No death penalty for rapists of Gujarat riot victim Bilkis Bano, says Bomaby High Court.

The Bombay High Court today upheld the conviction and life imprisonment of 12 people in the Bilkis Bano gang rape case while setting aside the acquittal of seven persons including policemen and doctors. The court also dismissed an appeal filed by CBI seeking death penalty for three of the convicts. The CBI had sought death penalty to the three convicts saying this was a "rarest of rare case".

"The appeal against conviction filed by the 11 convicts (one convict is dead) is dismissed. The conviction and sentence is upheld," a division bench of Justices V K Tahilramani and Mridula Bhatkar said.

"The appeal filed by the prosecution against the acquittal of seven persons (in the case) is allowed. The acquittal is set aside," the court said.

The bench said the seven persons, which includes five policemen and two doctors, are convicted under sections 218 (not performing their duties) and section 201 (tampering of evidence) of the Indian Penal Code (IPC).

"We will consider the undergone period in jail of these seven persons as their sentence. But we will impose a fine amount of them," the court said today.

The convicted policemen and doctors are - Narpat Singh, Idris Abdul Saiyed, Bikabhai Patel, Ramsingh Bhabhor, Sombhai Gori, Arun Kumar Prasad (doctor) and Sangeeta Kumar Prasad (doctor).

Now 18 people stand convicted in the case.

The court had last year reserved its judgement in the appeals filed by 11 persons convicted in the case and also the appeal filed by CBI for capital punishment to three of them.

A special court had on January 21, 2008 convicted and sentenced to life imprisonment 11 men for gangraping Bilkis and murdering seven of her family members in the aftermath of the Godhra riots.

The convicts later approached the high court here challenging their conviction and sought for the trial court's order to be quashed and set aside.

The CBI had also filed an appeal in the high court seeking harsher punishment of death for three of the convicted persons on the ground that they were the main perpetrators of the crime.

According to the prosecution, on March 3, 2002, Bilkis Bano's family was attacked by a mob at Randhikpur village near Ahmedabad during the post-Godhra riots and seven members of her family were killed.

Bilkis, who was five months pregnant at the time, was gang raped while six other members of her family managed to escape from the mob.

The trial in the case began in Ahmedabad. However, after Bilkis expressed apprehensions that witnesses could be harmed and CBI evidence tampered, Supreme Court transferred the case to Mumbai in August 2004.

The 11 convicted are Jaswantbhai Nai, Govindbhai Nai, Shailesh Bhatt, Radhesham Shah, Bipin Chandra Joshi, Kesarbhai Vohania, Pradeep Mordhiya, Bakabhai Vohania, Rajubhai Soni, Mitesh Bhatt and Ramesh Chandana.

The convicts had challenged the order on three main grounds -- that all evidence in the case was fabricated by CBI, that Bilkis gave birth to a child after the incident, thus, the same proved that she could not have been gang raped, and the failure to find the bodies of some of her family members proves that they were not killed.

The CBI had sought enhancement of punishment for three of them- Jaswantbhai, Govindbhai and Radhesham Shah— on the grounds that they had raped Bilkis.

It will be. I hate the fact that in India Death sentences are provided at the whims and fancies and according to the taste of judges who handle it. They should uphold the law. I remember an article that an previous SC Judge was hesitant to provide death sentences cos he was not comfortable with it. I mean WTH.

This case will be mostly overturned when appealed at SC. The current SC judges have a more assertive in giving harsh punishment according to the merits of the case.

@Soumitra Don't you think the b@stards convicted here should be killed instead of life sentence?

And where are the Bhakts and their outrage? I don't see many here compared to Nirbhaya's rape.

There is no provision for death penalty in case of rape or even a gang-rape, the maximum sentence that a judge can pronounce is life sentence which he did. Only in case of rape + murder a judge can issue a death sentence.

I have no problem in hanging them. They have been convicted by the court for the grusome crime of rape and they should be hung. No Double standards here.

BTW it is the CBI under the Modi govt which appealed for the death sentence. I am sure it will come up in the Supreme Court and it will take the correct decision

There is no provision for death penalty in case of rape or even a gang-rape, the maximum sentence that a judge can pronounce is life sentence which he did. Only in case of rape + murder a judge can issue a death sentence.
There was a gang rape and multiple murders. So this case does qualify for death penalty. An excerpt from an article for your reference

"In the Mumbai court, charges were filed against 19 men, including 6 police officers and a government doctor. In January 2008, 11 of them were sentenced to life imprisonment for gangrape and murder."

Yes so the death penalty can be given for the murders of family members and not for the gang-rape of bilkis bano.

Death sentences are given in rarest of rare cases, I guess learned judges don't find gangrapes during riots not so rare. And I wonder if these guys were given death sentences would NGO cabal who plea against death sentences would have appealed on their behalf to reduce their sentence?

Little pawns getting death penalty sets a bad precedence. The massacre's mastermind is now the PM - he will never let this happen.

That is mere technicality, since they have been sentenced for the entire incident and not just for gang rape.

They cannot be sentenced for the entire incident, they will have to be convicted under some section and death penalty can be then given, death penalty can be given for the below section only

Section 121 of Indian Penal Code, 1860: Waging War against the Government
Section 132 of Indian Penal Code, 1860: Abatement of Mutiny
Section 194 of Indian Penal Code, 1860: Giving or fabricating false evidence leading to procure one's conviction for capital offense.
Section 302 of Indian Penal Code, 1860: Murder
Section 305 of Indian Penal Code, 1860: Abetment of suicide by child or insane person
Section 307 of Indian Penal Code, 1860: Attempt to murder by a life convict, if hurt is caused
Section 396 of Indian Penal Code, 1860: Dacoity with murder
Section 364A of Indian Penal Code, 1860: Kidnapping for ransom

Yes if they would have been given death penalty, it would have been for gangrape + murder. But not for gangrape alone. For only gangrape of Bilkis Bano the maximum punishment could have been life imprisonment.
