Adviser to Prime Minister on Foreign Affairs Sartaj Aziz on Saturday said the International Court for Justice (ICJ) cannot nullify Indian spy Kulbushan Jadhav’s death sentence.

“Jhadav had confessed to carrying out terrorist activities inside Pakistan and was a naval officer using a fake passport. He was sentenced according to the country’s law,” Aziz said while addressing the media in Islamabad.


Jadhav was arrested in a counter-intelligence raid in Mashkel, Balochistan in March 2016. In a video confession released soon after, he confessed to being assigned by India’s Research and Analysis Wing (RAW) to plan, coordinate and organise espionage and sabotage activities in Balochistan and Karachi with an aim to destabilise and wage war against Pakistan. He was convicted last month by a military court and sentenced to death.

The adviser said India’s stance that Pakistan was defeated by the recent International Court of Justice (ICJ) verdict was inaccurate. “A wrong impression was created by Indian media that Pakistan has lost the case,” Aziz added.


Responding to a question as to why no judge was sent on the day of ICJ’s hearing, he said the government could not appoint one within a short notice of five days.

“We will go with a strong team in the next hearing,” Aziz said adding that even if Pakistan had chosen an ad hoc judge, the ICJ’s verdict would not have changed.

The United Nations’ top court recently ordered a stay in the execution of Jadhav. Judges at the ICJ ruled that Jadhav must not be put to death by Islamabad until they have had time to pass final judgement in the case

Now they are scrambling to appeal to a court which they claimed had no jurisdiction.

The case in ICJ is not at all about the merits of jadhav's alleged violations - rather it is about Pakistan's violations, which now have been proven in so many words in the ICJ's order to Pakistan.

It is high time to play ICJ with Kashmir. File case today itself and hang this case outcome with Kashmir case. checkmate to India.

Those are provisional measures for the duration of the case, India didn't achieve anything other than request the obvious decision for the court to take; Pakistan wasn't planning to execute him anyway while the court case was running so celebrating it as a victory is pointless. India's main demand of consular access, hasn't been granted so they have not won anything.

Pakistan wasn't planning to execute him that's is your wish. but icj gave order to not hang him and also give India for counselor access.

If ICJ grants India a counsellor access, Pakistan still has a bilateral agreement which nevertheless accepts counsellor access given India meets our conditions and ICJ cannot annual or surpass such an agreement.

So even if India gets a favourable decision, they are still barred unless they cooperate and expose RAW's network to Pakistan. Do you see this happening? Such a decision by ICJ will put pressure back on India to cooperate with Pakistan on terrorism and expose their network.

We might see another round of requests by India and then by Pakistan and failing to meet condition will lead to hanging of Indian Terrorist Kulbhushan Yadev.

In the past, ICJ has always given a similar ruling for a case related to subject awarded death sentence. It's not a huge victory for India. While staying the actual execution for the time being, the court hasn't asked Pakistan for granting counselor access to the busted Indian terrorist Jadhav. The court however has not accepted Pakistan's contention that the case doesn't fall under the court's jurisdiction. But the fact is that court cannot nullify any country's local laws. If, for some reasons, the court decides to that effect, Pakistan can flatly refuse its verdict. ICJ's verdicts are not binding unless both the parties have agreed before the proceedings of their case start. In this case, Pakistan, like many other countries, has already declared that it does not accept court's jurisdiction in matters related to its security. At the end, as Sartag Aziz said, only Pakistani law will prevail. However, Pakistan needs to pursue this case at the ICJ. For one, it offers a privileged opportunity to Pakistan to expose the terrorist face of India to the world. Also, this case might open up new possibilities to bring India to this court for other gave offenses.
