A lawsuit filed in a US district court claims that US aid to Israel is illegal under a law passed in the 1970s that prohibits aid to nuclear powers that don’t sign the Nuclear Non-Proliferation Treaty.

Grant Smith, director of the Institute for Research: Middle Eastern Policy, who filed the lawsuit Monday with a Washington DC court, said the United States has given Israel an estimated $234 billion in foreign aid since Congress in 1976 passed the International Security Assistance and Arms Export Control Act, with its stipulation regarding countries that did not sign the NPT, according to Courthouse News

Discussing his August 8 lawsuit in an interview to Court House News, Smith said the litigation has been 10 years in the making.

Though Israel is not a signatory to the Nuclear Non-Proliferation Treaty, Smith noted that it is a known nuclear power and recipient of US aid. Israel has neither confirmed nor denied possession of nuclear weapons but is widely believed to possess dozens if not hundreds of nuclear warheads.

The US has had a long-standing policy of keeping mum on the existence of Israel’s nuclear weapons program, an open secret that successive US administrations since Gerald Ford’s have refused to publicly acknowledge.

Smith’s lawsuit comes on the eve of a deal that would boost US aid to the country by between $1 billion and $2 billion per year over a decade. Israel already gets $3 billion a year in US aid.

In addition to the United States and President Barack Obama, the complaint names as defendants Secretary of State John Kerry, CIA Director John Brennan, Defense Secretary Ash Carter, and the secretaries of the Treasury, Energy and Commerce Departments.

“Defendants have collectively engaged in a violation of administrative procedure and the Take Care Clause by unlawful failure to act upon facts long in their possession while prohibiting the release of official government information about Israel’s nuclear weapons program, particularly ongoing illicit transfers of nuclear weapons material and technology from the US to Israel,” the 33-page lawsuit states.

To sustain a policy of “nuclear ambiguity” on Israel’s weapons program, Smith says the government uses improper classification and threatens federal employees and researchers with prosecution, fines and imprisonment.

The gag is driven, according to the complaint, by a Department of Energy directive known as WNP-136, Foreign Nuclear Capabilities.

Smith says his digging under the Freedom of Information Act brought a version of the document to light that was “nearly 90 percent redacted.”

“This is an Energy Department directive that demands imprisonment for any federal official or contractor who even mentions that Israel might have a nuclear weapons program,” Smith said in an interview.

In the lawsuit, Smith says foreign aid to Israel violates two amendments of the 1961 Foreign Aid Act, known as the Symington and Glenn amendments, which ban aid to clandestine nuclear powers.

The CIA, White House, State Department and Treasury Department each declined Courthouse News’ request for comment on the lawsuit, the news service reported.

I'm curious, why does Israel get so much aid?
Israel is a base of U.S in the middle east, also it cooperate with it on large projects that suits both of them , and most of the intelligence on middle eastern organizations and countries come from Israel.
Some say that AIPAC control the aid, but I think it's the military who emphasis on continuing the aid.
Anyhow, many stuff ain't public so

Yes but that much money seems like too much in my opinion, what's the actual point? Israel could do whatever the US needs without a single penny of aid, let alone this much. Maybe it's because of religious purposes? I know republicans are very religious, and Israel is holy for the Christians and there's the whole end of the world thing that Israel apparently is supposed to play a part in or something. Could also help that Jews in the US are quite successful and hold some powerful positions.

At the end of the day, I think it's just lobbyists and religious nuts who get these fat stacks sent.

Israel stops the expansionism of radical Islam in the Middle East, serving as well as a shield that any Islamist group such as ISIS will have to deal with before they attack the further-away Western countries. Not to mention, looking a bit back at recent history, that Israel blew up Iraq's nuclear reactor at Osirak back in 1981, and Syria's too, in Deir-ez-Zor, 2007. Iran's efforts at obtaining a bomb were also hampered by Israel's targeted assassination of Iranian nuclear scientists, and Israel is widely considered to have a hand in the Stuxnet virus. If Israel wouldn't have done all of the above, either America would have had to do it eventually, or the global balance of power would've been upset, something I'm sure the U.S. is happy in retrospect that never occurred, especially considering Syria, Iraq, and Iran all have a reputation as America's enemies.

The US learned a large amount of counterinsurgency techniques from Israel, which saved American lives in Iraq and Somalia. Israeli Special Forces urban warfare specialists also went to Fort Bragg in order to train US Special Forces personnel in aggressive counter-insurgency techniques such as assassination, for use against insurgents in Iraq.

Former Supreme Commander of NATO and U.S. Secretary of State, Gen. Alexander Haig (May he rest in peace) said of Israel "the largest US aircraft carrier, which does not require even one US soldier, cannot be sunk, is the most cost-effective and battle-tested, located in a region which is critical to vital US interests. If there would not be an Israel, the US would have to deploy real aircraft carriers, along with tens of thousands of US soldiers, which would cost tens of billions of dollars annually, dragging the US unnecessarily into local, regional and global conflicts."

Also, 90% of US aid to Israel is military. 75% of that is dumped straight back into the American economy, what with Israeli weapons purchases. Aid to Israel has been described as an indirect subsidy for American arms manufacturers.

Israel co-developed/co-develops multiple weapons systems with the US, along with giving the US a lot of tech that saved many American lives in US and Afghanistan. For example, the US has one of the largest fleets of Israeli-made UAVs in the world. The US also uses the SIMON breach grenade, Popeye air-to-surface missiles, Python air-to-air missiles, Shoulder-launched multipurpose assault weapon (SMAW), that being a shoulder-mounted bunker-buster, as well as the SINGCARS radio, which is the most widely-used tactical radio in the U.S. Army's inventory, and the NTS (Night targeting system, used on Cobra attack helicopters).

Intelligence-wise, Israel benefits the U.S. greatly, as well. According to Maj. Gen. George J. Keegan Jr., former head of U.S. Air Force intelligence, America’s military defense capability “owes more to the Israeli intelligence input than it does to any single source of intelligence,” the worth of which input, he estimated, exceeds “five CIAs.” The amount of American aid Israel received between 1974 and 1990 in military grants was $18.3 billion. America received in return $50-$80 billion in intelligence, research and development savings, and Soviet weapons systems captured and transferred to the U.S.

The U.S. also stockpiles fuel, weapons, food, and munitions in Israel, in case the U.S. ever needs them while in the region. Israeli ports are also used by the U.S. Navy.

All in all, I think the U.S. gets a bang for their buck.
