India rape: Second uncle held in 10-year-old pregnant child's case

A second uncle of a 10-year-old Indian child who gave birth to a baby girl last month has been arrested for allegedly raping her.

He is the younger brother of the uncle who was arrested earlier and charged with raping the girl, police said.

Police began looking for a second suspect after forensic tests revealed that the baby's DNA samples did not match those of the first accused.

Child welfare activists say the first suspect remains in custody.

He is not absolved of charges against him and his trial is under way in a special court dealing with crimes against children. He is in prison and has made no statement so far.

The latest arrest was made on Tuesday evening after the girl named the second uncle in her conversations with the police and counsellors.

"The girl stated that her 38-year-old uncle had also abused her," a senior police official in Chandigarh city, Neelambari Vijay, told BBC Punjabi. She said police had sought permission to test his DNA samples.

The BBC's Geeta Pandey in Delhi says the harrowing case of the 10-year-old has made headlines for weeks, both in India and globally.

Her pregnancy was discovered in mid-July when she complained of stomach ache and her parents took her to hospital.

A local court in Chandigarh turned down the abortion plea on the grounds that she was too far into her pregnancy after a doctors' panel advised that termination of the pregnancy would be "too risky". Later, the Supreme Court also refused to allow an abortion for her on similar grounds.

The girl was not even aware of her pregnancy, and was told her bulge was because she had a stone in her stomach, our correspondent adds. Her baby was given away to child welfare authorities for adoption.

The girl initially told police and child welfare activists that she had been raped several times in the past seven months by the first uncle to be placed under arrest, who is in his 40s.

She had also testified to the court by video link and very clearly named the uncle and revealed facts about her abuse.

The girl's father had earlier told the BBC that the first accused had not denied the charges against him. Police too said he had admitted to the allegations.

But after his DNA test results did not link him to the baby, police began searching for more suspects. They have also asked for a re-check of the forensic tests to ensure there has been no error in the DNA report.

Indian law does not allow terminations after 20 weeks unless doctors certify that the mother's life is in danger. The country's courts have received several petitions in recent months, many from child rape survivors, seeking permission to abort.

In most cases, these pregnancies are discovered late because the children themselves are not aware of their condition.

Earlier this month, a 13-year-old girl was given court permission to terminate her pregnancy at 32 weeks. The boy she was carrying was born alive in Mumbai but he died two days later.

In May, a similar case was reported from the northern state of Haryana where a 10-year-old, allegedly raped by her stepfather, was allowed to abort. She was about 20 weeks pregnant, doctors said.

None of the girls can be named for legal reasons.

sorry but i can't accept that a 13 year old girl don't knew she is pregnant until she is 32 week old.
and the fact that her father and mother also didn't understood the situation is suspicious .

I wonder why police don't look into it from that perspective , don't forget children can be fantastic liars,if they want.

by the way wonder why the court ordered immediate Caesarian Section instead let th medical communities decide on when to end the pregnancy .just one or two week of waiting meant a lot for the mother and child . even they could have ended the pregnancy naturally if the proportion and position of the child was more normal and that would have been a lot better and less traumatic and less dangerous for the mother.

its very much possible in Indian context not to know... sex education is virtually nil...
anyway if the second uncle's dna does not match, then we need to widen the net, to the father and other relatives.
i presume court order is based on medical panel's suggestion, courts seldom decide like this without expert opinion

the case is about a 13 years old girl not a 10 years old one .so don't play that with me . she had saw a lot of pregnant woman in her family by that age and what about her family ,neighbors , school teachers , ........ were they also innocent?

Indian girls like many other girls of warm climate area mature 1-2 year sooner than girls from countries like Scandinavian area ,and you believe for 7 month her menstruation cut off and nobody in her family realised that, and a teenage even was not curious about that?

by the way its not much of the Sex Education its common sense to believe a girl of 13 in a country of 1 milliard have seen hundred of pregnant woman by that age , saw a dozen in her relative heard a lot when older female talk between themselves .have seen several TV program that has shown her several pregnant woman .
you expect in pregnancies at such young ages she show exaggerated symptoms like nausea , gastric discomfort and her body shows a lot more than an mature woman that at least on in her family examine here closely.

honestly I smell some cover up in the family and even if one of the uncles DNA test show positive it just means he is only the father it won't mean no other in the near family is not participating in the crime.

its news because for 7 month nobody cared at all why the 13 year old unmarried girl is pregnant . for me its news because as doctor i wonder why the court ordered on ending the pregnancy at 32 week while the doctors stated they can wait 1-2 week and end the pregnancy a lot safer for both mother and child as now the child is dead and the mother scarred and in danger of not being able to conceive any child any more and C/S complication also I wonder how the judge could be sure the baby is 32 week not 30 wee or 29 week as its impossible to tell when you stimate the age of child late in pregnancy.

I am no doctor, so cant question why indian doctors decided to go at 32 week, all am saying is, courts must have acted based on their input.

Indian court ordered the doctors to end pregnancy at a date they think it was 32 week, the point is the doctors wanted to wait for another two week.
