tuesday that criminalizes sex outside of marriage for citizens as well as foreigners, prohibits promotion of contraception, forbids progressive political thought, and bans defamation of the president and state institutions.

The amended code also expands an existing blasphemy law and maintains a five-year prison term for deviations from the central tenets of Indonesia’s six recognized religions: Islam, Protestantism, Catholicism, Hinduism, Buddhism and Confucianism.

Citizens can face a 10-year prison term for associating with organizations that follow Marxist-Leninist ideology and a four-year sentence for spreading communism. Anti-communism has long been a tenet of the Indonesian state.

In 1965-66, the Indonesian government headed by military dictator Suharto undertook a mass purge of communists, progressives, and trade unionists, as well as ethnic Javanese, ethnic Chinese, and atheists. Up to a million people were murdered, and the Communist Party of Indonesia—one of the largest in the world—was totally annihilated.

The intelligence agencies of the United States, United Kingdom, and Australia participated in collecting the lists of those who were targeted by the Indonesian military.

The new criminal code maintains the previous criminalization of abortion but adds exceptions for women with life-threatening medical conditions and for rape, provided that the fetus is less than 12 weeks old, in line with what is already provided in a 2004 Medical Practice Law.

Rights groups criticized some of the revisions as overly broad or vague and warned that adding them to the code penalizes normal activities and threatens freedom of expression and privacy rights.

Some advocates found one bright spot for the country’s LGBTQ community in the whole affair. During fierce deliberation, lawmakers eventually agreed to remove an article proposed by Islamic groups that would have made gay sex illegal.

The revised code also preserves the death penalty within the criminal justice system despite calls from the National Commission on Human Rights and other groups to abolish capital punishment, as dozens of other countries have done. But under the new code, the death penalty has a probationary period. If within a period of 10 years the convict behaves well, then the death penalty will be changed to life imprisonment or 20 years’ imprisonment.

Under Indonesian regulations, legislation passed by Parliament becomes law after being signed by the president. But even without the president’s signature, it automatically takes effect after 30 days unless the president issues a regulation to cancel it.

President Joko Widodo is widely expected to sign the revised code in light of its extended approval process in Parliament. But the law is likely to gradually take effect over a period of up to three years, according to Deputy Minister of Law and Human Rights Edward Hiariej.

“A lot of implementing regulations must be worked out, so it’s impossible in one year,” he said.

The amended code says sex outside marriage is punishable by a year in jail and cohabitation by six months, but adultery charges must be based on police reports lodged by a spouse, parents, or children.

It restores a ban on insulting a sitting president or vice president, state institutions, and the national ideology. Insults to a sitting president must be reported by the president and can lead to up to three years in jail.

Hiariej said the government provided “the strictest possible explanation that distinguishes between insults and criticism.”

The penal code had languished for decades while legislators in the world’s biggest Muslim-majority nation struggled with how to adapt its traditional culture and norms to the code, a legacy of the Dutch colonial administration. Indonesia proclaimed independence on Aug. 17, 1945.

A previous revised code was poised for passage in 2019, but Widodo urged lawmakers to delay a vote amid mounting public criticism that led to nationwide protests in which tens of thousands of people participated. Opponents said it contained articles that discriminated against minorities and that the legislative process lacked transparency.

Human Rights Watch said Tuesday that laws penalizing criticism of public leaders are contrary to international law, and the fact that some forms of expression are considered insulting is not sufficient to justify restrictions or penalties.

“The danger of oppressive laws is not that they’ll be broadly applied, it’s that they provide avenue for selective enforcement,” said Andreas Harsono, a senior Indonesia researcher at the group.

Many hotels, including in tourism areas such as Bali and metropolitan Jakarta, will risk losing visitors, he added.

“These laws let police extort bribes, let officials jail political foes, for instance, with the blasphemy law,” Harsono said.

So basically we can have sex outside marriage as long as it's not to be reported by spouse, parents, or children??

To be honest, this law is not effective, it's a big hole!

I feel like it's nothing happening, because in the past that is what happened, and it's not able to stop free sex culture at all.
 
No Marxism is a joke. I guess Indonesian elites are wary that once people studied Marxism, they will be sent to guillotine.

