The Supreme Court on Wednesday slammed Mumbai Police for restraining three Uganda nationals, including a parliamentarian, from leaving the country and directed it to immediately release their passports which were seized on a complaint filed on behalf of Videocon group.

A bench of justices AK Patnaik and Ranjan Gogoi said such actions on part of some police officers bring a bad name to the country and directed that the foreign nationals be allowed to leave for their country.

"The Mumbai police, instead of protecting the Uganda nationals, has filed an FIR which is baseless. The country gets a bad name because of acts of few officers. It is very unfortunate," the bench said.

The court passed the order on a plea filed by the three Uganda nationals, including Issac Insanga Musumba who claims to be senior advisor to the President of Uganda, alleging that police officials were harassing them on the instructions of Videocon Group.

The foreign nationals had arrived in Mumbai on April 17 to sort out disputes with the Videocon Group related to mines lease awarded to the company in Uganda.

Two days thereafter, a complaint was filed against them on behalf of the group and police restrained them from leaving the country and impounded their passports. They then approached the Supreme Court.

Granting relief to them, the apex court said their right to liberty could not be restrained by police due to a business dispute and directed police to return their passports.

I wonder how erring officers are punished? It obviously does not seem a deterrent.

Only slamming is not solution court should give strict punishment to guilty cops.

The three ugandan nationals demanded bribes from the Videocon officials and threatened them with arrest and so they filed a complaint...how can the cops be guilty if a complaint has been lodged against them and hence their passports were impounded as it is the usual thing to do for an under trail....for once I can't believe that the cops are guilty here....the SC should have waited for the outcome of the case and then should have asked the cops to return their passports as it is evident they will not be returning to India to stand trial...if ever the case of Videocon stands in a court of law

The bribery part I could agree with you but ho can they threaten officials for arrest in their own country.

I dont think that is the full story. The Mumbai police also took bribe from these Ugandan nationals to let them flee the country.

On April 19, the MRA Marg police questioned Musumba, Mawanda and Magoola for trying to extort $20 million (or Rs 108 crore) from four senior officials of Videocon Industries. The accused were picked up from Trident hotel in the Indian commercial hub of Mumbai and face charges of extortion, criminal conspiracy and criminal trespass under the Indian Penal Code.

Though the First Information Report (FIR) was filed, police have not yet taken any action against the trio, reported the publication. According to Mid-Day, the Deputy Commissioner of Police (DCP) Shisve had tasked the suspended officers to keep watch of the three.

But the trio still managed to leave Mumbai for the Indian capital in New Delhi and filed a special leave petition in the Supreme court there, alleging that their detention was illegal. The Supreme court in New Delhi then asked the Mumbai police to file a reply in the matter, claims the publication.
