New York family left homeless after police rip down walls to serve DWI warrant

DANBY, NY — A family has been left homeless after law enforcement agencies destroyed their entire house in the process of serving a warrant for a man for driving while intoxicated.

The home of David and Melissa Cady was condemned after armored police vehicles plowed through several walls while attempting to get 36-year-old Mr. Cady to surrender. A bench warrant had been issued after Mr. Cady missed a court appearance August 26, 2014, regarding his DWI conviction. On December 30th, 2014, a SWAT team moved in to make the arrest.

With the home at 127 Hornbrook Road surrounded, Melissa and the two children peacefully exited upon request. But David Cady did not, and police spent extensive resources to perform a lengthy standoff, resulting in his death.

“I’ve known him for like 12 years,” said friend and neighbor Dave McCarthy to the Ithaca Journal. “He’s been a good neighbor, he’s got a wife, two nice kids, a dog.”

Police cordoned off roughly 20 other homes while besieging the Cady residence. Neighbors were not allowed to return after leaving their homes on the 1.7-mile stretch of restricted roadway.

Police suspected Mr. Cady was armed. On the evening of December 30th, police say that a single shot was fired. It was the only shot of the entire standoff.

After this shot, Mr. Cady stopped communicating with police. Police proceeded to break down the walls to with armored vehicles to “restrict his movement,” and shot teargas into the house until 61 hours had passed, when they finally realized their suspect had died from an apparent self-inflicted gunshot wound.

Soon after, Danby Code Enforcement declared the home to be unlivable and condemned the property.

Resident Kory Watkins uploaded a video (below) of the the Cady’s former house, which now features gaping holes and mounds of debris scattered across the yard.

Watkins captioned the video: “All for a warrant. A violation of Probation for a D.W.I. and it took over 150 officers from over 18 agencies and military vehicles with more than 50 bombs of tear gas to end this like this…UNNECESSARY!

To “defuse” a situation involving a delusional man who had locked himself in a bathroom with a knife, police kicked in the door, screamed obscenities, tased him several times, and finally shot him to death. The horrifying scene was captured through a hidden camera set up by family members who were distrustful of police.

An event that should have been happy and memorable turned into violence and chaos when the Galveston Police got involved. A couple had just exchanged their vows and were celebrating with friends and family at the San Luis Hotel.

Everything was fine until an off-duty police officer thought that he had witnessed the bride’s brother, Daniel “Cole” O’Balle, 19, walking outside with an alcoholic beverage in his hand. Suspecting an under-aged adult had consumed a beverage without government permission, and violated the “open container” prohibition law, he phoned the police department for backup.

“I never thought I would have to go into a room and pray for my brothers life within hours of getting married.”
Police officers arrived to confront Mr. O’Balle. Joe and Shannon Belluomini, guests of the wedding party, witnessed the altercation and said that O’Balle was complying with security. Nonetheless, “out of nowhere, mayhem started,” explained Joe Belluomini to KTRK.

A total of 34 officers stormed the scene, prepped to handle what was described as a “riot.” Witnesses said the officers swarmed into the bar swearing at patrons and beating, pepper spraying, and tasering people without provocation.

Gil O’Balle, the father of the bride, saw that the police had split his son’s skull open and was attacked himself just for asking what had happened. Gil was then tased, pepper sprayed, and arrested

“I never thought I would have to go into a room and pray for my brothers life within hours of getting married,” said the bride, Amanda Lankford to KTRK.

Ronald B. Jones, age 62, was walking down the street on December 18, 2009, when his life was changed forever as he was singled out by a ruthless predator employed by the Dallas Police Department.

DPD Officer Matthew Antkowiak was supposed to be in the area looking for two white males who were fighting. Instead he saw Mr. Jones, a black male who was doing nothing wrong and did not match either suspects’ description.

Officer Antkowiak begins the encounter by ordering Mr. Jones to the front of his police cruiser. Jones complies and places his hands on the hood. For no apparent reason, Antkowiak began to place Jones in handcuffs. When the officer aggressively wrenched Mr. Jones’ arms behind his back, he spun around, as if to try and understand the cause for the arrest.

Officer Antkowiak escalated the violence by slamming Jones backward onto the hood and placing him in a chokehold. The unhinged officer had placed a hand around his victim’s neck.

