Of the six accused in the 'Nirbhaya' gangrape case, he was reportedly the most brutal. Due to the liberal juvenile law in India, the 'juvenile rapist' was set to a reformatory for three years.
There, he reportedly befriended a Kashmiri youth involved in the Delhi High Court bombing in 2011 and got indoctrinated. Since then he has been under the watch of intelligence agencies. Now, top officials in the security establishment will review the status of counter radicalisation of the youth who has just turned 20. Ahead of his release, the intelligence agencies want to be sure that he has been completely de-radicalised.
Sources said he has already shown positive signs as all attempts are being made to make sure he gets back to the mainstream.
"We will review his case and a decision will be taken after analysing all aspects. If it is found that he is completely deradicalised, he will be released," said a government official.
Based on the suggestion of the Intelligence Bureau, he was earlier separated from the Kashmiri youth he befriended. The Intelligence Bureau is of the view that it needs to be examined how the rape convict and the Kashmiri youth were kept in the same cell. "Whether this was part of a larger conspiracy or accidental has to be probed," the MHA note says.
The brutal gangrape of the young woman who came to be referred as Nirbhaya, on December 16, 2012, created a national uproar and led the government to bring immediate changes to strengthen laws dealing with crimes against woman.
The rape convict and the Kashmiri youth shared the same cell for over a year. Arrested by the National Investigation Agency for his alleged role in the Delhi High Court blast, the Kashmiri youth is suspected to have indoctrinated the rape convict. "He (the rape convict) was initially lodged in the Juvenile Kingsway camp in December 2012. He was transferred to Juvenile Welfare Home located at Majnu Ka Tila without assigning any specific reason after 2-3 months. The Kashmiri youth was lodged there," the report by the Intelligence Bureau on the matter says.
IB, in its report, said taking advantage of his proximity to the rape convict the Kashmiri youth brainwashed him and motivated him to join jihad in Kashmir after his release from the juvenile welfare home. Intelligence officials probing the matter are also wary of the situation since the Nirbhaya rapist has said that he is scared to return home after completing his sentence and this could also be a reason for him to get swayed.
Sources said as per instructions of the union home ministry, the rape convict went through counseling sessions for counter radicalisation. Delhi Police Commissioner B S Bassi and Director, Intelligence Bureau, Dineshwar Sharma, will be sharing their recent assessment on the rape convict with the Home Ministry.
The matter was taken up by the government after BJP's Subramanian Swamy wrote to Prime Minister Narendra Modi in July this year saying that the rape convict has become a jihadi and an investigation to find out the truth must be carried out. Swamy had also said in the letter that there are enough provisions in Indian law to keep him under detention beyond the threeyear period if this was indeed true. "For the purpose of finding out the truth whether he has become a terrorist, a proper investigation should be done before he is set free. If true, the convict will be a menace to society," Swamy had written in his letter.
Following this, the Prime Minister's Office had informed the Ministry of Home Affairs (MHA) to look into the matter. The NIA claimed that the investigation of the Delhi High Court blast in which 15 people were killed and 79 wounded revealed that the juvenile Kashmiri convict was responsible for sending emails to media houses claiming responsibility.
In the Nirbhaya gang rape case, the other four adult accused were awarded death sentence for the gruesome act by the trial court. The Delhi High Court has upheld the death penalty and the matter is now pending in Supreme Court.
