Italy takes India to int'l arbitration over marines

You cant imagine how I eagerly wait for India to be embarassed in front of the whole world!

I hope Pakistan offers Italy support and if required a combined military force! Both Pakistan and Italy military force can match India!
!

I think India should arrest the Italian ambassador until Italy surrender the other marine. If the Europeans response with force,India can show them the power of. Brahmos.

Ok. It may be that's how your country (whatever it is) solves their problems but in India we believe in rule of law

Its time for the world to know that superpower India exists outside of movies.

Now it is clear that the right of appeal still is available.

In Pakistan normally the cases of India are coated because they have many similarities but not all accounts are valid in Pakistan due to some Islamic provisions. Non the less the issues regarding the Indian Supreme Court are given equal respect.

Well i would be honest, Indian SC has had some bad apples too and allegations of corruptions but usually whenever there is bench of three or more judges you can be assured judgement would be legally sound and worthy of respect.

Right now we have a collegium system where in judges appoint judges. Stupid politicians are trying to change it so that politicians have a say in appointment of Judges. This is because Indian Supreme court has been very activist in nature and regularly reprimanded the Govt and given landmark judgement like convicted politicians cannot stand for office.

I guess all good things have to end :(

In Pakistan it is the same System too Judges appoint Judges but there are ways to have Adhoc Judges too. They are normally directly appointed by the Government but they still have to go through the collegium system to get the cases.

Constitution of Pakistan also has the provision to bar convicted politicians. The best example is that of Ex. PM Yousaf Raza Gilani who lost his office in a contempt of court charge and was banned for 5 years to contest elections.

If we compare the two countries atleast the Courts are learning from each other and trying to take those decisions that are positive. During the last 7 years Pakistan Supreme Court has taken up many cases that have really been a sour issue for the Government. The current Chief Justice Supreme Court is not taking many suo moto cases like the previous Justices were taking.
 
One of the marines is not in India, He was allowed to go to Italy for medical reasons and has been in Italy for more than six months. The second marine is comfortably staying in Italian Embassy not in a Jail.
Considering the fact that Indian justice system moves in snail's pace...not really sure why they couldn't fast track this case. This was an international incident right from the start...& there was huge furore both in India & Italy. Considering what is at stake here (diplomatic relationship between India & Italy)...one would have thought this would be fast tracked & justice would be served at the earliest.

As far as marines staying comfortably at Italian embassy...obviously that would have been the part of the deal when the marines came back last time around after casting their vote in Italian elections. A real surrender by the then Indian govt. & it's a pity that no media picked up on that.

There is a system that is fast but unfortunately India was not interested. India would gain much more than out of court settlement and also save the image of a strong and Law abiding State.

Yeah, I remember one of your judges Mr. Iftikhar Chaudhary, he was a real firebrand!!

In the end courts can do only so much. There is always a threat to brave justices from nefarious interests be it politicians, militants or industrialists. What i do believe is once the judges have given their verdict whether good or bad, it must be enforced with full power of the state. If rule of law collapses or is not enforced it is then the country becomes a failed state. Nothing else is more important for a country.

In India we had a dark time during emergency when all judges were puppets of Indira Gandhi, everyone knew that judges verdict regarding emergency was not correct but still our army and police enforced it. People waited and filed appeals in Supreme court and the full strength of Supreme Court i.e. all twelve judges delivered a final verdict which is hailed as a landmark judgement all across the world from US to Bangladesh. Just a few months ago US Supreme Court Judge quoted that verdict in some case.

Look this is not as simple as that. Matters were complicated because of Italy connection as Sonia Gandhi is of Italian Origin and the congress couldn't be seen to be taking side of Italians.

Italians also were arrogant, making unreasonable demands, breaching promises and insulting our highest court. This became a matter of sovereign integrity and prestige on both sides.

What was a simple case of non voluntary man slaughter i.e. just like a traffic accident or something where in most cases sentence is suspended and accused never has to stay a day in jail now has snowballed into a huge mess. Neither side will back down and I see a major split in Indo-Italian relationship

Why fast forward, aren't there so many other cases which deserve attention rape cases,terrorist ones, drunken accidents...etc? India should not kow-tow to white mans whims and fancies. Any attempt to tinker with pace will lead to miscarriage of justice.

Remember bhopal disaster when warren anderson just walked out of the country with help of politicians. Politicians and diplomats should stay out of it. Devyani case americans said the same thing that they cant interfere in justice matters.

These goras think they are special and above the law. In our usual bureaucratic style we should drag this case for another 20 years (usual time in india) , make them suffer and start the case all over again :p:. This will put fear into all those ppl who think india is banana country where they buy out politicians, police and get away with it. There will be international outcry and lot of noise we should not care to give a damn about it.