As the struggle continued, the pair tumbled off of the hood onto the concrete street. Soon after, more officers arrived and began to repeatedly kick the 62-year-old man.

OAKLAND, CA — After years of suffering due to brain and neck injuries caused by the aggression of Oakland police, a man has finally received compensation in a settlement with the city. The violent officers, however, have never faced justice in any meaningful way.

The incident dates back to October 25th, 2011. Citizens were protesting the perceived injustices in their government in what was called an Occupy Oakland rally, which involved day-and-night occupation of the public square. Cops clad in riot gear had fenced them off and surrounded the rally armed with rubber bullets, teargas grenades, and a variety of other weapons they were sanctioned to use at will on the American people.

Scott Olsen went through a long and arduous hospitalization and recovery period after initially being admitted in critical condition. His injuries included a fractured skull, broken neck vertebrae, and brain swelling.

Olsen injuries are still being treated and he may never fully recover. He later made the following statements to the SFGate:

“I guess I thought that I wasn’t in Iraq anymore, you know, I’d be more or less safe. I wasn’t going to get shot. I wasn’t going to be attacked. Oakland police proved me wrong in that, and it makes me feel less safe in general, especially around people who are supposed to be protecting you.”

NEW YORK CITY, NY — A Staten Island family barbecue turned into a nightmare when it was interrupted by police investigating the improper use of a parking cone to save a parking spot on the street. What resulted was a day the family will never forget, as their home was invaded without a warrant, several family members were bludgeoned, and a NYPD officer sadistically stomped on a pet parakeet that lay helpless on the floor.

According to police reports, 14-year-old Joseph “Joey” Williams and his cousin, 19-year-old Jordan Gibson, were arrested after being accused of shoplifting $31.93 worth of merchandise from a local Walmart. Following a car chase involving the police and Gibson’s F-150, the vehicle was ultimately trapped in a construction zone and the two unarmed teens were taken into custody.

Bucks County District Attorney David Heckler told reporters that Williams managed to escape the patrol car in which he was sitting while handcuffed and tried to make a run for it. One of the Tullytown officers initially gave chase on foot while ordering Williams to stop and warning him that he would use the Taser. Williams did not immediately comply, and, according to Heckler, “the officer fired his Taser to stop the boy from running handcuffed into busy afternoon Route 13 traffic, where construction barriers would have likely trapped him in the lanes of travel.”

(CNN)Two days before he died, Everett Palmer Jr. called his brother, Dwayne, to tell him he was on his way from Delaware to New York to visit him and their sick mother. But first, he said, he wanted to resolve an outstanding DUI warrant from an incident in 2016 in Pennsylvania to make sure his license was valid for the drive to see his family.

The phone call was the last time the family would hear from the 41-year-old US Army veteran and father of two.
On April 9, 2018, two days later, the family was told that Palmer had died in police custody at the York County Prison. Fourteen months later, the Palmers say they still don't know what really happened. But they are suspicious because when Palmer's body was returned to them, his throat, heart and brain were missing.
"This entire case smacks of a cover-up," civil rights attorney Lee Merritt told CNN by phone.

