ISLAMABAD: Supreme Court would announce its decision on the judges’ appointment and emergency enforcement case until Friday, while the Chief Justice has saluted the parliament for not ratifying the November 3, 2007 actions relating to emergency enforcement.

Later, Attorney General said that the government would abide by the principles relating to the judges’ appointment set by the Supreme Court.

Supreme Court 14-member larger bench headed by Chief Justice, Iftikhar Muhammad Chaudhry was hearing the judges’ appointment case, when Attorney General, Latif Khosa told that whatever principle the Supreme Court would outline relating to the judges’ appointment, government would abide by it.

CJ, Iftikhar Muhammad Chaudhry on one occasion in his remarks said, “He salutes the parliament for not ratifying the Nov.3, 2007 actions, existing president, prime minister and the parliaments’ elections were held in accordance with the constitution.” He further said that July 5, 1977 came because nothing was done for stemming this torrent and Shaheed Bhutto was hanged.

The Court called for a comprehensive written statement relating to the existing government’s stance on Nov. 3, 2007 actions, while AG said, “The government doesn’t recognize these actions, however, he would submit written statement on this issue tomorrow in the Court after consultations with the higher authorities.

AG said that the revision on the decision of Tikka Iqbal case would be effective on onward matters and didn’t want to go back into PCO or non-PCO issue. Judges had taken oath on December 15, 2007 under the constitution, when Justice Khalilur Rahman Ramday said that Nov. 3 was ‘Najis’, then how come it was wiped out by scented soap on December 15. Further in his remarks, he said that what was the status of Abdul Hameed Dogar would be looked into afterwards. He said that Nov. 3 emergency was not martial law, it was the law of a General and Army was not at fault. Nov.3 actions were given the name of emergency for misleading the people.

The petitioner, Sindh High Court bar president, Rashid A. Rizvi arguing the case said that former president, Pervez Musharraf in an interview with the British Broadcasting agency had admitted that the clamping of emergency was unconstitutional, therefore, Tikka Iqbal case decision be declared void.

The chief justice heading the bench in observation said that the decision of the case would be taken by Friday.

Later, the court adjourned the hearing until tomorrow.