There is already law about prostitution and p0rn as crime.

This law is another level. Remember law can be change in the future. Being able to make our own criminal law is already a huge breakthrough.

As I see the society is getting more conservative and the law will likely follow it. First only prostitution that is criminalized. Then during SBY administration there is anti p0rn law being introduced. Then during Jokowi period gov and parliament make all out side married as outlaw.

See the trend.....

Indonesia is much much lower in term of free sex culture. In here seeing baby born as result of free sex is much much smaller than Western countries

Nothing new. Muslim countries always vacillate between secular and Islamic ideologies. At first they want pure Islamic society. After reality hits them hard, they have to turn to secular to settle all social problems. After problems are about to be solved, Islamic ideology rises again. We see people in Islamic countries ask for secular(Iran, Afghanistan, Saudi) and people in secular countries ask for Islamic laws( Turkey, Indonesia).

This vacillation will haunt Muslim countries forever. And It will hurt Muslim countries forever.
 
Marxism strives for human emanicipation. All Marxists countries today have respectable living and in next 30 years time, China likely top world in technologies and material wealth being. China would also likely be country having freeist speech and best human rights in our life time,

It is really unlucky for Marxism that the first Socialism country was built by Russians. Who ruined Marxism's reputation.

I have quite a different opinion. Russia is a precursor for China to do it right. Marxism is just mind masturbation without Leninism.

Lenin taught China to implement Marxism, one must purge the party cadre, purge the army never mind how ruthless the process is.

Next USSR taught China that how internal decay can destroy the nation and also how not to listen to white man mantra of democracy and free market.

USSR basically make all the mistake, so that China can avoid making the same mistake.
 
Why marxism ? And abortion is right of female gov can get pregnent if she want more babies .stupid laws

I mean if it was France or Germany that established the first socialism country, Marxism would have a better position than today. Russians' culture was heavily influenced by Mongolians. It was very ruthless and backward. It is not suitable for building modern economy.

People's bad impressions of Socialism mostly can be attributed to Russian culture. Instead of Socialism itself

If I am not mistaken Harvard Economics Faculty also learn Marxism. I learn Economics from Harvard published economics book in Indonesia translated book. If I am not mistaken there is section about Marxism economics there. Any way any economics book will show the difference between market based economy and its opposite system. In essence we will learn of why market based system is the best way to allocate resources. Any Economics and Socials university students in Indonesia will learn marxism as part of study

Marxism in essence is quite simple despite Das Capital (book) is so thick.

If I am not mistaken Harvard Economics Faculty also learn Marxism. I learn Economics from Harvard published economics book in Indonesia translated book. If I am not mistaken there is section about Marxism economics there. Any way any economics book will show the difference between market based economy and its opposite system. In essence we will learn of why market based system is the best way to allocate resources. Any Economics and Socials university students in Indonesia will learn marxism as part of study

The market economy has internal contradiction deliberately not emphasized or not taught. It will lead to concentration of wealth. Bosses will get bankrupt if they produce $100 and pay $1 to their workers. No one buy the goods.

Which is why world government and people are always being put in debt -- a temporary fix by pseudo marxist John Keynes.

When people as Keynes how is long term plan, Keynes said, In the long term we are all dead.

Dividend for any business entity is much much smaller compared the cost to pay workers salary, cost for raw material or intermediate goods to be processed, and other cost. It is like pyramid, the dividend for owner is on top relative to other costs like workers salary and others, much much smaller.

Korea that has really concentration based economic system with their Chaebols follows perfectly trickle-down effect theory in economics. It shows even this system can indeed bring economics prosperity despite personally I dont like the system.

Any way we have government as well to set regulation. There is minimum wage and other obligation that must be followed by any business owners like paying all of workers health insurance every month. We have set up anti-monopoly body as well here. Democracy system will push workers right even better compared to authoritarian system.

Personally I dont bluntly believe with Western economy that mostly very liberal.

Indonesia follow mix based economic system where government can have large SOE, similar like China current economics system. Indonesian SOE assets is half of Indonesian GDP and our economy is dominated by small and micro business that contribute around 60 percent of GDP every year. This shows our economic system is pretty mix and not as liberal as Western economic system that adore liberal economic system.
