Headely is accused of conspiring terror attacks in India. Interrogation nod maybe given ahead by FBI but their local court may have rejected the plea until he is proven guilty unlike kasab who is caught red-handed

Thanks for bolding it as well as explaining...Just see you are saying "may have"...Again i said whatever the reasons may be "Our investigation team went there and came back empty headed"...Now whosoever fault it is ...communication gap...Babus fault...US fault it indeed is humiliation...Instead of telling me why they were not given access please tell me why you think this is not humiliation...It is simple you went there with a purpose and were denied because of X Y Z reasons..if this is not humiliation than what is???

Now what GOI should do is to sort out the reasons and ensure that our investigators did get their hands to this guy...This will save the face to some extent...


P.S: May be you are getting confused by the title "SNUB".. I do not support it however i say that it was humiliation for us becuase we went there making claims that we will talk to the terrorist but failed to do so because of whatever reasons...I am fine if you want to tone down the word from humiliation to something more subtle...

This development may have taken place while Indian Intel team was leaving for US or when they are in US itself as they were rushed after his apprehension.

The questions you are asking can be cleared after case conclusion but nevertheless, he appears to be handler or snitch send to take survey of sites. That can be the sole objective to send a canadian or american citizen. OTOH, i dont think he is a foot soldier.

Call it Snub or Humiliation, it is embarrasing for the GoI.

Lack of planning, comm gap and an assumption that FBI will let foreign officers into their investigation are causes of this issue.

Secondly, Indians need to understand that Pakistan is important to the US and for now they will not do anything to hurt the existig relationship.

Too late..even if it is truth people are going to take it as a spin to cover up the humiliation..However it has raised doubt in my mind. earlier i had very strong views that its humiliation of our team but now i am wondering why the heck they went to Washington if the purpose was to interrogate ... but i will wait for more details to pour in before changing my POV...

US laws entail that once an accused is in court's custody, one needs permission from the court to interrogate the accused. In our case IB and R&AW couldn't get the required permission from the court.
Generally, even if permission is granted, the accused can be interrogated only in the presence of his lawyer. Even the FBI can not interrogate him in the absence of his lawyer! That s US law.

An agent, who was part of the joint IB-R&AW team, told rediff.com that a local court had turned down their plea to meet the Pakistani-American.

"In the United States, it is important to obtain the court's permission before interrogating anyone on its soil," the agent said, requesting that his name not be mentioned in this report.

An application was filed before a local court, but it was rejected, he added. "We were unable to convince the court that we had sufficient grounds to interrogate Headley."

When asked why the team had traveled to the US without completing the groundwork, the agent said IB and R&AW officials had communicated the team's agenda to the FBI who had given them the go-ahead to interrogate Headley.

"But Headley was in judicial custody and we needed the court's permission to question him. We would have had no problems had he been in police custody," the agent added.

India on Thursday (November 12) said that it will press for extradition of Lashkar-e-Toiba (LeT) linked David Coleman Headley and his accomplice Tahawwur Hussain Rana. Sources in the Home Ministry say there is enough evidence to link Headley and Rana to the LeT terror outfit. The proof has been handed over to Federal Bureau of Investigation (FBI) which will present it before the Chicago court trying the men.

Earlier, the National Investigating Agency (NIA) has registered a case against suspected terrorist Headley and Rana to probe their role in various terror strikes in the country including the 26/11 Mumbai attack. Giving details, Home Minister P Chidambaram told reporters in New Delhi that this was the fourth case registered by NIA in 2009 in connection with the 26/11 Mumbai attacks. The NIA "has been directed to take up investigations", he said.

Maintaining that Headley had visited India "several times before 26/11 and once after" the Mumbai terror strikes which left about 180 people dead, Chidambaram said "we are conducting investigations in the cities he visited to find out whom he met and what he did." The Home Minister sought the allay fears about a possible terror strike and asked media to desist from raising an alarm. "I don't think there is any connection with the alerts issued to the states."

The Union Home Ministry has alerted six states including Uttarakhand, Maharashtra, Delhi and Uttar Pradesh last night to keep a tight vigil on important installations especially those belonging to the military. Observing that the investigators would try to find out what Headley did during his visits to the country, the Home Minister said "whatever steps have to be taken, will be taken.”

Read my previous post again...that clearly states " the National Investigating Agency (NIA) has registered a case against suspected terrorist Headley and Rana to probe their role in various terror strikes in the country including the 26/11 Mumbai attack " based on the evidence provided by FBI and indian's own investigation and thats why they are asking the duo's extradition.

Now thats where the confusion is...There are two many theories...based on them here is my stand..

a) We went there with the objective of interrogating and could not then it indeed is a little humiliating(no matter if it was US law or anything...Those things should have been sorted out before calling the shots)

b) We went there with the sole objective of gaining more information from US authorities...then the blame goes to media for overcooking the story which ended up being looked as a humiliation for GOI

I will rest my case...better wait for more news than to speculate...
