The main complainant in judges’ detention case against General (Retd) Pervez
Musharraf on Friday disassociated himself from the case. “I have decided not to pursue this case as I feel it is in the better interest of the country”,
said Advocate Chaudhry Aslam Ghuman in a hurried press conference on Friday night. The case is based on First Information Report (FIR) which was registered against
Musharraf on August 11, 2009 by the Secretariat police for detaining over 60 judges
including Chief Justice Iftikhar Muhammad Chaudhry. The case had been opened on Advocate Ghuman’s application, submitted at a local
police station. On Friday, Ghuman, accompanied by two friends failed to justify why he was
disassociating himself from the case, saying the country is facing through turmoil and
he feels he should not peruse the matter further. When asked by a reporter how exactly would the country benefit from this move,
Ghuman failed to reply.

The title of the thread is misleading. The case is not withdrawn. The plaintiff has announced he is not pursuing the case. There is a big difference between the two.

ISLAMABAD: In the judges’ detention case, the special anti-terrorism court (ATC) of Islamabad on Saturday extended the judicial remand of former military ruler Pervez Musharraf for 14 days, DawnNews reported.

Judge of ATC’s special court Kausar Abbas Zaidi heard the case.

During the hearing, the court was informed that Aamir Nadeem Tabish was appointed as the new public prosecutor of the said case.

Furthermore, Musharraf’s counsel Ilyas Siddiqui informed the court that Advocate Chaudhry Mohammad Aslam Ghumman, plaintiff of the case, had announced his decision to withdraw his petition but had not submitted a written notification to the court.

Subsequently, the court extended Musharraf’s judicial remand to 14 days and adjourned the hearing to June 1.

While talking to the media, the newly-appointed public prosecutor Tabish said that the announcement by the case’s plaintiff, Ghumman to withdraw the case is merely limited to the media.

Moreover, he said that the court shall take due action after it received an official notification from Advocate Ghumman in regard to his withdrawal of the case. He added that he had requested the court to give him time for preparing his defence.

Once a case has been filed, it has to completed or withdrawn by the proper process which takes time.

A sentence can come only after a verdict of guilty has been given, and it can implemented only after all appeals are exhausted, and not before.

Yes, if a sentence is overturned, quashed or pardoned by competent authority, the slate is wiped legally clean.

The law is but a tool for use by civil society.
 
I URGE American government and Supreme court to study and add Musharaf case in their constitution.

Musharaf case should be a precedent for all the courts including International Court.

First file the cases than withdraw them.
