Justice Chaudhry Questions Pak Dual Nationals' Loyalty in Qadri Hearing

Wasn't it expat scientists that came to Pakistan to help in building the nuclear bomb ? Don't they send billions to their home country ? Windjammer and his friend started their help in Floods hit areas.

Politics should have a limit, Loyalty shouldn't be questioned. CJ should be thrown out.

Its because of the Expats the Pakistan had some good image as they are doctors, engineers etc. in other countries whereas the local people bring bad name to country.

issue here is not what dual nationality holder have done or are doing for pakistan, issue is the Qadri's agenda was clearly unconstitutional. he wanted ECP to be abolished and that in other simple words means he wanted to delay elections and in that process may be get help or provide help to some third party. he clearly wanted to delay elections and that only means destabilizing Pakistan further. Pakistan needs to get rid of this government but only through constitutional means.

Also the main point is when Qadri says he travels around the globe on canadian passport then how he can be considered a affected party in the formation of pakistani EC.
 
By law, a dual national enjoys the same rights and responsibilities as any other citizen in each country of nationality, individually, except where prohibited by law.

In casting doubts on the motives for the petition, the Supreme Court needs to explain the legal basis upon which it is limiting the rights of a citizen within Pakistan based on a dual nationality.

I know that a dual national cannot be elected to a high office, but what about seeking redress from the courts, or any other permitted activity?

On what legal basis has the Chief Justice said what he said?
 
CJ need to answer quite a few questions, but who is going to ask these questions from him ? apart from few anchors all others love to praise CJ for no reason.
 
The contents of the proceedings in Qadri case have been widely reported and corroborated by multiple sources about the entire line of questioning which had nothing to do with the merits of the claims made in Dr. Qadri's petition. Instead, the Court chose to impugn the motives and loyalty of Dr. Qadri simply based on the fact that he is a dual national.

This court, particularly its chief justice, is an activist court that exercises absolutely zero judicial restraints. It disregards the letter and the spirit of the constitution and the laws of Pakistan to pursue its own agenda. It attempts to squelch all criticism by threatening frivolous contempt charges regularly.

It usurps the power of other institutions of government, particularly the legislature and the executive....something that has drawn strong criticism of Geneva-based International Commission of Jurists for overstepping its authority.

Justice Katju, former Indian Supreme Court Judge, has criticized Pakistan Supreme Court for "showing utter lack of restraint".

Justice Chaudhry has personally been criticized for his judgements in multiple cases by Chaudhary Aitazaz Ahsan who led the movement to restore him.

Chaudhry and his fellow judges deserve to be closely scrutinized and criticized when they make mistakes. In a democracy, everyone should be held accountable for their actions. No one should get a free pass.

Every Pakistani is effected by events in Pakistan - either do away with dual citizenship or act within the law -- but The CJP had set a precedent when he went after parliamentarians holding dual nationality -- the unfortunate thing about our so called parliamentarians is that the majority are not really of the caliber to understand and be willing to act on conviction, because their "vulnerabilities" are known to other players in the system.

Legislatures are about making and refining LAWS, our parliamentarians choose to differ with this suggestion

The present direction of the Supreme Court is indeed unfortunate, and it will only end in more problems for the country, unless changed.

The precedent that the CJ set when he went after dual nationality has opened up a Pandora's box of problems. You are correct, either do away with the dual nationality, or act with the law and treat all citizens fairly and equally.
 
There is difference in ordinary citizen of Pakistan with another nationality andthe other one claiming to be the saviour of Pakistan whho even dont want to live in Pakistan like Altaf Hussain, Qadri, our other political leaders etc. also
We should also ban our politicians whose children and families do not live, study, business or medical treatment in Pakistan thats why they are not providing better infrastructure in Pakistan cuz they dont have any inetrest other than making public fools and stealing and corruption

Why only politicians? Why not ban the judges, bureaucrats and officers whose children and families do not live, study, do business or receive medical treatment in Pakistan also?

CJP is instrumental in keeping the country on the democratic bearing. It has ordered that overseas Pakistanis (including dual-nationals) be facilitated in voting. But SC has been very clear in not allowing dual-nationals be part of parliament, or getting involved in constitutional questions esp. just before elections.

The facts are being twisted to make it seems as though SC and CJP is somehow working against the interests of dual-nationals. I am a dual-national, and I should not be allowed to contest elections because I have taken an oath of loyalty to another country. I have no problem with that.

Only three types of people find issues with SC and CJP. 1. pro-Musharraf tribe, which one finds in defense related websites. 2. People whose political alignments make them biased (PPP, MQM, etc...), 3. Various pro-Army people who are clamoring for some sor of extr-constitutional setup. TuQ supporters are among them.

When you say "CJ should be thrown out", you are insulting people like me who were active in pro-judiciary movement. We did not make sacrifices only to hear Indians tell us that we should throw out CJ.

Try to analyze the various anti-Supreme court and anti-CJP posters and you would find out the truth.

TuQ made a big drama for the last two months and people had been openly wondering if SC was part of a conspiracy to bring down the government and help instal a technocrat setup. When SC ordered that people related to Rental Power scandal be apprehended, TuQ was in Islamabad with thousands of followers trying to give an impression that he is calling the shots with many journalists questioning SC's motives. SC HAD to hear his petition and set the record straight.

People descrying treatment given to TuQ and crying over the 'plight' of dual nationals are intentionally twisting a straight forward judgement.

The OP is motivated by something that is not in Pakistan's interest.

Have you read the SC short order? Or do you know the rationale of this judgement? What is the basis of your claims?

SC questioned how come a dual-national can move a dangerous petition barely three months before elections. What is wrong with that? How does that make you say "pakistanis who send, millions & billions to pakistan they are not patriots"?

The short order did not indicate the rationale. It says that the reasons "will be recorded later".
