ICC directs PCB to bear 60 percent of BCCI’s legal costs

The International Cricket Council (ICC) has asked the Pakistan Cricket Board (PCB) to bear 60 percent of the legal costs which the Board of Control for Cricket in India (BCCI) had to bear to defend itself in the ICC’s dispute panel hearing. The PCB had alleged that the BCCI did not honour an agreement signed in 2014 on bilateral cricket and sought a compensation to the tune of $70 million. However, the ICC’s Dispute Panel had dismissed Pakistan Cricket Board’s compensation claim against the India board after which the BCCI filed a counter case against the PCB to recover the legal cost.

In a statement released the ICC said, “The Dispute Panel has determined that the PCB should pay 60 per cent of: “(a) the [BCCI’s] Claimed Costs; and (b) the administrative costs and expenses of the Panel which fall within the scope of paragraph 11.4 of the T/R (including, without limitation, the fees of the Tribunal members, and the costs and expenses they incurred in relation to this matter), the figure whereof is to be supplied to the PCB by the ICC.”

So not only does the PCB have to pay 60 % of what BCCI claimed but another 60 % for the administrative costs and expenses of the dispute Panel including their fee etc.

Earlier, COA Chief Vinod Rai had expressed satisfaction over the judgement by the dispute panel and said that the BCCI will file a compensation case against the PCB to demand the cost of arbitration. “We will make a presentation to the panel and demand entire cost of compensation to be borne by the PCB for the arbitration where there claims have been dismissed,” he had said.

ICC also said that the decision from the panel will be final and cannot be challenged.

Failure for Pakistan and lesson that India cannot be trusted. The PCB management who made the deal should and will hopefully be punished for this. NAB will have to probe why Najam Sethi & Shahryar Khan made such an incomplete deal.

Deal was India will play series in Pakistan against PCB's support for big three, where India, England and Australia will get majority share of ICC funds. Pakistan would have been compensated by revenue from home series. But as per court decision India did not sign a binding contract which is why Pakistan lost the suit.

ICC bought by India long back and to sue BCCI at ICC is just a mistake and foolishness.


ICC is bought by India, World bank is also bought by India (there also Pakistan keeps loosing its cases against India).

It is pitiful, how you people are so convinced of your own rhetoric, end up loosing all your cases.

ICC bought by India long back and to sue BCCI at ICC is just a mistake and foolishness.

Best and realistic approach is to come out completely and start and alternative of ICC by your won with the association and help from friendly cricket playing nations. Even BCCI had threatened ICC with the same few years back during the big three profit sharing issue I guess and succeeded to a certain extend. Why not give it a try ??? :enjoy::enjoy::enjoy:

Emotions aside. It is not a matter of trust or trustworthiness. There is a good reason why PCB ended up loosing this case. I bet if you take it from ICC to any international courts of arbitration's, again PCB will have to eat the dust there as well.

First and foremost understand the term MoU. Memorandum Of Understanding as the name states is just an understanding between two or more parties engaging in the agreement and there is no legal obligation whatsoever to follow the same. Otherwise, there should be a clause added in the agreement specifically stating the penalty is any party unilaterally withdraws. But then it won't be an MoU anymore, rather becomes a contract with a sovereign guarantee.

Nopes, PCB knew that it was not BCCI's decision but GOI that has instructed them not to play. They just tried to make some money using BCCI's constrains and compulsions.

Lahore December 19: The PCB notes the ICC Dispute Panel’s decision on BCCI’s claims for their legal expense incurred on the PCB-BCCI dispute. The award of significantly lesser costs than claimed by BCCI reflects that PCB's case had merits.
The PCB, however, reiterates its disappointment in the original decision/award given against it.
