Governor denies holding Saulat Mirza mercy appeal

The Governor House Sindh has denied holding the Saulat Mirza mercy appeal for four years (from 2004 to 2008) whereas documents show that the Governor Sindh had contacted senior legal and constitutional expert Barrister Akram Sheikh to seek legal opinion on assuming presidential powers to pardon Saulat Mirza back in June 2004.

In response to The News story titled Sindh Police depressed as Saulat Mirza still alive published on September 11, 2011, Governor House Sindh issued the following press release on Thursday:

A spokesman of the Sindh Governor House said that Saulat Mirza s mercy petition was not delayed in the Governor House. Clarifying the news item appearing in a section of the press under the heading Sindh Police depressed as Saulat Mirza still alive , the spokesman said that petition was received in the Governor House on April 7, 2008 and dispatched out on May 28, 2008. The delay of four years in the Governor House, mentioned in the news item is not correct, is baseless and misleading.

However, it is on record that the Governor of Sindh Ishrat-ul-Ebad sought legal opinion of the senior legal and constitutional expert Barrister Akram Sheikh on the question whether the governor can pardon or commute death sentence of a convicted person and held different meetings with Akram Sheikh in 2004.

A letter written by Barrister Akram Sheikh to Governor Sindh giving legal opinion on the question with the subject THE POWERS OF THE GOVERNOR/PROVINCIAL GOVERNMENT TO COMMUTE DEATH SENTENCES IN TERMS OF SECTION 401 AND 402 Cr.P.C. was dispatched from office of Barrister Akram Sheikh to Governor Sindh in June 2004.

The first paragraph of the covering letter reads: With reference to our meeting of yesterday at Governor House Karachi and to our similar earlier meetings on the subject noted above, I am enclosing herewith formally, our opinion on the powers of the Governor in relation to grant of remission and commutations of death sentence in cases which are dealt with and punished under Ta zir. Another paragraph of this June 2004 covering letter written by Barrister Akram Sheikh to Governor Sindh reads: I shall appreciate if you may kindly solicit similar opinion from the Advocate General Sindh, and the Attorney General of Pakistan. I shall waive the question of confidentiality of placing of our opinion before the aforesaid two gentlemen.

Malik Shahid Hamid, the then MD-KESC was killed along with his driver and bodyguard on July 5, 1997 in Defence Karachi. Saulat Mirza was arrested in December 1998 from Karachi Airport on his return from Bangkok. Saulat was found guilty of killing Malik Shahid Hamid by the anti terrorist court Karachi and was sentenced to death on May 24, 1999. The Sindh High Court and the Supreme Court (SC) dismissed Mirza s appeals against the death penalty on January 21, 2000, and September 14, 2001, respectively. The SC also rejected the review appeal on March 9, 2004. The mercy appeal has to be moved within seven days of the decision of the Supreme Court on the review petition.

According to top Sindh Police officials any person whose appeal and review petition in the Supreme Court are dismissed applies to the Superintendent Jail for mercy and this appeal is sent to provincial home department from where it is sent to provincial governor through the chief secretary.

The provincial governor sends this appeal to the federal Interior Ministry from where it is forwarded to the Presidency for a final decision of the president as per his constitutional power under article 45 of the Constitution.

The 2004 correspondence between Barrister Akram Sheikh and Governor Sindh Dr Ishrat-ul-Ebad shows that governor was in the picture of the mercy appeal.

Top Sindh police officials say that it is worth mentioning that Saulat Mirza s party Muttahida Qaumi Movement (MQM) was in power in 2004 in the centre as well as in Sindh and senior MQM leader Wasim Akhtar was Home Minister of Sindh. They say that it should be investigated as to why and how this mercy appeal remained in the province of Sindh for four years till 2008 and was only forwarded to the Presidency later.

It should also be investigated that even if proof is available against some criminal and courts award him punishment, how he escapes the long arm of law and why the superior courts judgments are being ridiculed.

It is also extremely important to mention that the mercy appeal of Saulat Mirza was forwarded to the Interior Ministry by the Governor House Sindh on May 28, 2008. It has not been forwarded to the Presidency so far even after passing of three more years.

Credible sources say that a powerful minister of the Gilani government was sitting on the appeal for some political considerations and is not forwarding it to the Presidency for smooth dispensation of justice.