The family hired Merritt to help find answers because so far, they have been unable to get them on their own, they say. Merritt says prison and county officials have not been cooperative with providing an official manner of death.
Representatives for the prison could not be reached for comment Friday.
An initial autopsy by the York County Coroner's Office stated Palmer died after an incident "following an excited state" during which he "began hitting his head against the inside of his cell door" and was restrained. The report says Palmer became agitated as a result of "methamphetamine toxicity." A probable "sickling red cell disorder" as listed as a contributing factor.
According to his family, Palmer never had any health problems leading up to his death. They also say the autopsy report of him hitting himself are completely out of character.
The York County Coroner's Office updated its autopsy results on July 28, 2018, to include a manner of death, which it listed as "undetermined." The autopsy report says details of the autopsy may be corrected as more information becomes available.
The family says Palmer did have "some history of drug use," but never meth. Prison processing reports made available to the family provided no indication that Palmer was under the influence or had any drug paraphernalia listed in his items when he arrived.
"He would have had to receive (the meth) in the jail itself. We don't believe that happened," Merritt said.
Palmer's body was returned to his family, but it was only after the family hired their own independent forensic pathologist that they discovered Palmer's body was missing three body parts.
"It's not unusual to take organs out of a body during an autopsy, especially if you believe they were subject to trauma. The highly unusual part is to misplace them," Merritt said.
For seven months, the family could not track down Palmer's brain, heart or throat. They say they were told by the York County Coroner to check with the funeral home for the body parts.
"The funeral home says they hadn't touched the body," Merritt said.
The family says they were later told by the coroner that the body parts were at an independent lab. However, the lab, Merritt says, has refused to hand over the parts, citing an ongoing investigation.
Merritt says the family believes the body parts will reveal details of how Palmer died. "But we haven't been able to get them back yet," Merritt said. "His constitutional rights are being violated."
CNN reached out to the York County District Attorney's Office for comment. Kyle King, the chief administrator and spokesman for the district attorney, told CNN by phone, "The office of the district attorney does not comment on pending or ongoing investigations."
When asked how long an investigation into a case like this typically takes, King said, "Every investigation is unique." He did not answer when asked why, more than one year after Palmer's death, there is still no official determination about his cause of death.
Multiple calls to the Pennsylvania State Police, which is listed as the investigating police agency on the autopsy, were not returned. A voicemail message left with the York County Coroner's Office also went unanswered.
Of the five children in the Palmer family, Everett Palmer Jr. was like the glue that kept the family bond strong, his brother Dwayne said. He was a "gentle giant," tall and muscular, and served as a US Army paratrooper. An avid sports fan, especially of basketball, Palmer was often found working out in the gym or helping others achieve their goals as a personal trainer.

Palmer also enjoyed being a DJ and had a very "eclectic taste in music," preferring heavy metal, according to his brother, Dwayne. He may have looked imposing, his brother says, but he loved to smile.
"He joked around a lot. He was the life of the family," Dwayne Palmer said. "He wasn't a perfect person, but certainly not somebody that's a rabble-rouser, fighting, starting trouble or anything like that. He was a loving person."
Speaking from his home in New York, Dwayne says the family just wants to know what happened. He says the information they have been given so far is scant.
"We don't believe anything (officials) are telling us at this point," he said. "It's a tremendous loss for our family. We are devastated."
According to the autopsy report, on the morning of his death, Everett Palmer Jr. was taken to a medical clinic where he was noted to be unresponsive. He was transferred to York Hospital, where he was pronounced dead at 5:46 a.m.
"If he was being processed for something that he did wrong in terms of the DUI -- he should be held accountable for that -- but it shouldn't be a death sentence, certainly inside of a jail," his brother added. "We know that there are good people in that prison system. We appeal to them to come forward and share what they know."
The Palmer family has put in a Freedom of Information Act request for any video recordings from the York County Prison while Palmer was in their custody.
"It's been over a year and we want some answers. He was delivered back to us without organs. We want closure," Palmer said. "If something criminal happened, and I believe something criminal did happen, we want the people that was involved in that to be held accountable."

You should read Orwell as he popularized the term “Police state” in his books and China 70+ years later has pretty much implemented every example he put forward in his books back in the 1940’s. His books must be on the required reading list of the Chinese leadership.

He wanted to drive to see his sick mother, he told his brother and wanted to drive in the state.

Instead , he was killed in Prison. Police claimed he was under "Influence" of drugs and then stole his vital organs. Brain/Heart and Throat to hide evidence of what caused his death

The guy was a personal trainer meaning he did Gym and exercised daily and helped other

I've had my own bad experience with police officers.

If I, as a seemingly milquetoast law abiding South Asian medical student at the time had trouble with a police officer, I can't even imagine what others have to deal with.

It ultimately comes down to a he said she said type scenario.

Most of the time the cop gets the benefit of the doubt.

My point is its more than just some bad apples in the ranks of the police.

But York County Coroner Pam Gay said those organs were actually retained as part of the forensic autopsy for additional testing.

"There were never any missing organs," Gay told CNN on Saturday. "The lab that does our autopsies has the organs. Coroner's offices don't always have a morgue or a forensic pathologist. We contract those services out. We utilize a team in Allentown. That's who retains the specimens. They don't always tell us what they retain. We made that clear to the family from the beginning."

She noted that removing the throat is typical in this kind of investigation because "we have to make sure there wasn't any kind of component that caused asphyxia."
Gay also said local authorities have been cooperative.

"We were in communications with them directly and through their attorney," she said. "I understand their need and desire for answers. We are working to do that. The truth will come out. I can't comment on the active investigation."
