PESHAWAR: The Peshawar High Court (PHC) on Thursday stayed the decision of the Election Commission of Pakistan for re-polling in PK-95 Lower Dir-II, where women were barred from voting.

The decision was taken in the light of a petition that was submitted by the winning candidate of Jamat-e-Islami, Aizazul Mulk Afkari, against the ECP’s decision.

In the petition, JI maintained that women who had appeared before the court and said that they were barred from voting belonged to an NGO. Further, Ayesha Sayed, a JI MNA, had also informed the ECP that women had had not come out to vote out of their own will and there was no force used nor any agreement.

On June 2, the ECP had ordered re-polling on the constituency and set July 12 as the date for another round of elections on PK-95.

Earlier, around 12 women from the constituency had approached Peshawar High Court through a petition, asking for the election to be declared null and void and to unseat Jamaat-e-Islami’s elected candidate.

However, Peshawar High Court dismissed the petition.

Why not put a ban on all elections for the next 50 or 100 years until our majority is "educated" enough to vote already? :D

Our "democratic" politicians will not allow this or they'll be out of business. You know your country is messed up when your champions of democracy include the likes of politicians who do not believe in women voting.

This is the tribal nature of KPK. I am not sure if other parts of Pakistan are so stupid enough to ban women voting?

The beauty of democracy is, despite the failures and all, it just keeps throwing the bad apples away after 5 years in governance. Zardari faced the wrath in 2013, now it is the turn of Nawaz Sharif in 2018 (also Imran Khan if he did not deliver in K-P)

Every Pakistani has a right to go to court if they feel they have been treated unjustly and it is norm of the court to issue stay order in almost every case. If the court rejects his appeal without giving him a proper chance, it would be violation of his constitutional rights. If the court decides in favour of him, it will be unjust to the ECP and opposition parties.

So the court always find the middle way of listening to both parties, in such case it has to issue stay order to give chance to both parties to present their argument.

LOL :D These PPP and PMLN bad apples have been in Pakistani politics since the death of Zia ul Thug. Get real! They are not going anywhere :D

Nonsense. Election Tribunal took 2 years to arrive to the conclusion that Saad Rafique's constituency was rigged. It took no more than a few days for the higher court to DISMISS that decision by the lower court which it took years to achieve. What justice? :D
 
Very nice! Iam tired of these nonsense bad traditions that make no sense! Let the women vote. Nobody is gonna see them to break their sacredness due them being in Hijab or Burqas anyway then what was the issue?

it is sad to see this female politician acting against females.

having said that, many societies should have learnt by now the falsity of the "elections" system, because it is not real democracy... real democracy is direct-democracy guided by socialism, where each citizen must compulsorily participate in the running of the society.

the female jamaat-e-islami politician and her party itself are clear proof that "representative democracy" does not work for people's welfare.

A stay is just to preserve the Courts jurisdiction. They have not reversed the decision, they have not ordered that the winning candidate be notified by the ECP. They have simply agreed to hear the challenge to the ECP decision. GThe stay is to ensure that there is no new election in the meantime which makes any decision moot (or as our courts say, "infractuous")