Mrs Shehnaz Hamid, the widow of the Malik Shahid Hamid, while talking to The News said that she had moved appeals to the president, the prime minister and even the chief justice of Pakistan but no heed was paid to her requests and appeals for justice.

Senior legal and constitutional expert Barrister Akram Sheikh while talking to The News confirmed that Governor Sindh Ishratul Ebad had approached for legal opinion on the question of using of power of pardon by the provincial governor which I have given to him after one-month long research.

Akram Sheikh said he didn t recall what legal opinion exactly he had sent to governor of Sindh. He said that legal opinion sent to governor Sindh will be present in his offcice record.

MQM'ers is this evidence enough that MQM are killers? ex KESC murdered in broad day light .. the murderer apprehended and ALL courts have upheld the murder sentence. Must I remind you that back in the day Mirza made confession of this murder and also exposed MQM on how they target foreign nationals too in Karachi..

shame on you, if you still need proof of MQM's involvement .. open your eyes .. there are innocent people being murdered by your party .. and same people are being protected by your party leaders ...

Sindh Police depressed as Saulat Mirza still alive

ISLAMABAD: The government circles have drawn the attention of presidency towards the matter that the the mercy petition of Saulat Mirza, the convict of Karachi’s target killings, which remained pending for four years in the Governor’s House Sindh (2004 to 2008) is now gathering dust in the Interior Ministry since 2008 and not being sent to the Presidency.

Mirza is a convicted target killer who committed 58 murders after being released on parole in 2004. Sindh Police officials claim Mirza belongs to the Muttahida Quami Movement (MQM) and is the only person convicted for Karachi’s target killings and was arrested for the July 1997 killing of the then MD of KESC Malik Shahid Hamid when he returned from Bangkok at the Karachi airport in December 1998.

The record reveals that on May 24, 1999, Mirza was sentenced to death by an anti-terrorism court in Karachi after he was found guilty of murdering Hamid, his driver, Ashraf Brohi and guard Khan Akbar. The Sindh High Court and the Supreme Court (SC) dismissed Mirza’s appeals against the death penalty on January 21, 2000, and September 14, 2001, respectively.

The SC also rejected the review appeal on March 9, 2004. According to law, the government circles say, Mirza should have been executed after the disposal of his mercy petition. Number of methods were tried to get him off the hook including threatening heirs of Shahid Hamid to grant Saulat mercy under qisas in 2003.

Officials say that in 2004, the governor of Sindh even attempted to have the constitutional pardon powers of the president transferred to himself, so that he could grant mercy to Saulat. For four years, the file for Saulat’s mercy petition was delayed in the Governor’s house, whereas the legal time limit for the execution of a convict is seven days from the announcement of the final appeal.

Finally the file reached the Interior ministry in 2008, where it is gathering dust instead of being forwarded to the Presidency. Police officials say that such practices by the political governments are disheartening the police.

The police officials also reveal that Mirza was running the target killers networks from his jail cell and no one dared to stop him from any of his activity as a jail official Amanullah Niazi was shot dead in 2006 when he tried to interfere with Mirza’s activities.

Police officials even reveal that jail authorities ignore the strict warnings of the top intelligence agencies to check Mirza’s activities because of fear for their lives. Mirza was transferred to interior Sindh jail in July but was brought back to Karachi jail under political pressure.

On the other hand these top police officials reveal that notorious target killer Ajmal Pahari has allegedly committed 111 murders in different target killing incidents. Ajmal Pahari was released on parole along with his 45 companions in 2004 and police say all those released indulged in target killings again.

Haider Abbas Rizvi, however, in his Friday interview said that Ajmal Pahari was innocent and his innocence will be proved in a court of law. Pahari has revealed before the JIT that this was the party policy that “if arrested, you can reveal everything to avoid beating, because the party will deny it subsequently.” The police say that Pahari was wanted in 54 murders before he was paroled, and after his release, he committed 58 more killings.

So - as you can see all these b***ards are released by sitting MQM govt in 2004 .. this was what ZM was referring to when he said that if convicted murderers are released by someone (MQM) then obviously they won't mind murder more people for them ...

and look at the last para .. that moron haider rizvi .. saying they will obey court of law .. when clearly they are trying there best to save the murderer saulat mirza at same time .. also telling on what Ajmal Pahari is saying about party policy to reveal everything and party will deny it .. this is the DENIAL I have been talking about .. and some forumers are good at it too ..

Now - MQMer's . what say you? still deny? ...Shame on you if you do !! wake up
