SC declares GST hike unconstitutional; demands withdrawal


The Supreme Court on Friday declared unconstitutional the one per cent increase in general sales tax (GST) and ordered immediate withdrawal of the hike, DawnNews reported.

A three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry, was hearing the case initiated on a suo motu notice following the sudden increase in petroleum prices.

Earlier, the price increase came after Finance Minister Ishaq Dar proposed in his budget speech that the GST be raised from 16pc to 17pc.

During today's hearing, the bench observed that the government did not possess the right to impose an additional sales tax, adding that it should be withdrawn with immediate effect.

Moreover, the decision of nine per cent additional sales tax on Compressed National Gas (CNG) was also declared unconstitutional.

The court said no additional tax could be imposed without approval of budgetary bills before the Parliament in the shape of a finance bill.

The bench ordered the government to deposit all the money recovered through imposition of additional sales tax to the office of the Supreme Court Registrar, saying it was refundable.

The Supreme Court will announce its detailed judgment on the case later.

good step by courts.now we will see how pmln reacts in previous government they use to cheer on such court ruling against ppp wrong polices or decisions.

and when Surmay dani Ishaq Dar faced tough questions in Parliament over GST he replied cut army budge by 50 million i will not impose GST .If they stop this gutter spending like mentioned above they did not need GST and now they are scapegoating army budge on this as well.

SIMILARLY when on recent terrorism in Baluchistan so called jamhori champion Achkzai blamed agencies along with Interior mintier Ch Nisar .while facts are out of 7000 security personnel in quetta 6000 were on vip security as told by MAlik in his program on dunya news .That the reason that yesterday Interior Minister Ch Nisar made the decision of calling back police and FC from vip security and on pm and president will get security .

also BLA and Lashkar e Jhnvi are allies .lashkar main base has always been Baluchistan and they originated from there .they have been ethnic cleansing Baluchistan from hazara and shia to make it land of pure but they did not mention that and to save them from humiliation of security lapse blamed every thing on agencies
