Men don't do this..

Take the example of Reham Khan.. Her children don't want to see the face of their father, despite being supported by him financially all these years..

It happens in Pakistan quite often..

Actually, I didn't know till today that men and women are so different.. I mean I knew there were differences, but after reading some researches today, both the genders are quite different from head to toe..

Really? Forgive the personal question, but how old are you? Have you attended many family court proceedings?

I am referring to the simplified solution offered by some people on this thread that having a Mahram will mean cases of sexual exploitation will disappear.

Personally, I don't disagree with the Islamic system because I see the wisdom behind it. But I don't see why certain laws can not be expanded/amended depending on the circumstances. For example, when Hazrat Umar (ra) suspended the punishment of the chopping of hands due to famine etc, did the puritans of that time call him a kafir or innovator (nauzbillah)? It was a great case of using ijtehad and reviewing the circumstances of the society and then applying the law in its proper spirit after taking in to consideration what the state and the society could provide.

In the same manner, I do not see why the same cannot be applied for other sections, as long as the spirit is maintained with frugality. Having a guardian in early Islamic society was of paramount importance due to the nature of the conflict between the different parties. Abduction etc of woman was common part of it and I don't think any woman would have an issue if the same law was applied if the situation demanded it.

However, if a modern society and state can provide securities and certain guarantees, there is absolutely no need to have the exact same clauses as were prescribed in 7th Century Arabia. The issue is of lack of ijtehad in my opinon, I have no problem if Ulama sit down with experts from various different fields and say okay we can look at constructing an Islamic framework based on traditions from the Shariah but use Ijtehad at the same time. As long as the spirit of the law is upheld, i.e. prevention of extra martial relationships, exploitation etc. Does it really matter that a particular given law follows the exact same wording as that prescribed for a society centuries ago under completely different circumstances?
I agree with everything you said. Times have changed and technology affords us to be able to do certain things better. But the same technology is also being abused to further the cause of corruption too, like child **** and exploitation of women. Also false evidence can be concocted with computer softwares. The human element still remains the decisive one.

But most people are not learned scholars, let alone Sahaba like Hazrat Umar (RA), who could make these decisions with the wisdom on religious affairs that Allah SWTA bestowed on them. Of course, the average person can give their input, but final decision should only be made by learned scholars in light of Quran and Sunnah.

With regard to the Mahram sexual violence issue, yes, the problem does exist, but only in a society that perpetuates injustice and cruelty on the weak, regardless of gender.

Men do, not as much as the women.. Partly because men are mostly at a disadvantage in the divorce cases involving young children..

'Perhaps one day a judge will be bold enough to jail a mother and finally set an example.'

In all this there is only one real victim - the children. If one of those wives was handed an axe and ordered to hack off a limb of her child, she would be appalled. Yet so many women are happy, even gleeful, to commit the equivalent emotional amputation on their children by depriving them of their father.

U.S. author Kathleen Parker in her excellent book Save The Males points out that in depriving a child of their father, 'we reduce a child's chance of a successful and happy life.

They like that. That is why women go for "bad" boys who end up beating them, cheating on them and leaving them.

This is why in Islam a woman needs her Wali's permission to marry any man because she herself has bad judgement of men.

We have the scientific research on the brains of men and women available on the internet now.. so not difficult to realize the wisdom behind every Islamic concept.

Exactly. Though unfortunately even that is not enough for some people to stop pushing the BS of Feminism and gender "equality".

Women are at a disadvantage in the current era.. there is a lot that men should be made responsible for, but they are being forced not to work up to their real potential.. and women are being convinced to take the role of men and then suffer..

It's one of the most abused words. And it's a recent phenomenon too. Men and women were always considered different and not equal in all cultures and societies up till 50 years ago or so.

Indeed. Women are being forced to become men and vice versa. This has caused so many problems alone.

IMHO both men and women are at a disatvantage in this system when considering the long term interests of both genders and society at large.
