Pakistan court: Zardari corruption case 'must be reopened'

Pakistan's Supreme Court has ordered the government to request the Swiss authorities to reopen a corruption case against President Asif Ali Zardari.

The case is at the centre of contempt proceedings against Prime Minister Yousuf Raza Gilani, who is accused of failing to pursue the allegations.

The government has argued that Mr Zardari has presidential immunity. He says the case is politically motivated.

But the court has said a compliance report must be filed by 21 March.

The Supreme Court earlier adjourned a contempt hearing against the prime minister to 21 March as well, saying that Mr Gilani must either file a statement or testify personally that day.

Correspondents say that by ensuring that both cases are heard on the same day, the court has effectively narrowed the legal options of the prime minister.

Mr Gilani is being tried for contempt because he has refused to write a letter to the Swiss authorities despite a Supreme Court order which overturned an amnesty on corruption cases said to be politically motivated.

The BBC's M Ilyas Khan in Islamabad says Thursday's court order is likely to further heighten the tensions between the government and the judiciary.

Many in Pakistan wonder whether this is a power struggle between two state institutions or a battle to ensure the rule of law, our correspondent says.

Swiss 'laundering'

The prime minister, who has pleaded not guilty to the contempt charges, faces jail and being barred from office if convicted.

In explaining why he did not ask for the cases to be reopened, Mr Gilani has said it would have been unconstitutional to pursue them as the president has immunity as head of state.

In 2003 Mr Zardari and his late wife, Benazir Bhutto, were found guilty in absentia by a Swiss court of laundering millions of dollars in kickbacks from Swiss firms while they were in government.


They appealed and Swiss officials dropped the case in 2008 at the request of the government led by the Pakistan People's Party of Mr Zardari.

The case was one of thousands dropped under an amnesty agreed with then President Pervez Musharraf that allowed Ms Bhutto to return from self-imposed exile and run for election in 2008. She was assassinated shortly after returning.

However in 2009 Pakistan's Supreme Court declared the amnesty unconstitutional, leaving those covered by it open to prosecution.

Analysts say the court and the government are locked in a power struggle over who is the final arbiter of the rule of law.

Its clear for the whole world to see if this guy isnt brought to trial and locked up for his theft and looting of the Pakistani treasury - Pakistan will never be taken seriously. Let our judical system for once stand up and trial this moronic moron.!

reopen these cases when ppp's term is over. Then there is a slight chance that you can put zardari behind bars, otherwise there is noway you are getting to him.

That man (Zardari) bought the whole senate for saving his chair and that too for the coming tenure too... how can you throw him out of the office, that is only possible if a death angel comes in and take his soul away.

Same with our bozos in India too! There's almost half a trillion dollars stashed away in secret accounts abroad, from Switzerland to the Caymen Islands! Jeeez! This sucks and how! These buggers should be hung by their balls and their a$$es whipped!

He has created a web of deceit and deep rooted corruption - in fact so deep we would have to lock up half the senate and the "human shield" of dodgy people he has around him. To get to the heart of the corruptible core we have to simply remove the heart and Zardari - we all know - is that heart. Unless he is removed Pakistan will continue to suffer externally and internally.

Most of them dont have any dude. If it ever came out how much was hidden that belong to the state - i think we would all have dropped jaws..

what is pakistan is becomming a j/k country, the president which runs the country now sit on in UK (musf), the committed made by previous govt. which give pardon to present govt. is not under scanner n null and void. All the president who run the country either killed or find safe place aboard. what wrong is going on ....

that could be the case or the CJ is smart and playing politics if you get my drift :police:

CJ is playing politics, he doesn't want to lose his job. Unless we get a Supreme Court that has some courage, nothing will ever change in Pakistan.

hes playing smart to not give PPP any chance to say they weren't given full time, plus this will only help strength PTI

I am only waiting Supreme Court to call head of Military for the support to implement their verdict. Nothing can get these haram*aday to order otherwise. PPP is going openly against court and equally criminally PMLN is staying silent and unmoved on their defiance. Army must arrest them all and court-marshal them giving them maximum punishments possible.

I dont see that happening until Kayani is in office.
