What's new

Haji Ali Dargah ruling is path-breaking as court relied on Constitution, not Quran or Hadiths

Its not state interfearing.

People went to court and court gave the order based on the Indian constitution not on religious books..it dsnt differentiate if its hindu or muslim or others....earlier courts have given similar orders against hindu places of worship as well..
Interestingly religious book in this case doesn't deal with the antics people pull at shrines and all that. Most people at Shrines even do Shirk and Bidaat's which are not allowed in Islam. Moreover its not surprising how non-Muslims are trying to claim superiority over Muslims holy book, even thou it has nothing to do with this. One wonders, No?

It can be dangerous. This ruling. Muslim men may treat this as an interference in their religion.

Which Islamic text bans women from Dargahs btw ?

^^^ Actually the mullah brigade of this trust did banned women from worshiping in the dargah in the name of Quran & Hadith, and in recent times there are many protest carried out in India by women rights activist against the ban of women from temples and dargah. As Hindu & Sikhs also visit Haji Ali, thats why this ban was challenged in court against the Human Right & right to worship violation.

@Djinn
And if the ruling authority had bothered to refer to actual Islamic injunctions related to the matter at hand it would have realized the facts. Rather the focus is on claiming a hypothetical victory over Quran.

Sufis are not really true Muslims. They make fool of Muslims and even non Muslims.

Islam is only qurand and Hadith. Sufis are shirk committing people. Be very careful. They are dangerous.

Exactly what kind of dangerous situation these fellows can create for us? Please free to mention.

Ok in Islam it is written in religious text and also there is a jurispendece and practice of 1000 years that woman are given half the share in inheritance than men.

Even I guess the Muslim personal law code also has this. If some agitated Muslim woman feels jealous of non Muslim woman about not receiving equal share of the wealth, and if knocked the doors of the court, what would court do?

Disregard 1000 years of Allahs laws and just spit them in the dustbin or respect them and let them conintue without interfering?

Disregard any law which interferes with the constitution of India. If anyone wants to follow Allah's law they are free to go to any country where Allahs law is the law of the land

Some of the excuses given by resident Islamists are hilarious. Apparently the ban is 'cause when women bend to pay respect, one can see their bosom! Hence it's necessary to ban woman from entering the sanctum sanctorum!

Funny as it may be, its true.

That is the same reason why they are not allowed in the mosque. Guess what position they have to take when its time for namaaz. ..... its "double jeopardy" for the faithfuls.

Care to tell me where it says Muslim women are not allowed into mosques? Women are without question allowed in mosques, but they pray in a separate section or floor.

My wife attends Eid prayers at the mosque.

What we have in the subcontinent is a tradition of women NOT going to the mosque.

Then what is the promise of the Constitution to every Indian citizen that it is secular?

Meaning of Secular - True one not congressi one " Religion has no role in the govt's laws" No reigions laws are over and above the constitution. You are free to follow your religion privately but the laws of the land will be supreme over religious laws

Then it's a sad excuse. Maybe they need some special attire while praying...or some sort of body armour which would stop anything from piercing through, whether a naked eye,,or naked something else!

But what about state and religion are separate and state (including judiciary) will not interfere in religious laws.

Indian secularism is a sham.
