The Board was looking at establishing grounds for his release, not his detention.
You didn't get my point. He was arrested 16 years ago and he wasn't even charged then. This case seems a like a case where they (US) made a poor judgement and threw the guy into detention otherwise they would have charged him with something like they did with Afia Siddiqui.

And that list does not include what the Saudi government did inside its own jurisdiction after 9/11.

Lets talk about WHY this man had to be released because US on the onset of failed "War on Terror" have their terror threat assessment to such a high level that "suspicion" equated to "conviction" which is really does not provide you any significance results in combating and conquering the "heart and minds" of the subject populace (i.e. in this case Afghanis and Pakistanis).

Statement taken in Gitmo... plausible very plausible. They didn't do it to Afia or the others who were given sentence but somehow in this case they didn't bother to charge him and then released after 16 years And no one can question it.

I mean who is going to question USA. They can bomb a country on suspicion of WMDs and then blame faulty intelligence on others while UN says the carnage in Iraq reminds of Halagu Khan siege of Baghdad.

Correct. No one give him back 16 years of his life and no one is bringing back those who died for the much touted WMDs.
